MAY 05,2003
(1)Call to Order -The regularly scheduled meeting of the Waukee City Council was
called to order by Mayor Tony Oberman at 7:00 PM.
(2)Pledge of Allegiance
(3)Roll Call-The following members were present:Mayor Tony Oberman,and
Council members Nicholas Gruber,Mike Watts and Bill Peard.Councilman Donald L.
Bailey,Jr.absent.
(4)Open Forum -Mark Arentsen spoke on behalf of Sergeant Greg Breuer of
the Waukee Police Department.He wished to thank the Waukee Fire Department
for their quick response.The City of Clive brought its ladder truck with a thermal
imaging camera on the ladder.Using that piece of equipment,which locates the
areas of greatest heat and by so doing displays the spots where the water hose
should be directed,results in far less water damage.Sergeant Breuer indicated
that use ofthe equipment saved about $10,000 in water damage to his house.
Sergeant Breur supports the purchase of one of these cameras by the Fire
Department as soon as possible.Marvin Berger of 160 Waukee Avenue,
candidate for city council wanted to explain to Waukee residents why he was not
in attendance at the "Get to Know Yom Candidate"political session.Mr.Berger
made sure that those organizing and planning the political session knew of his
absence one week prior to the final date for filing candidacy papers.Mr.Berger
had a previously scheduled vacation and was not be able to attend the scheduled
program.Rather than postponing the event one week,the sponsors of "Get to
Know Yom Candidate"chose to proceed.
(5)Agenda Additions I Approval-Councihnen Gruber moved to remove Item 61 from
the agenda and approve all other items;Councilmen Watts seconded the amended
agenda.Roll call:Ayes:Gruber,Watts,Peard.Nays:None.Absent:Bailey.Motion
carried 3-0 with one councihnan absent and one council seat vacant.

meeting Mike Watts inquired as to whether the city staff had contacted
previous project references for LEE Engineers &Surveyors.Mark
Arentsen assured the councihnen that city staff had reviewed previous
work products and felt that LEE Engineers &Surveyors would be able
to complete this project skillfully and efficiently.
H.Resolution:Approving the Preliminary Plat for Willowbrook Plat 1
1.Resolution:Approving purchase of a walk behind trencher/plow from
Midwest Underground Supply in the amount of$21,500 -Removed
from the agenda.
J.Motion:Setting May 19,2003 as the date of a public hearing for
approval of a lease purchase agreement with Diversified Lenders,Inc.
for the purpose of procuring a Utility Billing and Customer Service
Data Software and Hardware System in the amount of$33,776.00

(7)Mayor's Report:Mayor Oberman visited with the Police Chief and the Fire Chief
during the past two weeks.He attended the Community Development Meetings and the
two Land Use Workshops chaired by Bill Ludwig,Urban Planner.He had a meeting
with Deb Calvert,MidAmerican Energy Economic Development Consultant.Mayor
Oberman and City Administrator Mark Arentsen met with WDM Mayor Gene Meyer and

City Manager Jeff Pomerantz to discuss the 1-80 &Alice's Road Interchange.He will
attend during the week of May 4 to 11 the Dallas County Mayor's meeting,will be
visiting with Linda Schaut,Director of the Dallas County Economic Development,will
attend the Mid Iowa Association of Local Governments meeting and the MPO meeting.
Next "Get to Know Your Candidate"is scheduled for May 22nd at 7 0'clock in City Hall.
Councihnan Gruber mentioned receiving a notice,which stated that Burt Properties has
committed to develop a 20,000 to 40,000 square foot office building by the 1-80 /Alice's
Road Interchange.
(8)Public Hearing:On an amendment to the FY03 Budget Mayor Oberman opened
the public hearing.No written comments had been received prior to this hearing.No one
present wished to address the issue.Mayor Oberman closed the public hearing.
(9)Resolution:Approving an amendment to the FY03 Budget Nick Gruber moved to
approve the resolution.Mike Watts second.Roll call:Ayes:Gruber,Watts,Peard.
Nays:None.Motion carried 3 -0 with one councilman absent and one council seat
vacant.
(10)Resolution:Approving Letter of Understanding between Mid.American Energy
Company,A-TEC Energy Corp.,and Waukee Municipal Gas Mike Watts moved to
approve this resolution.Bill Peard second.John Gibson,Public Works Director,stated
the energy audits cost $175.00 per household.Waukee Gas will pay $150 per audit
leaving $25.00 as the cost of the audit to be paid by each home owner.Waukee Gas is
sponsoring 30 audits this year on a first come,first serve basis.During each audit,the
home is checked for insulation,window R rating and tightness.Tips for upgrading are
shared with the home owner,two or three energy saving light bulbs are installed and a
blanket for the hot water heater is installed.A programmable thermostat can be installed

