(1)Call to Order -The regularly scheduled meeting of the Waukee City Council was
called to order by Mayor Tony Oberman at 7:00 PM.
(2)Pledge of Allegiance
(3)Roll Call-The following members were present:Mayor Tony Oberman,and
Council members Nicholas Gruber,Donald Bailey,Jr.,Mike Watts,Bill Peard and
Darlene Stanton.
(4)Open Forum -Mike Watts,Council member,addressed the public in
explaining that the water tower being constructed by West Des Moines jointly
with Clive and Waukee will be filled with "Des Moines water."Council Mayor
Pro Tem Bill Peard introduced members of Scout Den 478 who are working to
fulfill the requirements to be an Eagle Scout.
(5)Agenda Additions /Approval-No changes.Mike Watts moved;Darlene Stanton

(7)Mayor's Report:Mayor Oberman attended the Mid IA Association of Local
Governments Meeting,the MFO meeting and the Waukee Chamber of Commerce
meeting.The Mayor mentioned that an IA DOT meeting will be held Tuesday evening at
the Botanical Center.Potential traffic solutions leading to developing the Iowa economy
will be discussed.The Mayor reminded everyone of the two candidate forums and
encouraged everyone to vote for the candidates oftbeir choice on Tuesday,November 3.
Mayor Oberman also announced that the Police Department was the recipient of an
$8,000 grant from the Government Traffic Safety Bureau.Money from tbis grant will be
used for equipment,educational material and officer overtime.
(8)Resolution:Approving a merit/closure system for all non-represented employees
with recommended pay increases retroactive to July 1,2003 Council member Don
Bailey,JI.moved to approve the resolution.Nick Gruber second.Mr.Bailey read a
letter addressed to the Mayor and to Fellow Council members.It is here reproduced:

Dear Honorable Mayor Oberman and Fellow Councihnembers,
The closure program is a good program if done right.However to ensure it is done in a
fair and equitable manner,I am suggesting a committee of two council members along
with our Honorable Mayor convene to review the information provided.I am
volunteering myself to serve on this subcommittee,In a positive effort to support the
great employees working for our community and sense any raise is retroactive to July 1st,
I hope you will support me for a subcommittee review process to ensure the accuracy of
the information.
After reviewing the documentation provided in the packet Thursday night in the short
amount of time before the meeting,I have found what I believe inaccurate data was used
to calculate mnnbers for the closure program.
1.In figuring employee's compensation benefits as well as wages tell the whole
story.To compare apples to apples one must have information on the benefit package
(for example health benefits,Waukee pays 100%of insurance costs,certainly we are
doing right by our employees but in tax dollars this amounts to around $10,000.00 per
employee with family coverage,in other words each employee with that level of
coverage could receive a $10,000.00 a year or $2.00 an hour raise if taken from benefits

package).Other benefits include city paid life insurance,paid holidays,vacation time,
retirement contributions and for some car allowance money.I support the benefit
package given by our city,so please don't misrepresent my point here.We cannot tell
what the rest of the presented cities are giving in benefits from the information put
together.I am very proud of the fact that we have provided great benefits for the city
employees,my6 point is we need to see the whole compensation package to ensure we
are paying our employees properly.We do not have it.
2.North Liberty compares closer to our community than any other listed.No
information has been used from our closest sized high growth community.Why?
3.Clive program information on Exhibit I is missing the next page and it refers
to the average maximum salary contingent on receiving a satisfactory evaluation.Has
everyone received a satisfactory evaluation?Is the maximum reserved for long time
more than five-year employees?Would there not be a range that considered the length of
service and experience?Is that detailed in the next page of the information provided to
us?
4.There are many NI As listed on some positions and not on others.Why?
5.Numbers are not consistent and don't match positions,for example in the case
of Police Chief the data shows Police Chief in Norwalk at $43,264 and Police Sergeant at
$48,949.I am I supposed to believe a Sergeant position in Norwalk is work more in
wages by $5,685 than the Police Chiefs position,and worse yet those numbers are
accurate to sue for the closure program?Our Police Chiefhas held this position for two
decades,I don't agree with the numbers.
6.Altoona,Pleasant Hill and Norwalk's Community Development Director
wages are used for the planner position in Waukee,yet not used for the same titled
position economic development position in Waukee.Why?
7.The planner position in Ankeny is 4 different positions with (begin,mid and
max range),why is the max pay position used?

I am asking that you support me in taking a closer look at the proposed numbers,it is
retroactive so my changes made will be figured back to July 1st,2003.It is the light and
fair thing to do to ensure this is done right for all ofthe affected valued employees of
Waukee.

