SEPTEMBER 22,2003
(1)Call to Order -The regularly scheduled meeting of the Waukee City Council was
called to order by Mayor Tony Oberman at 7 :00 PM.
(2)Pledge of Allegiance
(3)Roll Call-The following members were present:Mayor Tony Oberman,and
Council members Nicholas Gruber,Donald Bailey,JI.,Mike Watts,Bill Peard and
Darlene Stanton,
(4)Open Forum -John Butz,341 Terrace Drive,speaking on behalf of Cook
Plumbing and asking that the ordinance amending the Uniform Plumbing Code of
the City be approved and passed this evening.Jeff Reichardt with Specified
Systems also present for this issue.
Nick Gruber requested a 3 to 5 minutes candidate position video,which would be
aired on the city cable channel.Mayor Pro Tem Bill Peard suggested that we
check with FCC prior to finalizing plans for a candidate view video.

(7)Mayor's Report:Mayor Oberman attended the MFO meeting last week and will
attend the Dallas County Mayor's Meeting this week and met with Ron Stalhnan of the
Chamber of Commerce.The Mayor reminded everyone present of certain upcoming
meeting dates and also reminded everyone of the Fall Festival,2003.
(8)Discussion:University Avenue Widening Project -Requesting allocation of 'funds
for other projects Don Bailey,Jr.moved to receive and file the discussion.Darlene
Stanton second.Council member Darlene Stanton who had requested tins issue be on the
agenda,stated that she and Jody Gunderson met with Tom K.ane of the Metropolitan
Planning Organization (MFO).Mr.K.ane indicated the MFO project allocation is for a
particular project;if the project changes significantly,tile funds revert to the MFO.Ms.
Stanton withdrew her request to allocate these funds to another project;but did suggest
that trees be planted in the median tum lane to soften the visual effect of all expanse of
concrete.Don Bailey,reminded everyone that widening University Avenue was top

priority during the strategic planning sessions held in Fall 2002.Council member
Stanton also recommended a more thorough study of the water flow as residents of
Southfork are concerned with the amount of water potentially draining or flowing into the
water shed.Council member Mike Watts and Engineer Mik Briedis discussed drainage
of the area south of University Avenue.Council member Nick Gruber recommended
proceeding with this project.Roll call:Ayes:Bailey,Stanton,Gruber,Peard,Watts.

(9)Receive/File:Annual Report of the Waukee Public Library Don Bailey,Jr.moved
to receive/file the annual report.Darlene Stanton second.Council member Don Bailey
who is council liaison to the Library indicated that circulation is up 13%over last year
which is similar to the previous several years.The highest increase is in adult nonfiction
and youth fiction and nonfiction,The collection is up 10,8%.Library Director Linda
Mack reported on the Library Foundation's efforts to create an endowment for the
acquisition of books during the coming years.Two projects mentioned were the selling
of gold leaves to be placed on the tree in the lobby and the selling of bricks in the
walkway,The library has practiced selective book purchasing where past circulations
dictate the types of book purchased.This is a method that tends to ensure that books
purchased will be circulated.Roll call:Ayes:Bailey,Stanton,Gruber,Watts,Peard.

(10)Resolution:Approving support for Waukee Public Library Board of Trustees
Agreement with Dallas County to provide service to all residents of the unincorporated
areas of Dallas County Mike Watts moved to approve the resolution.Nick Gruber
second.Don Bailey indicated that this is a renewal of an agreement with the Board of
Supervisors,originally signed in 1975.Roll call:Watts,Gruber,Peard,Stanton,Bailey.
Nays:None.Motion carried 5 -O.
(11)Public Hearing:On the detailed plans,specifications,notice of hearing,notice to
bidders and form of contract for the Hickman Road Street Lighting -Phase II Mayor
Oberman opened the public hearing.Mark Arentsen indicated that no written comments
were received prior to the hearing.Greg Smidt,factory sales rep for Holophane lights
and a Waukee resident,encouraged the council to keep Ius product in mind for future
projects and to ask him to be involved early in the planning stage.Mr.Smidt responded
to a question from council member Bailey and indicated that Ius product would have
represented a savings.Mayor Oberman closed the public hearing.
(12)Resolution:Finally approving and confirming detailed plans and specificutions,
form of contract and estimate of cost for the Hickman Road Street Lighting -Phase II
Council member Gruber moved to approve the resolution and Mayor Pro Tern Peard
second to install the original base bid consisting of galvanized steel poles,"truss-style"
luminaire arms and a 400 watt,high pressure sodium Type III lighting fixture.Roll call:
Ayes:Gruber,Peard,Stanton,Watts,Bailey.Nays:None.Motion carried 5 -O.
(13)Resolution:Approving awarding contract for the Hickman Road Street Lighting-
Phase II Nick Gruber moved to approve awarding the contract to the lowest bidder,
Iowa Signal &Electric in the amount of$183,038.Darlene Stanton second.Brief
discussion.Roll call:Ayes:Gruber,Stanton,Bailey,Peard,Watts.Nays:None.Motion
carried 5 -O.
(14)Public Hearing:On the detailed plans,specifications,notice of hearing,notice to
bidders and form of contract for the Warrior Lane Sidewalk and Storm Sewer

Improvements Mayor Oberman opened the public hearing.Mark Arentsen indicated
that no written comments were received prior to the hearing.Jim Bemer of 275 Laurel
representing Immanuel Lutheran Church,900 Warrior Lane,explained to the council that
the ChUTChwould not,at this time,be responsible for the installation of a four foot
sidewalk across the eastern portion of property.The sidewalk across the frontage of
Immanuel Lutheran Church is not included in this project.Tim Parker residing at 10
Warrior Lane was concerned about the drainage of storm water,which pools near his
home.Engineer Briedis indicated that installation of the storm sewer as designed should
alleviate most,if not all of the pooling.
(15)Resolution:Finally approving and confirming detailed plans and specifications,
form of contract and estimate of cost for the Warrior Lane Sidewalk and Storm Sewer
Improvements Nick Gruber moved to approve the resolution.Darlene Stanton second.

