September 10,2001
(1)Call to Order -The September 10,2001 meeting of the Waukee City Council was
called to order by Mayor Bailey at 7:00 PM.The Mayor asked for a roll call.
(2)Roll Call-The following members were present:Mayor Donald L.Bailey,Jr,and
Council members Nicholas Gruber,Marvin Berger,Bill Peard,and Wayne Johnson.
Councilman Mike Watts absent.
(3)Open Forum -Joe Schmidt,Library Board President,reported the Board of
Trustees set the date for the Library's "Meet the Candidate"evening for Mayoral
candidates as October nrd at 7 PM and for City Council candidates as October
25th at 7 PM.
(4)Agenda Additions /Approval-No changes.Marvin Berger moved and Bill
Peard second to approve the agenda as written.Ayes:All.Nays:None.Motion carried
4-0.
(5)Consent Agenda -
A.Approve August 31 Payroll and Bill List
B.Approve August 6,August 20 and August 29 Council Minutes
Two questions/statements concerning the minutes and bill list:1)New software is used in
the creation of the bill list,which does not repeat the vendor when a series of invoices are
paid for that vendor.2)The Mayor clarified the August 20th minutes by stating
unequivocally that there is no validity to the rumor or thoughts that the downtown portion
of Locust Street will be closed.
Marvin Berger moved,Nick Gruber second to approve all items.Ayes:Gruber,Berger,
Peard,Johnson Nays:None.Motion carried 4-0.

(6)Mayor's Report:Mike Watts has been appointed to the Development Committee.
The committee will meet September 25 at 5:30.Change of address problems regarding
City Hall address.The new address is 230 Highway 6.City Hall no longer has a P.O.
Box #.The Mayor would like copies of the Community Survey Summary circulated.
Would like to report that Chad Weaver,City Planner,applied for a Centennial Park
Expansion Project Grant,a REAP grant from the DNR.Larry Phillips,police chief,has
informed the mayor of the urgency in getting turn lane signals installed in the temporary
lights at the comer of Alice's Road and Hickman Road.They will be part of the
permanent lights when the lA DOT installs them.Per Mark Arentsen we are asking the
DOT to put up temporary tum signals;however,a timeframe has not been mentioned by
the DOT.The Mayor reiterated that Locust Street would not be closed.Mark Arentsen
indicated in a letter to Council that feedback received by him indicated that there was
insufficient support for closing Locust Street;however,there was interest in enlarging the
triangle.There was a meeting downtown regarding the triangle last week.Future
meetings and planning sessions will take place in the weeks ahead.Commercial building
permits are down approximately 50%from last year,Overall permits are up about 25%
mostly because of an increase in town home,condo and multifamily residential
construction.As to whether these buildings can be classified as residential,Mark
indicated he had contacted the assessor's office today.The assessor's office indicated the
multifamily buildings are eligible to be classified as residential ifthe owners file a
"condominium regime."That would be the case even if they did not intend to sell the
units as individual pieces of property,which means it might be possible for people with
.apartments to obtain the residential right down as single family home owners do.The
Warrior Plaza development is also included in the building permit report for this month.
The value for it is listed as $425,000.The Mayor was grateful for the report from Jody
on the MFO Tech Committee.The problems there have been ongoing.Basically,if they
stick with density vs area,the density model,Waukee will have a hard time getting
federal dollars through the MFO.Have received a letter from Jane Englehardt who is the
new community contact volunteer for MidAmerican Energy and a resident of Waukee.
The Mayor has the signed copies of the MPO 28E agreement.Also he and Mark had
talked about the regional transit system.MediaCom notified the City by certified mail
that a price adjustment would occur for certain programming.The Mayor of Council
Bluffs sent a letter indicating the Olympic Torch will pass through his City on its way to

Salt Lake City on January 10,2002.Council Bluffs is the only host City in the State of
Iowa.Council also received a letter from Gene Phillips.They are sending a funding
agreement to us concerning our financial commitment for the Iowa Events Center.There
is an Urban Summit at the end of the month.Issues will be discussed are contract sales,
historic tax credits,housing tax exemption,and other issues.If any staff is interested in
it,they need to let the Mayor know.
(7)Motion:Approving Chamber of Commerce F all Festival -parade route,vendors,
schedule of events:GeoffWarmouth led the discussion of the material he presented to the
Council regarding the parade route,vendors,schedule of events.The festival will be one
day rather than two this year.Council is encouraging all to attend.Bill Peard moved to

