WAUKEE CITY COUNCIL MINUTES
(1)Call to Order -The regularly scheduled meeting ofthe Waukee City Council was
called to order by Mayor Tony Oberman at 7:00 PM.
(2)Pledge of Allegiance
(3)Roll Call-The following members were present:Mayor Tony Oberman,and
Council members Nicholas Gruber,Donald Bailey,Jr.,Mike Watts,Bill Peard and
Darlene Stanton.
(4)Open Forum -Nicole Baldwin,property manager for Westwoods Plaza,
present to invite the council to the 6X6 Festival at Westwoods Plaza on the 27'h of
June.
(5)Agenda Additions /Approval-Don Bailey moved to approve the agenda as written.
Mike Watts second.Nick Gruber requested item 6K be pulled out of the consent agenda
and moved to the end ofthe agenda at Item 24.Don Bailey amended his motion to

(7)Mayor's Report:The mayor discussed the DM Partnership trip to Washington,D.C.
taken during the last week.The Alice's Road /105'11 Street Interchange was the number
one priority for Waukee.All participants in that trip felt that the trip was very beneficial.
All members visited with Senator Harkin,Senator Grassley's staff person,
Representatives Latham,Boswell,Leach and lobbyist and Iowan Tom Dawson.Mr.
Dawson gave the City representatives a lot of advice and strategies to help the city seek
additional funding for the interchange,Each council member added their comments in a
one minute summary of the DC trip.The Mayor outlined his future projects which
included a meeting with West Des Moines and with Dallas County Development;
preparing the presentation to the Iowa DOT Commissioners to ensure that we are on their
project schedule,attending MFO meeting.
(8)Swearing-In:Swearing-in Darlene Stanton as Council member elected to fill the
council seat vacated by Wayne Johnson City Administrator Mark Arentsen swore in
Darlene Stanton,the latest City of Waukee council member.
(9)Mayor's Appointment:Appointing Teresa DeGraaf and Cathy Colson Homer
each to a 3 year term on the Waukee Library Board of Trustees and appointing
Darlene Stanton as council representative to Planning &Zoning Commission Mayor
Oberman read these appointments.

(10)Resolution:Approving appointment of Teresa DeGraaf and Cathy Colson Horner
to 3 year terms on the Waukee Library Board of Trustees Bill Peard moved to approve
the appointments to the Waukee Library B08l'd of Trustees,Don Bailey,Jr.seconded the
motion.Roll call:Ayes:Peard,Bailey,Gruber,Watts,Stanton.Nays:None.Motion
carried 5 -O.
(11)Resolution:Approving results of City Administrator's Annual Performance
Review Council member Don Bailey,Jr.moved to approve the resolution.Mike Watts,
Jr.second.Mayor Oberman asked the council to delay the evaluation until a single
evaluation form is completed and a method for increasing wages be developed.In the
discussion for this item most council members felt a change in the evaluation form was
necessary before the council could proceed.Councilman Bailey felt a change in the form
would be beneficial;but did not feel that the review should be postponed until a later
council meeting.Council member Nick Gruber moved to amend the motion so as to
delay the evaluation until July 21,2003;at which time a new evaluation form would have
been used by the council members.Mike Watts seconded the amendment,Jim Phillips
of240 Bel Aire Drive suggested that the City freeze all wages and let it go for a year.
Roll call on the amendment:Ayes:Gruber,Watts,Stanton,Peard.Nays:Bailey.
Motion carried 4 -I.Roll call on the original motion as amended:Ayes:Watts,Gruber,
Peard,Stanton.Nays:Bailey.Motion carried 4 -1.
(12)Resolution:Approving raises for the non-represented employees Mike Watts
moved to approve the resolution.Nick Gruber second.After much discussion,Mike
Watts moved to amend his motion to approve the resolution by approving a 3.5%wage
increase for non represented employees except for an individual who will be receiving a
2%increase,except for three individuals from the Public Works Department who will be
receiving increases greater than 3.5%and except for Chief Larry Phillips and Public
Works Director John Gibson who will each receive an additional $1,000 salary increase
for their exceptional service during the preceding year.Nick Gruber seconded the
amended motion.Roll call:Ayes:Watts,Gruber,Bailey,Peard,Stanton.Nays:None.
Motion carried 5 -O.
(13)Resolution:Approving Engineer Proposal for Warrior Lane Sidewalk and Storm
Sewer Project Design,Final Design and Administration Nick Gruber moved to
approve the resolution.Mike Watts second.Nicholas Kuhn and Douglas Ernst were
present representing Engineering Alliances,Inc.Mr.Kuhn stated that all members of this
new engineering:finn had been employees of Howard R.Green,had excellent references
and had worked on much bigger projects than this one.This firm is concentrating in
transportation /municipal projects,Three of the councihnen felt that Veenstra &Kimm,
Inc.were not that far over the low bid and because they were the city engineers should
have received the bid.Roll call:Ayes:Gruber,Stanton.Nays:Watts,Peard,Bailey.
Resolution defeated 2 -3.
(14)Resolution:Approving Preliminary Plat for Westgate Plats 5,6,&7 Don Bailey,
Jr.moved to approve the resolution.Mike Watts second.Melissa Hill,representing Civil
Engineering Consultants,was present to discuss the Westgate Plats 5,6,&7.These lots
are the last in the Westgate development to be platted.Roll call:Ayes:Bailey,Watts,
Gruber,Peard,Stanton.Nays:None.Motion carried 5 -O.
(15)Ordinance:Approving an ordinance to amend Chapter 501,Waukee Municipal
Code,Regulation of Traffic Upon and Use of the Streets of Waukee,Iowa,by

