HomeMy WebLinkAbout2001-08-29-Special MinutesWAUKEE CITY COUNCIL MINUTES SPECIAL MEETING August 29,2001 (1)Call to Order -The August 29,2001 meeting of the Waukee City Council was called to order by Mayor Bailey at 7:00 PM.The Mayor asked for a roll call. (2)Roll Call-The following members were present:Mayor Donald L.Bailey,Jr,and Council members Nicholas Gruber,Marvin Berger,Mike Watts,Wayne Johnson and Bill Peard. (3)Agenda Additions /Approval -No changes.Bill Peard moved to approve agenda as is.Wayne Johnson second.Ayes:All Nays:None.Motion carried 5-0. (4)Resolution:Approving Library Site Plan.Douglas Saltzgraver with Engineering Resource,described the site plan for the Council.Wayne Johnson requested information concerning the lighting proposal.Mr.Saltzgraver suggested that it would be either the shoe type box or something where light would not be shining on other properties.Further discussion elicited the possibilities of having shoe box lights on the perimeters and lights closer to the building,which would broadcast the light.It was also suggested that although most of the lights would be on a timer,it would be good to have one or two running during the evening and early morning for security purposes.Mayor Bailey addressed the issue of the sidewalk and said he thought the sidewalk was on the wrong side.Mr.Saltzgraver indicated that where they placed the sidewalk was perceived by them to be the safest route for crossing.It was further suggested that patrons will create their own paths.In future years modification of the current sidewalk system can take place to accommodate actual use patterns.The site plan has areas devoted to parking lot expansion.The driveway as originally envisioned would have required approximately 30%more funds to complete.The driveway as shown in the Site Plan minimizes the expense associated with the construction of the driveway.The design was such that the grading was to be balanced on site where dirt could be moved to an area from another area on the site.Mr.Saltzgraver visited with the contractor of the Lutheran Church, which has a large pile of dirt directly south of the Library site.Because that was extra dirt for their project the Library site developers can take that dirt for fill and not have to take quite as much from the northeast comer of the site.Mr.Saltzgraver indicated the water retention area will have water from a heavy rain for 2 hours at most.Wayne Johnson brought up the issue of access from the west.Joe Schmitt said that had been broached to the property owners to the west;however no one had come forth.The easement for the "path"would have to be approximately 10'wide,which is a large swath to be taken out of anyone's yard.Dennis Dowell indicated that at the P&Z meeting the previous evening,a recommendation was made that the sidewalk along Warrior Lane be shown on the site plan.Discussion on the completion date of Warrior Lane will basically be coordinated so that the paving of the street and the use of heavy equipment do not coincide any more than absolutely necessary.Nick Gruber moved to approve the site plan contingent on completion of the recommendations of P&Z,which included drawing the sidewalk along Warrior Lane on the site plan and the twelve items previously listed in 1 a letter from the engineers.Bill Peard second.Roll call:Ayes:Gruber,Peard,Watts, Berger,Johnson.Nays:None.Motion canied 5 -O. (5)Resolution:Approving Library Site Development Bid Package.Material was delivered Friday of last week,which included all of the site-related information.The changes from the site plan were addressed in the bid package and included (1)a suggested change in the water main hook-up by John Gibson,which saved about $10,000 and (2)John Gibson requested additional flumes in the water retention area.The sidewalk along Wanior Lane is not part of this package and will not be included.No further discussion.Bill Peard moved to approve the bid package with the suggested changes.Marvin Berger second.Roll call:Ayes:Peard,Berger,Gruber,Johnson, Watts.Nays:None.Motion canied 5 -O. (6)Resolution:Approving the final plat for Westgate Plat 4 The issue brought up by Paul Huscher,the City Attorney,has been resolved to his satisfaction.They still have to add barricades at the end of a street in the development.Mike Watts moved to approve contingent to completion of the punch list.Bill Peard second.Roll call:Ayes:Watts, Peard,Johnson,Gruber,Berger.Nays:None.Roll call carried 5 -O. (7)Public Hearing:On approval of the Waukee Comprehensive Plan.Continuation of the public hearing from the August 20 City Council meeting.Discussion and question/answer period of the previous presentation were continued from the previous meeting.Changes suggested at the previous meeting were addressed in a letter sent to Chad Weaver,the City Planner.The current comprehensive plan map shows the short- term potential annexation areas of the City.During the previous discussion,Council suggested that an area designated as Phase II development should be included in that map.Gary Lozano of RDG suggested this area,which is long,long term development, should be identified as Waukee growth area to avoid the confusion with the short-term goals.Discussion continued as to the boundaries of that area.Mike Watts asked what were the number of years a comprehensive plan encompasses.Mr.Lozano indicated the focus of a comprehensi ve plan is twenty years out.Actual implementation of the plan results in review of it more frequently than every twenty years.Cities with vigorous growth or unexpected changes in growth need to revisit the plan more frequently such as every five years.Mayor Bailey requested seeing a map of All areas of short term potential annexation and long term growth with an overlay of current property owners. Mike