(8)Resolntion:Approving payment of Auditor's Invoice,FY2000:Mark Arentsen
deferred to the City Attorney who indicated that after the Auditor's hearing we are faced
with letting the decision stand or appealing the decision.Mr.Huscher feels we could
appeal this decision under 17A,which would go to the district court.Further discussion
included the cost of proceeding versus paying the reduced amount of$25,421.57.A.time
frame ono days in which to file an application forrehearing or judicial review exists.
Further discussion of what had been requested of the auditors and what the auditors
actually did occurred.Nick Gruber moved that the continued discussion be deferred to
the end of the meeting where the Council will go into closed session under section
21.5lC ofthe Iowa State Code.Marvin Berger second.Roll call:Ayes:Gruber,Berger,

(9)Public Hearing:On the Hickman Road Arterial Street Lighting Project:The
Mayor opened the public hearing.Written comments were received prior to the meeting
from Tim Hogan representing Laurel Properties,L.L.C.and Windfield Development Il,
L.L.C.and Lon Hawbaker representing Paul S.Hawbaker.Mark Arentsen read all three
letters into the record.Tim Hogan,Chuck Thomas,representing the Developer's Council
ofthe HBA of Greater DM,Steven Blumenthal,parishioner Waukee Baptist Church,
Mike Roberts,pastor Waukee Baptist Church,Carol Crow,Jerry Crow,and Ed Butler
voiced opposition to the assessment of24.6%based on Flint formula calculations on
those bordering properties,which are not residential.Discussion included the
predominant public benefit,assessment of church property,the plight of developers,the
exclusion of residential properties and the deferral of agricultural properties versus the
inclusion of church properties.Mark Arentsen indicated once again that he felt the value
to the properties being assessed was or would be greater than the amount assessed.Jody
Gunderson also indicated the value of being able to "see"the entrance to the street by a
property would provide a benefit to the first,second and third tier properties.Both felt
that the value to property owners was or would be greater than the amount being
assessed.Wayne Johnson indicated two points -that being (1)the fact that commercial
developers and retail property owners pay taxes and (2)the TIF dollars are funding the
rest of this project.Basically commercial people are paying through assessment and also
paying through TIF funds.Accordingly as some have indicated it appears to be
predominately funded by commercial interests,although not lOO%directly.Further
discussion ofTIF dollars showed that TIF funds were being used for eight to twelve
different projects.These projects once completed would generate more dollars for other

projects in the future.Nick Gruber indicated after a point made by an objector to the
assessment that he had voted against 100%assessment but felt that some type of
assessment was appropriate.Mayor Bailey closed the public hearing @ 8:40 PM.
(10)Resolution:Approving the Resolution of Necessity for the Hickman Road Arterial
Street Lighting Project:Wayne Johnson indicated his concern at this meeting was not
how the lights were to be funded;but,whether we needed the lights on Hickman Rd.He
also suggested that starting at the center and working out as funds were available might
be a way to fund this project.Bill Peard thought this would not send a positive message
to prospective investors in Waukee.Marvin Berger moved to approve the Resolution of

WHEREAS,this Council has adopted a preliminary resolution in accordance with
Section 384.42 of the Code ofIowa,covering the Hickman Road Arterial Street Lighting
Project (the "Project");and
WHEREAS,pursuant thereto,the Project Engineers have prepared preliminary
plans and specifications,an estimated total cost of the work and a plat and schedule,
including the valuation of each lot as determined by this Council,and the same have been
duly adopted and are now on file with the City Clerk;
NOW,THEREFORE,It Is Resolved by the City Council of the City of Waukee,
Iowa:
Section 1.It is hereby found and determined to be necessary and for the best
interest of the City and its inhabitants to proceed with the Project,and to assess a portion
of the cost to the property benefited thereby.
Section 2.The Proj ect shall constitute a single improvement and shall consist
generally of the installation of approximately 73 roadway lighting poles;approximately 6
control stations;approximately 2,000 feet of 2 inch conduit;and electrical circuits and
other associated fixtures and appurtenances thereto to provide a fully operational
roadway lighting system along U.S.Highway 6/Hickman Road from approximately 600
feet west of 10th Street to approximately 3200 feet east of Alice's Road.

