(2)Pledge of Allegiance (3)Roll Call-The following members were present:Mayor Tony Oberman,and Council members Nicholas Gruber,Donald Bailey,Jr.,Mike Watts and Darlene Stanton. Council member Peard absent.Mayor Oberman indicated that Mr.Peard would be present later in the meeting via phone pursuant to §21.8 ofthe Iowa Code. (4)Open Fornm -(1)Robert Ellis,President of Waukee Lions,stated the Lions had reserved the Community Center over the weekend for a function that had not included senior citizen activities.However,the senior citizens who attend many of the programs at the Center were present and somewhat disruptive.Waukee Lions President Ellis indicated that the Community Center no longer seemed to be a community center;but rather a senior citizen's center.(2)Terry Meyer of 355 Laurel Street present to support approval ofItem #14.All member of the Liberty Park Town Homes Association were appreciative of the changes to the back of Liberty Park Mall and supported the use of vinyl in this situation. (5)Agenda Additions /Approval-Mark Arentsen asked the council to delete Items 12 and 13.Nick Gruber moved to approve the agenda as modified.Darlene Stanton second. (8)Mayor Proclamation:Declaring October 2003 as Iowa Brain Injury Awareness Month Mayor Oberman read the proclamation. (9)Resolution:Approving the sending offlowers to esteemed citizens and colleagues for such life events as illness and death Mike Watts moved to approve.Don Bailey second.Roll call:Ayes:Watts,Bailey,Gruber,Stanton.Nays:None.Absent:Peard. (11)Resolution:Approving V&K engineering proposalfor Stormwater Drainage Study along University Avenue Corridor in preparation for University Avenue Widening Project Mike Watts moved to approve the resolution.Darlene Stanton second.Bud Humphrey,President of SouthFork Homeowners Association,stated that holding ponds, Westview Church,new construction,widening of University Ave have had an impact on the amount of water draining into the ponds at SouthFork.Don Perschau,and unidentified woman,and Alan Kniep,all residents of SouthFork stated through pictures and recollection what has OCCUlTedin the last year or two to the entrance to the largest pond of the seven ponds in SouthFork.Mil,Briedis of Veenstra &Kimm,Inc.,the finn which will do the Stonnwater Drainage Study,explained the purpose and depth of the study.Roll call:Ayes:Watts,Stanton,Bailey,Gruber.Nays:None.Absent:Peard. Motion carried 4 -0 -1. (12)Resolution:Approving Final Plat for the Replat of Parkview Crossing Plat 2 Item was withdrawn from the agenda. (13)Resolution:Approving Construction Plans for Williams Pointe Plat 5 Item was withdrawn from the agenda. (14)Resolution:Approving use of vinyl siding in the rehabbing of the back of Liberty Park Mall Don Bailey,Jr.moved to approve the resolution.Mike Watts second.All council members present indicated their approval of the use ofthe vinyl siding to rehab the back of Liberty Park Mall.Each council member also indicated that the decision to allow vinyl siding was approved in this particular situation because it does improve the 4 appearance for those individuals whose properties abut the rear of the mall.It improves a building whose exterior had suffered considerable structural failure since its construction. Current zoning requirements are meant to prevent the necessity for a rehabbing of existing buildings twenty years from now.Roll call:Ayes:Bailey,Watts,Stanton, Gruber.Nays:None.Absent:Peard.Motion carried 4 -0 -l. (15)ORDINANCE:Approving an ordinance to amend Chapter 303,Waukee Municipal Code,Section 303.158 by inserting as Subparagraph G thereof a provision to notify developers of property separated by public access or streets and which can be served by one water main,the costs of installation of the main shall be borne by the developer who first develops the adjacent public access;and adding provisions for any person,firm or corporation who wishes to connect to the existing main to share the costs thereof as set out in Section 211.17,Waukee Municipal Code;and by relettering subsequent subparagraphs of Section 303.158 (intro and first reading)Mike Watts introduced the ordinance.Nick Gruber moved to have the first reading in title only. (18)ORDINANCE:An ordinance to amend Chapter 502,Section 502.29,Waukee Municipal Code,Parking Regulations of the City of Waukee,Iowa,Penalty,to provide for an increase in the penalty