amending Section 501.9(F),by adding subparagraph 1A providing for establishment of
a speed limit of 25 miles per hour for vehicular traffic on University Avenue from the
West line of Ashworth Drive,if extended,to the East line of Warrior Lane,if extended,
within the City of Waukee,Iowa (intro and first reading)Don Bailey,Jr.introduced the
ordinance.Mike Watts moved to have the first reading in title only.Bill Peard second.
Roll call:Ayes:Watts,Peard,Stanton,Bailey,Gruber.Nays:None.Motion carried 5-
O.Mark Arentsen read the ordinance in title only.Don Bailey,Jr.moved to waive the

(16)Ordinance:Approving an ordinance to amend Chapter 501,Waukee Municipal

amending Section 501.9(F),by adding subparagraph 2A providing for establishment of

(17)Ordinance:Approving an ordinance to amend Chapter 500,Section 501.18,3-
Way Stop Intersection,Waukee Municipal Code,Traffic Ordinances of the City of
Waukee,Iowa,by adding as a 3-way stop intersection,the intersection of Warrior Lane
south bound,north bound traffic at the intersection of Warrior Lane and University
Avenue,and University Avenue at its intersection with Warrior Lane (intro and first
reading)Don Bailey,Jr.introduced the ordinance.Nick Gruber moved to have the first
reading in title only,waive the second and third readings and place this ordinance on its
fmal passage.Bill Peard second.Roll call:Ayes:Gruber,Peard,Stanton,Watts,Bailey.
Nays:None.Motion carried 5 -O.Mark Arentsen read the ordinance in title only.

(18)Ordinance:Approving an ordinance to amend Section 304.5(M),Waukee
Municipal Code,Chapter 304,Site Plan Requirements of the City of Waukee,Iowa,by
adding after the second sentence of the ftrst paragraph a sentence which reads:"A
material board shall also be submitted prior to consideration by the Planning &Zoning
Commission."(intro and first reading)Mike Watts introduced the ordinance.Nick
Gruber moved to have the first reading in title only,waive the second and third readings
and place this ordinance on its final passage.Darlene Stanton second.Roll call:Ayes:
Gruber,Stanton,Watts,Bailey,Peard.Nays:None.Motion carried 5 -O.Mark

(19)Ordinance:Approving an ordinance to amend Chapter 210,Regulating and
Licensing of Peddlers,Solicitors and Transient Merchants in the City of Waukee,
Iowa,Section 210.12,Revocation of License,by deleting said Section and substituting
in lieu thereof a revised Section 210.12 (intro and first reading)Nick Gruber
introduced this ordinance.Don Bailey,Jr.moved to have the first reading in title only.