(16)Resolution:Approving awarding contract for the Warrior Lane Sidewalk and
Storm Sewer Improvements Darlene Stanton moved to award the contract to TK
Concrete in the amount of$111,973.Mike Watts second.Roll call:Ayes:Stanton,
Watts,Peard,Gruber.Nays:Bailey.Motion carried 4 -1.
(17)Resolution:Approving a commitment to funding the local match for proposed
projects being submitted to the MPO for consideration for FY2007 Mike Watts moved
to approve the resolution.Don Bailey,Jr.second.Roll call:Ayes:Watts,Bailey,

(18)Resolution:Approving Final Plat for Westgate Plat 5 Melissa Hills with Civil
Engineering Consultants present on behalf ofthe Westgate Partnership,discussed Plat 5
which is the last 20 acres of Westgate Development located south of Westgate Plat 4 and
north of the Willowbrook Development.Eleven single family lots are included in this
plat.The remaining outlot will become Westgate Plats 6 &7.All staff comments have

(19)Resolntion:Approving Site Plan for Earl May at Legacy Pointe Mike Watts
moved to approve.Darlene Stanton second.Mike Kastner of Kastner,Schipper and
Wells presented the site plan and described the construction material.Jeff Ewing,owner
of the development,was present to discuss his development.Larry Gore,representing
Earl May,also present.Roll call:Ayes:Watts,Stanton,Peard,Bailey,Gruber.Nays:
None.Motion carried 5 -O.
(20)Public Hearing:On an ordinance to amend §301.13,Waukee Municipal Code,
Zoning Ordinance of the City of Waukee,Iowa,"R-3"Multi-Family Residential
District,by adding as §301.13(H)the words "Minimum Open Space.The total land
area devoted to open space and landscaping shall not be less than twenty (20)percent
of the gross land area included in the building lot.Such open space shall be
maintained as grassed and landscaped area and shall not include access drives,
parking areas,structures or buildings;except ornamental structures included as part
of the landscaping theme."Mayor Oberman opened the public hearing.Mark Arentsen
indicated that no written comments were received prior to the meeting.Council member
Mike Watts discussed the timeliness of these ordinance changes.No other person wished

(36)Ordinance:Approving an ordinance to amend Chapter 11 0,Waukee Municipal
Code,of the City of Waukee,Iowa,Establishing the Salaries of Municipal Officers,by
deleting the Chapter in its entirety and inserting in lieu thereof a revised Chapter 11 0
(intro and first reading)Don Bailey,Jr.introduced the ordinance,moved to have the
first reading in title only and moved to amend the proposed ordinance to reflect in lieu of
the amount proposed initially,a $75.00 a month raise for each elected official.Darlene
Stanton second.It was stressed by council member Don Bailey,Jr.that the council is
doing more,meeting as many as three or four times per month,attending more meetings
with other govemmental bodies and should be compensated for the increased effort being
sustained by all members of the council.However,he was aware of the concems of the
current budget and stated that City Administrator Mark Arentsen and assured him that
funds were available in the current budget to pay each elected official an additional
$75.00 per month.Council members Mike Watts,Nick Gruber and Mayor Oberman

tubing.John Butz added additional positive comments concerning the PEX tubing.John
Gibson and Dennis Dowel were more conservative in their comments and indicated there
were certain requirements which must be met by the users ofPEX tubing before it would
pass inspection amonth those being that exterior lines were to be in copper and the

the words "40 percent -2"or greater caliper diameter";and by deleting the words
"Balance -1"-1 y,"caliper diameter"in subparagraph 1 thereof,and inserting in
lieu thereof the words "Balance -1"-2"caliper diameter";and by adding as
subparagraph 4 the words"All development within the Arterial Corridor Overlay,as
described by Section 304.5(M)6,shall adhere to the following:Minimum requirements

Chuck Thomas of the Development Council of Greater DM was present to request a
revision in the ordinance by reducing the amount of hard surface required from the

proposed 40%to 30%.Council member Bailey,wanting to ensure affordable housing,
suggested 35%instead of the proposed 40%.Jerry Steele,100 Ashland Court,and chair
of the Planning &Zoning Commission stated his support of the proposed 40%indicating
that the percentage includes glass as a hard surface if surrounded by stone OT brick,Joe
Schmidt,2896 W Ave.,also a member of the Planning &Zoning Commission suggested
that value ofthe multiple family dwellings would reflect maintenance and upkeep 15 to
20 years from initial construction,That value would have been maintained at a higher
level,if the building was of a higher level at the time of construction.Jeff Mertz and