of an unpaid /uncontested citation per violation from ten dollars ($10.00)to fifteen dollars ($15.00)by deleting therefrom "ten dollars ($10.00) from §502.29(A)(3)and inserting in lieu thereof "fifteen dollars ($15.00)"so that said section reads:"In the event the penalty as set forth in this subsection is not paid within thirty (30)days from the date of issuance of an illegal parking citation-complaint and the defendant has failed to appear to contest the citation-complaint,the penalty shall automatically increase to fifteen dollars ($15.00)in accordance with Section 805.8A(I)(a)for each violation of this chapter,excluding a secheduled violation that is subject to a fine as per state code.(intra and first reading)Mike Watts introduced the ordinance.Darlene Stanton moved to have the first reading in title only.Nick Gruber 1 J I 5 second.Roll call:Ayes:Stanton,Gruber,Watts,Bailey.Nays:None.Absent:Peard. (30)ORDINANCE:Approving an ordinance to amend Chapter 502,Section 502.1, Waukee Municipal Code,Parking Regulations of the City of Waukee,Iowa,to delete "Fourth Street see §502.4,"which prohibited parking on both sides of Fourth Street; and inserting "Fourth Street"lifter "Dogwood Lane"in §502.2;and by deleting "Fourth Street"from §502.3;and further by adding as §502.4(A)(4)"Parking is permitted on the West side of 4'"Street from the South line of Northview to the South terminus of 4th Street at the North edge of the Cul-de-sac."The purpose of this ordinance is to prohibit parking on the East side of Fourth Street between the South line of North view and the North Edge of the Cul-de-sac thereon (third reading)Nick Gruber moved to have the third reading in title only and to place this ordinance on its final passage.Darlene Stanton second.Roll call:Ayes:Gruber,Stanton,Bailey,Watts. (31)ORDINANCE:Approve an Ordinance to Amend §304.5(B),Waukee Municipal Code,Site Plan Requirements of the City of Waukee,Iowa,by deleting the words "40 Percent -1 ~"-2"caliper diameter"in subparagraph 1 thereof,and inserting in lieu thereof the words "40 percent -2"or greater caliper diameter";and by deleting the words "Balance -1"-1 y,"caliper diameter"in subparagraph 1 thereof,and inserting in lieu thereof the words "Balance -1"-2"caliper diameter";and by adding as subparagraph 4 the words"All development within the Arterial Corridor Overlay,as described by Section 304.5(M)6,shall adhere to the following:Minimum requirements at time of planting -Two (2)trees minimum or two (2)trees per 1,500 square feet of open space,whichever is greater.Six (6)shrubs or two (2)shrubs per 1,000 square feet of open space,whichever is greater.Tree plantings shall follow the size schedule set forth above"(third reading)Mike Watts moved to have the third reading in title only and to place this ordinance on its final passage.Darlene Stanton second.Roll call:Ayes: Watts,Stanton,Gruber,Bailey.Nays:None.Absent:Peard.Motion carried 4 -0 -1. Bill Peard present via cell phone during most of the discussion of the following ordinance: (32)ORDINANCE:Approving an ordinance to amend §3 04.5(M),Waukee Municipal Code,Site Plan Requirements of the City of Waukee,Iowa,by deleting subparagraph 2 thereof and inserting in lieu thereof certain specific language referring to Multiple- Family Dwellings in All Districts;and by adding as subparagraph 6 certain specific language referring to the Arterial Corridor Overlay (third reading)Mike Watts moved to have the third reading and place this ordinance on its final passage.Darlene Stanton second.Chuck Thomas,representing the Development Council of Greater Des Moines, suggested creating a taskforce made up of staff,C0l111Cil,builders and developers to develop architectural standards all can live with.This group would meet during the next thirty days prior to the final reading ofthe ordinance.All of the following supported a thirty day period for discussion prior to the final vote:Steve Staub,Executive Vice President of the Homebuilders Association of Greater Des Moines,Jim Conlin,319 7th 8 Street,Des Moines,owners of Wind field Community,Tom Gratias,610 SouthFork Drive,Robert Lundstrom,representing Jerry's Homes,LeMar Koethe,3514 142nd St., Urbandale,Ron Monahan,1704 Rio Valley Drive,Rick Monahan,1597 NW 90th St. Council members Don Bailey,Jr.and Mike Watts have been in support of affordable housing and think the per centage of hard surface should be decreased and also think a thirty day period of time during which the taskforce could meet would not delay the process.Darlene Stanton and Nick Gruber indicated this has been an item the City has discussed for almost a year and did not think the postpone necessary.Joe Schmidt,2806 W Avenue,member of the Planning &Zoning Commission,supports the standard stating that P&Z has difficulty enforcing an improved building code without specific standards in the Municipal Code.Mike Watts amended his motion to postpone the third reading of this ordinance for thirty days or to the closest regular council meeting which was November 3,2003.Council member Bailey seconded the motion to amend.At this point in the discussion there was considerable discussion with respect to the procedural rules of the meeting. (33)MOTION:Setting October 20,2003 as the date for a Public Hearing on an ordinance to amend Chapter 301,Waukee Municipal Code,Zoning Ordinance of the City of Waukee,Iowa,by re-zoning and changing certain property therein from R-3 (Multi-Family Residential)to PD-1 (Planned Development Overlay District);and amend the Official Zoning Map to show re-zoning (Williams Pointe Condominiums) Mike Watts moved to approve the motion.Don Bailey second.Brad Cooper of Cooper, Crawford &Associates,on behalf of Regency Land Company,Milee Simonsen,architect on the project,and Bill Spencer with Regency Homes present to discuss the re-zoning. Mr.Cooper began to explain the proposal and current requirements.Council members Gruber and Walts indicated that what was being presented needed to be presented and discussed at the time of the public hearing and not during the meeting setting a date/time for the public hearing.Mayor Oberman requested Roll call.Roll call:Ayes:Watts, Bailey,Gruber,Stanton,Peard.Nays:None.Motion carried 5 -O. (34)MOTION:Setting October 20,2003 as the date for a Public Hearing 011 an Ordinance to amend Chapter 301,Waukee Municipal Code,Zoning Ordinance of the City of Waukee,Iowa,by re-zoning and changing certain property therein from R-3 (Multi-Family Residential)to R-2 (One and Two Family Residential),R-4 (Row Dwelling and Condominium Dwelling Residential)to R-2 (One and Two Family Residential),and C-IA (Neighborhood Commercial)to R-3 (Multi-Family Residential);and amend the Official Zoning Map to show re-zoning (Koethe Property) 1 I I 9 Mike Watts moved to approve.Don Bailey second.Council member Bailey suggested waiting on this change in zoning until we are more aware of what will be developing in that area.Council member Bailey also indicated that Mr.Koethe was a member of the committee which developed the Comprehensive Plan and zoned the area,currently used predominately for agricultural purposes,as R-3,R-4 and C-l A.Because there were no proj ects proposed for these areas,Council member Bailey suggested postponing a vote on the re-zoning until the time of development.LeMar Koethe,owner ofthe property, insisted that the current zoning was appropriate and requested the council vote against the re-zoning at this time.Staff were in support of re-zoning,Council member Gruber indicated Mr.Koethe had stated he was interested in putting a road to the south through the property in question.Mr.Gruber would agree to not re-zoning at this time,if a road was built to the south.Council member Gruber recalled that the property was re-zoned during the development phase of the Comprehensive Plan because Mr.Koethe or a representative ofMr.Koethe that if it were re-zoned from A-I to R-3,R-4 and C-1A,the owner would be able to sell the property,if it were zoned accordingly.The land was never sold.M:r.Gruber suggested that the council should consider re-zoning back to A-l (Agricultural)and re-zone again when projects come in.Mr.Koethe gave a time line of three years or less for the installation of a road in that property.Planning Director Chad Weaver indicated that the re-zoning suggested allowed for a better flow for residential and a better boundary for the proposed Alice's Road extension.Joe Schmidt,2806 W Avenue,questioned why this was on the agenda,when it had not officially been approved by Planning &Zoning.Further discussion continued touching on such topics as current re-zoning,postponing until the City gets a commitment for the development ofthe road, and returning the item to P&Z for a motion to approve before council takes up the issue.