Watts continued the discussion of the potential growth area boundary lines and questioned why the map didn't reflect growth in the south,southwest areas from Waukee. Staff indicated that a proposed lO-year moratorium with West Des Moines would preclude development in that area for the immediate future.According to Jody Gunderson,our southern borders have essentially been set by our current sewer capacity. Growth beyond that area would include continued lines and development of a lift station. A map developed by Nick Gruber was circulated as a suggested map to be included in the comprehensive plan.Discussion continued with the Highway 6 north development plans. Gil Stanley expressed concerns as to future plans for the area immediately south of Meredith Drive on V Avenue.The comprehensive plan as it exists does not go past Douglas Ave so would in effect not impact the area Mr.Stanley is concerned about.Mr. Stanley also asked about the Iowa DOT Bypass Route proposed a few years back. According Mr.Lozano the Outer Loop of which Mr.Stanley was speaking was discussed and a preliminary conidor study completed by an engineering firm.Beyond that nothing 2 more was done and the project has not been included in the M:PO plan nor is it on a DOT list of projects to complete.The project doesn t have a status and cannot be planned around.As of now it does not exist.As the months and years progress changes, developments,proposals must be reviewed,as they occur to determine the impact on the community and the community's comprehensive plan.If modification of the comprehensive plan is necessary,it can be done at that time.Modification of the comprehensive plan can be done at any time.Mr.Lozano continued to say that according to state law,if a zoning change is to occur it must be consistent with the comprehensive plan.RDG will give staff a digital copy of the comprehensive plan and the associated map so that changes can be made easily as needed.In the process a public hearing has to occur as part of amending the plan.Mr.Stanley continued his questioning with regard to the voluntary vs.involuntary annexation.The City has in the past adhered to "100%" voluntary annexation.It has not used an 80/20 annexation,which is a mix of voluntary and involuntary annexation.It is not the intention of the City to use an 80/20;however, as the City continues annexing areas,an 80/20 might be the only method available in certain situations.Mark Arentsen interjected that he thought because of where Mr. Stanley's property is located,voluntary annexation is the only way his property would be annexed by the City of Waukee.Another individual,Jeff Downing mentioned his concern regarding the zoning of the area between Warrior Lane and Alice's Road north of Hickman Rd.The area in question is currently zoned C-I,Community and Highway Service Commercial District then M-I,Light Industrial District and then A-I,agricultural district.In the comprehensive plan the initial area north of Hickman Road is zoned similarly to the current zoning plan and is listed as Hickman Avenue Mixed Use Corridor,then the area immediately north is zoned Commercial,then High Density Residential replaces the currently zoned M-I area,Single Family Urban Residential immediately follows in the current A-I area.Mr.Downing is concerned with the implication of the switch in planned development conceptualized for that area.He foresees conflict arising when he begins developing the currently zoned M-I area,which is conceptualized in the comprehensive plan as a High Density Residential area immediately followed by a Single Family Urban Residential area.Council and staff duly note his concerns.During further discussion,Chad Weaver indicated that area could be rezoned by a decision of the Council so that it reflects the comprehensive plan.Rezoning doesn't always have to be initiated by the developer or concerned citizen.In addition, Mr.Lozano indicated that,in fact,staff and RDG reviewed the comprehensive plan with respect to zoning and in several instances modified the comprehensive plan to reflect the current zoning.However,there are two or three areas where the comprehensive plan is inconsistent with the zoning map.These areas should be identified by the staff and then discussed with the zoning commission.The Council is ultimately responsible for modifying the comprehensive plan or the zoning map.Jeff Downing indicated that his only concern is "if the developer comes in with some sort of plan under current zoning that it doesn't get unduly delayed because this map is different."Jerry Steele,Planning & Zoning Commission Chairman said that he didn't think that should be a concern,because Planning and Zoning always refers to the zoning map and not to the comprehensive plan. If there is a conflict,the zoning map prevails.The only time the comprehensive plan is reviewed is when the zoning is changed.Jerry Crowe indicated the zoning map must be modified now to comply with the comprehensive plan or that the comprehensive plan 3 needs to be changed to reflect the zoning plan so that both reflect the same.According to Gary Lozano,the zoning map should reflect the intentions of the comprehensive plan rather than the other way around.The zoning map will change frequently whereas the comprehensive plan changes relatively infrequently.Bill Mueller,an engineer and Library board member indicated that the plan "Looks good to me.This is a plan for the future and is a good job."Have not received any written comments.The Mayor closed the public hearing on the Comprehensive Plan. (8)Resolution:Approving the Waukee Comprehensive Plan Nick Gruber moved to approve the comprehensive plan with the changes mentioned during the discussion.Bill Peard second.Roll call:Ayes:Gruber,Berger,Watts,Peard,Johnson.Nays:None.
