APRIL 21,2003
(1)Call to Order-The regularly scheduled meeting of the Waukee City Council was
called to order by Mayor Tony Oberman at 7:00 PM.
(2)Pledge of Allegiance
(3)Roll Call-The following members were present:Mayor Tony Oberman,and
Council members Nicholas Gruber,Donald Bailey,Jr.,Mike Watts and Bill Peard.
(4)Open Forum -Darlene Stanton and JeffV.Mertz were present to discuss
their candidacy for the Council position vacated by Wayne Johnson.
(5)Agenda Additions I Approval -Mike Watts moved to approve the agenda as
written.Nick Gruber second.Mark Arentsen asked council to delete Item D.Mike
Watts amended his motion to include the exclusion of Item D.Nick Gruber seconded the
amended motion.Roll call:Ayes:All:Nays:None.Motion carried 4-0.

C.Approving payment to Rochon Corporation of Iowa,Inc.in the amount of
$47,916.10 ($62,916.10,the sum of amounts previously withheld from Pay
Applications 9,10 and 12 minus $15,000 withheld for roofmg)
D.Resolution:Approving an agreement with William J.Ludwig,Urban
Planner,for the purpose of developing a concept plan for the Alice's Road
Corridor for a fee of $25,000 -This item removed from the agenda.
E.Resolution:Approving and accepting the Phase 2 Water Main Extension
within the Joe Brick IndustriallBusiness Park and payment of retainage to

(Neighborhood Commercial)and then from R-3 (Multi-Family Residential)
to PD-l (Planned Development Overlay)(McNabb Property)

(7)Mayor's Report:Have met with more city department heads and committees;
participated in the Alice's Road Corridor Workshop held last Monday night;good
turnout and good discussion;Visited with Vic Camarnchi of the GDM Partnership;
attended a meeting for the Mid-Iowa Association of Local Governments -Met with
Dr.Stalker who indicated that Jim Dewey,the Athletic Director,would be sent to
Detroit to observe the Junior Olympics;Attended the MPO meeting where the
members approved adding the congressional award to Waukee of $2,500,000 to the
DM MPO's current Transportation Improvement Plan
(8)Public Hearing:On plans and specifications,estimate of cost and form of contract
for Asphalt Overlay of Ashworth Road and Warrior Lane I University Avenue No
written comments were received prior to the public hearing.Mike Watts questioned
whether the bids carne in as anticipated.Mik Briedis indicated with respect to the sum
total was about 2.2%less than the engineer's estimate.No other person present at the
hearing wished to address the issue.Mayor Oberman closed the public hearing.
(9)Resolution:Finally approving and confirming plans and specifications,estimate of
cost and form of contract for Asphalt Overlay of Ashworth Road and Warrior Lane I
University Avenue Nick Grnber moved to approve the resolution.Mike Watts second.
Roll call:Ayes:Gruber,Watts,Bailey,Peard.Nays:None.Motion carried 4 -O.
(10)Resolntion:Approving Awarding contract for Asphalt Overlay of Ashworth Road
and Warrior Lane I University Avenue Nick Grnber moved to approve the resolution.
Mike Watts second.Roll call:Ayes:Gruber,Watts,Bailey,Peard,Nays:None.Motion
carried 4 -O.
(11)Public Hearing:On designation of the expanded Waukee Urban Renewal Area
and on urban renewal plan amendment Mayor Oberman opened the public hearing.
No written comments had been received prior to the public hearing.No one present
wished to address the issue.Mayor Oberman closed the public hearing.
(12)Resolution:Approving the designation of the expanded Waukee Urban Renewal
Area and on urban renewal plan amendment Mike Watts moved to approve.Nick
Gruber second.Don Bailey,Jr.addressed the R-22 Sanitary Sewer issues of connection
fees,assessments and residences within the city limits vs.outside the city limits.This
will be addressed again during the Final Assessment of the R-22 Sanitary Sewer Project.

(13)Ordinance:Approving an ordinance providing for the division of taxes levied on
taxable property in the 2003 Amendment to the Waukee Urban Renewal Area,
pursuant to Section 403.19 of the Code of Iowa Mike Watts introduced the ordinance.
Nick Grnber moved to have the first reading in title only.Bill Peard second.Roll call:
Ayes:Gruber,Peard,Watts,Bailey.Nays:None.Motion carried 4 -O.Mark Arentsen
read the ordinance in title only.
(14)Public Hearing:On the Council's proposal to enter into a General Obligation
General Corporate Purpose Loan Agreement in a principal amount not to exceed
$280,000 Mayor Oberman opened the public hearing.No written comments were

received prior to the meeting.No one present wished to address the issue.Mayor
Oberman closed the public hearing.
(15)Resolution:Taking additional action in connection with and combining Loan
Agreements and authorizing the sale of General Obligation Corporate Bonds Mike
Watts moved to approve the resolution.Bill Peard second.Roll call:Ayes:Watts,Peard,
Bailey,Gruber.Nays:None.Motion carried 4 -O.
(16)Resolution:Approving Letter of Intent for the Municipal Water System Joint
Water Tower Project with City of West Des Moines Mike Watts moved to approve.
Nick Gruber second.John Gibson indicated there were three good reasons to contract
with West Des Moines,Clive and DMWW in the construction of this water tower to be
located on the east side of Waco Place by the rail road track intersection with Waco.
Those three reasons are:1)reliability of having at least one tower in operation at all
times;2)can use potentially the full 2,000,000 water capacity for fire protection;3)
tremendous cost savings when the construction costs are shared by three cities.
Estimated cost for the City of Waukee is $1,000,000.Roll call:Ayes:Watts,Gruber,
Bailey,Peard.Nays:None.Motion carried 4 -O.
(17)Ordinance:Approving an ordinance to amend Chapter 301,Waukee Municipal
Code,Zoning Ordinance of the City of Waukee,Iowa,by re-zoning and changing
certain property from M-1A (Limited Industrial District)to C-1 (Community and
Highway Service Commercial District)and amend the Official Zoning Map to show re-
zoning (Waukee Development)(second reading)Mike Watts moved to have the second
reading in title only.Nick Gruber second.Roll call:Ayes:Watts,Gruber,Peard,Bailey.
Nays:None.Motion carried 4 -O.Mark Arentsen read the ordinance in title only.
(18)Motion:Setting May 19,2003 as the date of a public hearing on an ordinance to
amend Chapter 301,Waukee Municipal Code providing for a Schedule of Fees,
Ordinance of the City of Waukee,Iowa,by deleting Section 301.31 of said Chapter and
inserting in lieu thereof a revised Section 301.31 Nick Gruber moved to approve.Mike
Watts second.Don Bailey,Jr.and Mike Watts explained why they voted "No"on this
issue at the last council meeting.Roll call:Ayes:Gruber,Watts,Peard,Bailey.Nays:
None.Motion carried 4 -O.