(11)Resolution:Approving the ordering of detailed plans,specifications,notice of
hearing,notice to bidders and form of contract for the 2003 Water Main and Sanitary
Sewer Crossings Mike Watts moved to approve.Nick Gruber second.Roll call:Ayes:
Watts,Gruber,Peard.Nays:None.Absent:Bailey.Motion carried 3 -0 with one
councihnan absent and one council seat vacant.
(12)Resolution:Approving detailed plans,specifications,notice of hearing,notice to
bidders and form of contract for the 2003 Water Main and Sanitary Sewer Crossings
and setting May 15,2003 at 11 :00 AM as the date for receipt of bids thereon and
setting May 19,2003 as the date for hearing and letting therefore Nick Gruber moved
to approve this resolution.Mike Watts second.Roll call:Ayes:Gruber,Watts,Peard.
Nays:None.Absent:Bailey.Motion carried 3 -0 with one councihnan absent and one
council seat vacant.

Code,Zoning Ordinance of the City of Waukee,Iowa,by re-zoning and changing

Residential);and then from C-IA (Community and Highway Service Commercial
District)and from R-3 (Multi-Family Residential)to the following zone:PD (Planned

(14)Ordinance:Approving an ordinance to amend Chapter 301,Waukee Municipal
Code,Zoning Ordinance of the City of Waukee,Iowa,by re-zoning and changing
certain property therein from A-I (Agricultural District)to the following zones:to C-
IA (Community and Highway Service Commercial District)and to R-3 (Multi-Family
Residential);and then from C-IA (Community and Highway Service Commercial
District)and from R-3 (Multi-Family Residential)to the following Zone:PD (Planned
Development Overlay District);and amend the official zoning map to show re-zoning

(16)Ordinance:Approving an ordinance providing for the division of taxes levied on
taxable property in the 2003 Amendment to the Waukee Urban Renewal Area,
pursuant to Section 403.19 of the Code of Iowa (second reading)Mike Watts moved to

(17)Ordinance:Approving an ordinance to amend §304.5(M),Waukee Municipal
Code,Chapter 304,Site Plan Requirements of the City of Waukee,Iowa,by modifying
the second sentence of the first paragraph thereof,so that it reads:"Documentation to
be submitted shall include color building elevations showing the building's design on
all sides and a description of structural and exterior materials to be used."(intro and
first reading)Nick Gruber introduced the ordinance.Mike Watts moved to have the
first reading in title only.Bill Peard second.Roll call:Ayes:Watts,Peard,Gruber.

(18)Discussion:Of Chapter 212 of the Waukee Municipal Code -Restriction of Open
Burning within the City of Waukee Mayor Oberman opened the discussion on this
topic.Jim Phillips,240 Bel Aire Drive was present and voiced his opinion against
raising the Waste Management of Iowa Inc.monthly charge per household for additional
services of picking up.Chief Sesker reported on the Fire Department's experience with
providing permits for open burning of vegetative matter that originated on the property of
the person requesting the burning permit,He also listed the responsibilities of home

owners who seek permission to burn outside as being the following:The bum area must
be 20 feet from any structure,a water supply such as a garden hose attached to an outdoor
spigot must be available,the fire must be attended by a competent adult,cannot be a
nusiance to others or can be asked to put it out,must be completely out and not
smoldering by 7:00 PM.Burning permits are not given for burning on Sunday.The Fire
Department has been very busy.Dave Massey of Waste Management of Iowa,Inc.
indicated that pick-up of yard wastes includes grass clippings,leaves,tree branches and
tree trunks less than 6 -7 inches in diameter.Bundles of branches cannot be longer than
4 -5 feet or bigger around than 15 -20 inches.Public Works Director John Gibson
stated that it would be possible to modify the existing contract to include pick-up of yard
wastes city wide during one month in the spring and six weeks in the fall for an
additional $.36 per household per month or $4.32 per household per year.During these
two periods a yard sticker would not be necessary;but biodegradable bags or garbage
cans would be required.All councihnen were supportive of modifying the existing
contract to include pick-up of yard wastes during the spring and fall by Waste
Management of Iowa,Inc.for an additional $.36 per househald per month.A modified
contract and ordinance change will be submitted to the council next meeting,if possible.