(20)Ordinance:Approving an ordinance to amend Chapter 210,Regulating and
Licensing of Peddlers,Solicitors and Transient Merchants in the City of Waukee,
Iowa,by adding a new Section 210.13,Right to Appeal Revocation,and by
renumbering each section thereafter in consecutive order (intro and first reading)
Mike Watts introduced the ordinance.Don Bailey,Jr.moved to have the first reading in
title only.Bill Peard second.Roll call:Ayes:Bailey,Peard,Stanton,Watts,Gruber.
Nays:None.Motion carried 5 -O.Mark Arentsen read the ordinance in title only.
(21)Ordinance:Approving an ordinance to amend Chapter 111,Section 111.6,
Waukee Municipal Code,Bidding-Major Contracts,is hereby amended by deleting
thereof "for such services"and inserting in lieu thereof "for such projects"and
inserting "(Except for engineering services for such projects)"after the words large
equipment so that the first sentence of said section reads as follows:Contracts for
consulting services,for such projects as water main,sewer and sanitary work,street
and utility construction by contract and large equipment (except for engineering
services for such projects)shall be placed before the council,if equal to or more than
that dollar amount identified in Section 384.96 of the Iowa Code,which once exceeded
requires that the city advertise for sealed bids,except for emergencies endangering the
public health."(intra and first reading)Nick Gruber introduced the ordinance.
Darlene Stanton moved to have the first reading in title only.Mike Watts second.Public
Works Director John Gibson indicated that engineering services were being excluded
from the requirement of bidding because in the Code ofIowa,professional services do
not have to be bid.Roll call:Ayes;Darlene Stanton,Mike Watts,Nick Gruber,Bill
Peard,Don Bailey,JI.Nays:None.Motion carried 5 -O.Mark Arentsen read the
ordinance in title only.
(22)Ordinance:Approving an ordinance to amend Chapter 111,Section 111.5,
Waukee Municipal Code,Purchasing Quotations,to provide for an increase in the
dollar amount for purchase of an item before quotations must be secured by deleting
"all purchase over ($500.00)"thereof and inserting in lieu thereof the words,"all
purchases over $5,000.00",.so that the first sentence reads:"All purchases over
$5,000.00 shall be made after securing quotations."(second reading)Mike Watts
moved to have the second reading,waive the third reading and place this ordinance on its
fmal passage.Darlene Stanton second.Roll call:Ayes:Watts,Stanton,Peard,Gruber,
Bailey.Nays:None.Motion carried 5 -O.Mark Arentsen read the ordinance in title
only.Mayor Oberman declared the ordinance passed and duly adopted.
(23)Ordinance:Approving an ordinance to amend Chapter 301,Waukee Municipal
Code providing for a Schedule of Fees,Ordinance of the City of Waukee,Iowa,by
deleting Section 301.31 of said Chapter and inserting in lieu thereof a revised Section
301.31 (third reading)Nick Gruber moved to have the third reading and to place this
ordinance on its final passage.Darlene Stanton second.Roll call:Ayes:Gruber,Stanton,
Bailey,Watts,Peard.Nays:None.Motion carried 5 -o.Mark Arentsen read the
ordinance in title only.Mayor Oberman declared the ordinance passed and duly adopted.
(24)Resolution:Approving sale of the Library Building at 500 6'"Street Mike Watts
moved to approve the sale of the Library Building at 500 6th street.Bill Pcard second.
Nick Gruber is/was very much opposed to the sale of the building because the City is

selling land,which when needed by the City will be purchased at a price two and three
times for which the City is selling this property.Other council members felt the site was
much too small for development of a senior citizen center.Another thought the next
center built will be one center for all ages.Another thought the revenue generated by the
proposed proj ect for the City and for others in the community far outweighed the need to
hold on to the land.Roll call:Ayes:Watts,Peard,Stanton,Bailey.Nays:Gruber.
Motion carried 4 -1.