John Gibson indicated that approval of the construction plans hinge on the completion of
items three and five on the August 27th letter from V &K,which were the installation of
an additional fire hydrant on Fortune Drive and an isolation valve just south of Venture
Drive.In addition the City has required (l)a fire hydrant along Venture Drive,(2)
Fortune Drive is directly across from Dartmoor Drive and the names need to be
consistent,(3)a tee and valve needs to be installed on the center of the easement for the
possibility of a future water line,and (4)the City has requested that a public utility
easement run along side the bike trail to be used for future City needs.With these

the plat was inaccurate when originally filed.Paul Huscher was able to review the
Parkview Crossing,Plat 2 earlier in the evening and indicated that the City needed to

Section 1.Section 301.3,Waukee Municipal Code,Zoning Ordinance,City
of Waukee,Iowa,is hereby amended by deleting the definition of "Kennel,"and
substituting therefore the following words:
So that said section shall read as follows:
Kennel:The keeping of any dogs,cats,or other household pets of mammal
group regardless of number,for sale,breeding,boarding or treatment
purposes,except in an animal hospital,veterinary clinic,or pet shop,as may
be permitted by law,or the keeping of more than one (1)dog or cat on
vacant property or on property used for business or commercial purposes,
shall constitute a kennel.The keeping of not more than 3 dogs and 3 cats in a
residential district shall not be deemed to be a kennel,unless kept for sale,
breeding,boarding or treatment purposes.Any person keeping more than
three dogs and three cats in a residential district on the effective date of this
ordinance,registered as required by ordinance,may continue to keep such
dogs or cats during the pet's lifetime.
Section 2.Repealer.All ordinances or parts of ordinances in conflict with the
provisions of this ordinance are hereby repealed.
Section 3.Severability Clause.If any section,provision or part of this ordinance

City Administrator,Mark Arentsen:Will be attending the Iowa League of Cities
Conference Thursday and Friday of this week.The regional transit meetings referred to
by the Mayor have begun.There will be a meeting tomorrow,The direction that they are
moving in is to promote a County sales tax to subsidize the transit services.Waukee is in
the unusual position of being in Dallas County and dealing with Polk County issues.
We're not sure what that means for Dallas County.We have some annexation issues,
which will be coming at the next Council meeting.MFO funding will be an issue in the
next couple of weeks.A schedule put out by the MFO he proposals include enhancement
funding,which includes bike paths and street improvement funding.Starting Wednesday
at 5 :30 a candidate information session will be held at City Hall and will cover a different
area each week until the last Wednesday in October,This week the presentation will be
on the park program.
Deputy City Clerk,Cathy Paardekooper:Working on vacating the alley between Locust
and Walnut and first and second.Also working on updating the Ordinance book and the
Municipal Code.
Director of Economic Development,Jody Gunderson:As Mark indicated we will be
completing the MFO application process in the next two weeks.Information will be
submitted to Council regarding the transportation projects applied for last year and how
we scored.In addition we will discuss the projects proposed this year to narrow the
number to the ones the Council is interested in applying for this year.The Mayor has
requested info on the Swallow Property including emails.
Treasurer,Linda Burkhart:Working on the Road Report,which will be on the Council
Agenda next meeting.We had the employee picnic/potluck yesterday.We had about 55
people there.It was a very good turnout.Mark indicated that it was Linda's idea.She
and Beth organized it and John cooked all the meat.It was great!!
Public Works Director,John Gibson:Starting construction on the Fourth Street cul-de
sac shortly.Sidewalks projects are progressing fine;haven't heard but one comment so
far.Wc'rc going to have some gas main installations in all 6 subdivisions,we're doing
some storm sewer repair around town,we will be having a walktoberfest in another
month.
City Engineer,Mikelis Bredis:Working on Warrior Lane Box Culvert project.Also
working on schematic drawings on the downtown areas,which will incorporate the
suggestions brought up at the last meeting.
City Planner,Chad Weaver:Has been working on the downtown project.A new
meeting has been scheduled for the 26th•'They're going to explain doing the project in
one phase rather than two.Has attempted to make contact via letter with everyone the
City hasn't spoken with and who lives East of or at Ute Ave.,south of the City and north
of the Interstate regarding annexation.Mark indicated that Chad is putting together a list
of all the people in the area and where they are located.Legal
descriptions/ownership/land location all have to be checked and verified to ensure
accurate information.It is a project to figure out who these people are.

City Attorney,Paul Huscher:Will be reviewing some issues with regard to the
anticipated appeal.With regard to closing the alley,the City can grant a temporary
easement to the property owners without vacating the alley.This accomplishes the same
thing while preserving the City's rights for future purposes.
Wayne Johnson,Park Board:Not present at meeting;but the Walktoberfest was
discussed.It will be a fun night in Centennial Park.I believe the Park Board was
discussing soliciting candidates for new Park Board members.John indicated we would
be advertising in the October Waukee Taukee for a vacancy that just opened last week.
According to Jay Oxenford we talked about the punt,pass and kick.The Board deferred
that until next year because of time constraints for this year.
