(1)Call to Order -The November 5,2001 meeting of the Waukee City Council was
called to order by Mayor Bailey at 7:00 PM.
(2)Pledge of Allegiance -
(3)Roll Call-The following members were present:Mayor Donald L.Bailey,Jr,and
Council members Nicholas Gruber,Marvin Berger,Mike Watts,and Wayne Johnson,
Councilman Bill Peard absent.
(4)Open Forum -no participation
(5)Agenda Additions I Approval-No changes.Marvin Berger moved and Wayne
Johnson second to approve the agenda as written.Ayes:All.Nays:None.Motion
carried 4-0.

Wayne Johnson questioned a motor replacement for a grader in Public Works.Other
repairs were made on this machine and given that the price of a rebuilt was about $3,000
more,rebuilding the current motor seemed to be a reasonable alternative.Nick Gruber
moved to eliminate one membership to IMMU @ $65.00 from the bill list and to approve
the remainder of the bill list as presented.Marvin Berger second.Roll call:Ayes:
Gruber,Jolmson,Berger,Watts.Nays:none.Motion carried 4 -O.

(8)Resolution:Approving FY2001 Audit Report:the representatives from the Denman
and Company,LLP.Jay Hom gave an overview of the audit and indicated that Denman
&Company,LLP was issuing an unqualified or a clean opinion on the financial
statement of the City for the fiscal year ending June,2001.Dave Ellis reviewed some of
the details of the audit including explaining the changes in procedure under GASB
accounting principles and discussing the findings related to the financial statements.Mr.
Ellis extended thanks for the cooperation and support given to the auditing personnel and

NOW THEREFORE,the City Council of the City of Waukee does resolve as follows:
SECTION 1.The Applications for Voluntary Anuexation are hereby approved and said properties
described in Exhibit "B"shall be anuexed to the City of Waukee,Iowa,in accordance with Chapter 368,
Code ofIowa,2001,and such property shall hereinafter become and be part of the City of Waukee,Iowa.
SECTION 2.The Mayor and City Administrator/Clerk are bereby authorized and directed to prepare and
execute all documents necessary for this anuexation and are directed to file the same with the City
Development Board as required by the Code ofIowa.

SECTION 3.A transition for imposition of taxes shall be proved to the above-described residential
properties pursuant to the formula set forth in Section 427B.3(1-5)of the Code oflowa,2001 and shall be
applied in the levy and collection only of City taxes.
SECTION 4.This Resolution's transition for imposition of taxes shall be effective upon completion of
annexation proceedings before the City Development Board;and thereafter,the City Clerk is hereby
directed to file a copy of this Resolution with the Offices of the Dallas County Recorder,Auditor,Assessor
and Treasurer.

a written comment from Bill Peard,Councilman who was absent.A member of the
audience asked if the house on the lot would be tom down.The multi-family unit would
be built behind the house.Bill Forrett indicated opposition to the subdivision of the lot
and to the rezoning to multi-family residential district.Councilman Gruber indicated he
had a major problem with placing a multi-family residential behind the existing house.
There is one other example of flagging in the community;but,the basis for the flagging

(20)Resolution:Approving an amendment to the contract between Waste Management
and the City of Waukee to incorporate new regulations regarding appliances Discussion
of this item led one of the councilman to share his personal experience of taking a large
item to the land fill.The fee for leaving the item was $25.00.This was in addition to
what it would cost to take the item to the landfill.Given that information the $30.00 fee
requested by Waste Management for appliances doesn't seem too high.Further
discussion concerned "why"the change.Appliances were previously picked up and

compacted and can no longer be picked up and transported that way because federal
regulations concerning the enviromnental impact of the components of appliances.Bill

AND THE CITY OF WAUKEE TO INCORPORATE NEW REGULATIONS REGARDING
APPLIANCES
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City of Waukee entered into an agreement with Waste Management ofIowa on April 19,
1999 to provide garbage pick-up for the residents of Waukee AND,
WHEREAS,pickup of various products included all waste,recyclable materials and white goods,which
included such items as refrigerators,washers,dryers,hot water heaters,dishwashers,stoves,freezers,
dehumidifiers,air conditioners,microwaves and furnaces AND,
WHEREAS,new environmental regulations as outlined in Iowa Administrative Code 567,Chapter 118
and in the Code of Federal Regulations -40 CFR Part 82,40 CFR Part 271 and 40 CFR Part 761 -will no
longer permit the compaction of white items and individual residents must arrange for the pick-up and
payment for the pick-up of such items with Waste Management or a hauler of their choice AND,
WHEREAS,this is a change in the three year Waste Management /City of Waukee agreement and must
be amended at this time;
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Conncil in session this 5'"day of
November 2001 that it hereby approves the contract amendment with Waste Management of Iowa,which
covers the pickup of appliances or white goods from individual residences.

Project Jay Oxenford asked why the sidewalks weren't continued the year after 1997.At
the time Councilman Gruber indicated that the Council hadn't planned to go up the
opposite direction.Councilmen Johnson and Watts commented on how much nicer and

November.Working with the Library on their fund-raising for interior furnishings and
equipment.Continuing to pursue a mail box for downtown.Attended a conference today
on computer security items.Reminder that next Monday is Veteran's Day Holiday-
City Hall will be closed.
Director of Community Development,Jody Gunderson:Will submit the application for
the STP and the STP TE funding this Friday with the MPO.

Code Enforcement Officer,Dennis Dowell:Good weather is allowing contractors to
finish up the various projects.West Woods Plaza,Warrior Plaza,Windfield Apartments
Lutheran Church,Kurtz's Dental Office will be wrapping up or close to wrapping up all
of these projects.Discussion of a comparison of this year's development numbers with
the past two years.
Treasurer,Linda Burkhart:Went to a public employer payroll seminar today.Have
financial statement;will need to work on annual report due December 1,2001.Working
with Mark to put together the budget times/schedule.
Public Works Director,John Gibson:Finishing up projects including the cul-de-sac
proj ect before winter.Getting ready for winter.
City Engineer,Mikelis Briedis:We began survey on the R22 project for extending sewer
and water to the south.We're trying to do the survey before the snow flies so we can
pick up where the utilities are.Have met with the county engineer.He would also like to
see R-22 become part of the City as soon as possible.
City Planner,Chad Weaver.Downtown project is continuing.Hope to have something
to you before the next meeting.Spoke with individuals down south regarding
annexation.Updated the park view ordinance after receiving opinion from the Home
Builders.
City Attorney,Paul Huscher:If you have an occasion to talk with a legislator,Cities do
need some help with park land dedication.Ifthe state would take a bold step and initiate
some legislation as to how that might be accomplished we would be in a situation without
putting together an ordinance which might be tested in court.The legislators could set
the guidelines for the ordinance so that the ordinances across the state would be uniform.
Wayne Johnson,Park Board:Two items:(1)Park Board will want to shut down Sixth
Street from the Ice Cream Shop to the Flower Shop for the Winter Fest,which is
scheduled for December 6,2001.(2)Councilman Johnson has asked the Park Board to
assume more of the duties of a Board as opposed to a Committee such as
recommendations on the budget and activities.Rene Herr will be asking for inforruation
concerning budgets and proj ections on growth from City staff.They will be doing
interviews on the 6th for candidates for the Park Board.
Bill Peard,Chamber of Commerce:The Chamber has met with the Greater Des Moines
Partnership.They are discussing whether to join the Partnership or hire a part time
Director to run the Chamber in Waukee.The representative complemented the Waukee
Chamber in terrus of what they had accomplished up till this time.