After a brief discussion,Darlene Stanton moved that we postpone this item until the
November 3,2003 meeting and after further discussion included in her motion the
appointment of a subcommittee,which would determine the veracity of the data and
review the method used to calculate the closure amounts.Nick Gruber second.City
Attomey Paul Huscher indicated that Ms.Stanton's motion was not an amendment to the
main motion but was a motion postponing consideration to a particular time.Mayor

this program.I(9)Resolution:Approving an amendment to an Easement for a Gas Line with the
Dallas County Board of Supervisors and the Dallas County Conservation Board to

reflect a change in the term of the agreement from 25 years to perpetual easement

(10)Resolution:Approving Site Plan for Country Club Mini Storage Nick Gruber
moved to approve the resolution.Mike Watts second.Eric Stroud of9310 Oakwood
Dr.,Urbandale was present to answer questions from Council.Mr.and Mrs.Stroud own
and operate the Country Club Mini Storage.Mike Watts raised the issue of the east side
of the building being built.He recommended that the building be required to be 60%
hard surface on the east side according to a recently passed ordinance.Planning Director
Chad Weaver indicated that the project is as originally planned with the exception of
landscaping and fixing the sign to meet some of to day's code.Mr.Weaver also stated
that this is a project in an M-l district and the requirements for that district are that the
front be hard surface and that the other sides be a s11100thsurface metal.Currently the
front or south of the new building will be all brick and the metal side will be the same
type as on the other buildings.Mr.Watts brought up the issue of smooth surface metal as
a requirement for this building.Council members and staff discussed other proj ects
where deviations from the site plan requirements were permitted,Further discussion of
the building proposal being presented included the closeness of other buildings to the
next nearest street which,as it tumed out,would be roughly 700 feet to the east,
increased landscaping to soften the exterior and a fence surrounding all units.As
discussion concluded,John Gibson requested the motion be approved contingent on a
performance bond for sidewalk construction being secured.Nick Gruber said it would be
included.Mike Watts concurred.Mayor Oberman requested a 1'011call.Roll call:Ayes:

(11)Ordinance:Approving an ordinance to amend Chapter 303,Waukee Municipal
Code,Section 303.158 by inserting as Subparagraph G thereof a provision to notify
developers of property separated by public access or streets and which can be served by
one water main,the costs of installation of the main shall be borne by the developer
who first develops the adjacent public access;and adding provisions for any person,
firm or corporation who wishes to connect to the existing main to share the costs
thereof as set out in Section 211.17,Waukee Municipal Code;and by relettering
subsequent subparagraphs of Section 303.158 (second reading)Mike Watts moved to

dollars ($10.00)by deleting therefrom "Five dollars ($5.00)"from §502.29(A)(1)and

inserting in lieu thereof "ten dollars ($10.00)"so that said section reads:"For each
violation of this chapter,excluding a scheduled violation that is subject to a fine as per

Municipal Code,Parking Regulations of the City of Waukee,Iowa,Penalty,to provide
for an increase in the penalty of an unpaid /uncontested citation per violation from ten
dollars ($10.00)to fifteen dollars ($15.00)by deleting therefrom "ten dollars ($10.00)
from §502.29(A)(3)and inserting in lieu thereof "fifteen dollars ($15.00)"so that said
section reads:"In the event the penalty as set forth in this subsection is not paid within
thirty (30)days from the date of issuance of an illegal parking citation-complaint and
the defendant has failed to appear to contest the citation-complaint,the penalty shall
automatically increase to fifteen dollars ($15.00)in accordance with Section
805.8A(l)(a)for each violation of this chapter,excluding a secheduled violation that is

Waukee's Site Plan Ordinance (Section 304)must be maintained continuously.This
includes grass,trees,shrubs,etc.required for site landscaping,parking areas,berms
and buffers.Material shall be replaced as needed in approximately the same location
as approved on the Site Plan.Replacement plantings shall be the same species as the
original landscaping.Planting requirements for single family developments are
excluded";and by re-lettering each successive subsection in Section 401.4 in

(25)Motion:Setting November 3,2003 as the date for a Public Hearing to amend
Chapter 301,Waukee Municipal Code,Zoning Ordinance of the City of Waukee,Iowa,
by deleting Legacy Pointe Planned Development Exhibit E,the Narrative of the
Specifics of the Legacy Pointe Planned Development,and inserting in lieu thereof a
revised Exhibit E Darlene Stanton moved to approve the motion.Nick Gruber second.
Answering Council member Bailey's question,Chad Weaver explained that most of the
changes were accounting for the things in the code which were already established or
were modified according to the layout originally presented to the Council.Roll call:
