(2)Pledge of Allegiance (3)Roll Call-The following members were present:Mayor Tony Oberman,and Council members Nicholas Gruber,Donald Bailey,Jr.,Mike Watts,Bill Peard and Darlene Stanton. Steve Helm who has worked as the Deputy Assessor for Dallas County during the past six years replaced Ron Potter.The Mayor also met with Superintendent Stalker, Associate Superintendent Wilkerson and Tracy Lepeltek,School Board President. Attended the Mid-Iowa Association of Local Govemments.Guests for the meeting were the state legislators for the area of whom approximately 8 to 10 attended.Discussion 4 topics were:State Budget,Property taxes,TIP,Economic Development,Park Site Dedication and continued connmmication between legislators and city elected officials and city staff.The mayor also attended the Dallas County Oversight Committee for the proposed airport.The mayor will attend the MFO meeting and will be visiting with Chief Phillips during the coming week. (8)Resolution:Approving the Agreement with West Des Moines and Clivefor shared use of water tower capacity Council member Don Bailey,Jr.moved to approve the agreement with West Des Moines and Clive for shared use of water tower capacity. Darlene Stanton second.Mr.Larry Anderson,General Manager of West Des Moines Water Works was present to answer any questions the Council might have.Council member Bailey had several questions concerning the proposed sharing and the agreement being approved.John Gibson,Public Works Director,City Attorney Paul Huscher and Mr.Anderson responded to his questions.Further questions from Couucil member Bailey were deferred to our bond /assessment attorney and to our city attorney.The joint management and rnaintenance was well planned,Construction on the shared water tower will start December,2003 and be in use in 2005.Roll call:Ayes:Bailey,Stanton, