(5)Agenda Additions /Approval-Nick Gruber moved to approve the agenda including in his motion separating Item 6F from the consent agenda and moving Item 28 to Item 9B,Bill Peard seconded the amended agenda.Roll call:Ayes:Gruber,Peard, Bailey,Watts,Stanton Nays:None.Motion carried 5-0. F.Approving Liquor License for MipFour Inc.DBA Mickey'S Irish Pub Darlene Stanton moved to approve,Nick Gruber second.Steve McFadden owner/operator of Mickey's Irish Pub in Clive was present to answer questions concerning his new business in Waukee.Council member Stanton questioned how Mr. McFadden would manage the noise level emanating from the out door service area.Mr. McFadden said he didn't think there would be a problem;however,he agreed to address the problem,if complaints were made about noise.Mr.McFadden is hoping to cater predominately to families.Roll call:Ayes:Stanton,Gruber,Watts,Bailey,Peard.Nays: None.Motion carried 5 -O. (8)Resolution:Approving Burbach Aquatics,LLC as architects and engineers for the Waukee Family Aquatic Center Project Bill Peard moved to approve this resolution. Mike Watts second.Public Works Director J ohn Gibson discussed the bidding process and the results of the bidding.Burbach Aquatics will complete an Aquatic Vision Study to determine the feasibility of building an aquatic center in Waukee.After that a Public Recreation Poll will be completed by Iowa State Intems.The latter study will help to determine the level of interest for all athletic activities.Roll call:Ayes:Peard,Watts, Bailey,Stanton,Gruber.Nays:None.Motion carried 5 -O. (9)Resolution:Approving Articles of Incorporation for the Waukee Firefighters Association Nick Gruber moved to approve.Mike Watts second.Fire Chief Terry Sesker explained that the Firefighters Association merges the First Responders and the Waukee Fire Department into one association which will be incorporated as a non profit by the State of Iowa.There are three levels of members;that being:acive,honorary and social or past members.Roll call:Ayes:Gruber,Watts,Stanton,Peard,Bailey.Nays: None.Motion carried 5 -O. (9B)Resolution:Approving Chamber of Commerce Fall Festival,09/27/03 -parade route,vendors,schedule of events;Geoff Warmouth presentation GeoffWannouth briefly discussed the list of vendors,parade participants and parade route.The parade will start at the Middle School and end downtown.The Chamber has sponsored the Fall Festival for the last 13 years.Darlene Stanton moved to approve the resolution.Bill Peard second.Roll call:Ayes:Stanton,Peard,Watts,Gruber,Bailey.Nays:None. (10)Resolution:Approving Site Plan for Hawthorne Plaza Mike Watts moved to approve the site plan for Hawthome Plaza.Don Bailey,Jr.second.LaITy Hague from Engineering Design Services representing Larry Grubb,developer discussed the building 4 elevations,the parking,the landscaping and the air conditioner covers.Council member Darlene Stanton raised the problem of light from automobile head lights in the food service area located on the northwest side of the building reaching the homes beyond the conservation area from the food service area.Mr.Hague acknowledge a problem could exist and indicated,if a lighting problem did exist,he would fix it with either trees or fence.Roll call:Ayes:Walts,Bailey,Gruber,Peard,Stanton.Nays:None.Motion carried 5 -O. (11)Ordinance:Approving an ordinance to amend Chapter 203,Section 203.2, Waukee Municipal Code,Water Rates,to provide for minimum posting fees for non- paid utilities to be set by resolution of the council;and to provide minimum fees for installation of water meters on new construction by adding to Section 203.2: "Minimum posting fees for lion-paid utilities and minimum fees for installation of water meters on new construction shall be set by resolution of the council"(intro and first reading)Darlene Stanton introduced the ordinance.Nick Gruber moved to have the first reading in title only,waive the second and the third and place on final passage.Bill Peard second.Roll call:Ayes:Gruber,Peard,Bailey,Stanton,Walts.Nays:None. Motion carried 5 -O.Mark Arentsen read the ordinance in title only.Mayor Oberman declared the ordinance passed and duly adopted. (13)Resolution:Approving an increase to $25.00 from $5.00 in the fee for posting of utility disconnect notices and authorizing the city to collect the same Nick Gruber moved to approve the resolution.Darlene Stanton second.A brief discussion including an inquiry by David Kovalsky of 595 Meadlowlark Lane as to whether a utility invoice incorrectly labeled as being over due would still result in a $25.00 charge for posting notice.Public Works Director John Gibson said it would not.Roll call:Ayes:Gruber, Stanton,Walts,Peard,Bailey.Nays:None.Motion carried 5 -O. (14)Ordinance:Approving an ordinance to amend Chapter 213A of the Municipal Code of the City of Waukee,providing for the assessing of fees or charges for the collection,processing and marketing of solid waste and recyclable materials within the city limits of the City of Waukee,Iowa,to ill crease collection charges for single family residences and for a dwelling of two (2)or three (3)units,by deletingfrum213A.3A and 213A.3B "$12.14",and inserting in lieu thereof "$12.39."(intro and first reading) Mike Walts introduced this ordinance.Darlene Stanton moved to have the first reading in title only.Nick Gruber second.Discussion included several "thank-yous"to Dave Massey of Waste Management who made every effort to ensure that Waukee would have a way to dispose of Fall and Spring yard waste.Roll call:Ayes:Stanton,Gruber,Walts, Bailey,Peard.Nays:None.Motion carried 5 -O.Mark Arentsen read the ordinance in title only. (15)Ordinance:Approving an ordinance to amend Chapter 502,Section 502.1, Waukee Municipal Code,Parking Regulations of the City of Waukee,Iowa,to delete "Fourth Street see §502.4,"which prohibited parking on both sides of Fourth Street; and inserting "Fourth Street"after "Dogwood Lane"ill §502.2;and by deleting "Fourth Street"from §502.3;and further by adding as §502.4(A)(4)"Parking is I J I 5 permitted on the West side of 4'h Street from the South line of Northview to the South terminus of 4'"Street at the North edge of the Cul-de-sac."The purpose of this ordinance is to prohibit parking on the East side of Fourth Street between the South line of Northview and the North Edge of the Cul-de-sac thereon (intro and first reading)Darlene Stanton introduced the ordinance.Bill Peard moved to have the first reading in title only.Mike Watts second.Bill Peard proposed a three corner stop at the intersection of Waukee Avenue and Fourth St.After further discussion the three corner stop sign was abandoned.There will be no parking on the cul-de-sac.Roll call:Ayes: Peard,Watts,Gruber,Bailey,Stanton.Nays:None.Motion carried 5 -O.Mark Arentsen read the ordinance in title only. (16)Ordinance:An ordinance to amend Chapter 502,Section 502.3,Waukee Municipal Code,Parking Regulations of the City of Waukee,Iowa,to prohibit parking on the West side of Rosewood Drive,SE Cardinal Lane,SE Carefree Lane,NE Carefree Lane and NE Cardinal Lane by adding Rosewood Drive,SE Cardinal Lane, SE Carefree Lane,NE Carefree Lane and NE Cardinal Lane to the list of North-South Streets on which parking is prohibited on the West side (intro and first reading)Mike Watts introduced the ordinance.Nick Gruber moved to have the first reading in title only,waive the second and third readings and place this ordinance on its fmal passage. (17)Ordinance:Approving an ordinance to amend §222.5,Waukee Municipal Code, Building Code Regulations and Penalties for Violations Ordinance of the City of Waukee,Iowa,Amendments,Modifications,Additions and Deletions to the Uniform Plumbing Code,by adding as §222.5(D)certain specific language allowing for the use of PEX tubing with certain restrictions (intro and first reading)Nick Gruber introduced the ordinance.Darlene Stanton moved to have the first reading in title only. Bill Peard second.John Gibson discussed the PEX tubing for interior plumbing and the properties ofthe tubing.Roll call:Ayes:Gruber,Stanton,Peard,Watts and Bailey. Nays:None.Motion carried 5 -O. (18)Ordinance:Approve an Ordinance to Amend §304.5(B),Waukee Municipal Code, Site Plan Requirements of the City of Waukee,Iowa,by deleting the words "40 Percent -1 j!,"or 2"caliper diameter"in subparagraph.I thereof,and inserting in lieu thereof the words "40 percent -2"or greater caliper diameter";and by deleting the words "Balance -1"-1 j!,"caliper diameter"in subparagraph 1thereof,and inserting in lieu thereof the words "Balance -1"-2"caliper diameter";and by adding as subparagraph 4 the words"All development within the Arterial Corridor Overlay,as described by Section 304.5(M)6,shall adhere to the following:Minimum requirements at time of planting -Two (2)trees minimum or two (2)trees per 1,500 square feet of open space,whichever is greater.Six (6)shrubs or two (2)shrubs per 1,000 square feet of open space,whichever is greater.Tree plantings shall follow the size schedule set forth above"(introduction and first reading)Darlene Stanton introduced the ordinance. Nick Gruber moved to have the first reading in title only.Mike Watts second.Joe Sclnnidt of2806 W Ave.discussed the ordinance briefly,Roll call:Ayes:Gruber,Watts, Peard,Bailey,Stanton.Nays:None.Motion carried 5 -0,Mark Arentsen read the ordinance in title only. 6 (19)Ordinance:Approving an ordinance to amend §304.5(M),Waukee Municipal Code,Site Plan Requirements of the City of Waukee,Iowa,by deleting subparagraph 2 thereof and inserting in lieu thereof certain specific language referring to Multiple- Family Dwellings in All Districts;and by adding as subparagraph 6 certain specific language referring to the Arterial Corridor Overlay (intro and first reading)Darlene Stanton introduced this ordinance.Nick Gruber moved to have the first reading in title only which reading includes the words commercial and industrial in §304.5(M)(6) immediately after the word "All"in the first sentence.Mike Watts second.Mike Watts indicated he was opposed to this ordinance because he didn't think it was necessary to require 40%brick on condominiums.Council member Stanton requested a letter be sent to the Builder's or tile Home Builder's Association informing them of the action being taken by the council.Mark Arentsen will do so.Council member Bailey indicated he was in favor of affordable housing and in bringing the builders to the table.Mayor Oberman and council member Peard supported the ordinance as written.Roll call:Ayes: Gruber,Stanton,Peard.Nays:Watts and Bailey.Motion carried 3 -2. (20)Motion:Setting September 22,2003 as the date for a Public Hearing on an ordinance to amend §3 01.13,Waukee Municipal Code,Zoning Ordinance of the City of Waukee,Iowa,"R-3"Multi-Family Residential District,by adding as §301.13(H) the words "Minimum Open Space.The total land area devoted to open space and landscaping shall not be less than twenty (20)percent of the gross land area included in the building lot.Such open space shall be maintained as grassed and landscaped area and shall not include access drives,parking areas,structures or buildings;except ornamental structures included as part of the landscaping theme."Mike Watts moved to approve this motion.Nick Gruber second.Roll call:Ayes Watts,Gruber,Peard, Stanton,Bailey.Nays:None.Motion carried 5 -O. (21)Motion:Setting September 22,2003 as the date for a Public Hearing on an ordinance to Amend §301.14,Waukee Municipal Code,Zoning Ordinance of the City of Waukee,Iowa,"R-4"Row Dwelling and Condominium District,by adding as §301.13(G)the words "Minimum Open Space.The total land area devoted to open space and landscaping shall not be less than twenty (20)percent of the gross land area included in the building lot.Such open space shall be maintained as grassed and landscaped area and shall not include access drives,parking areas,structures or buildings;except ornamental structures included as part of the landscaping theme."
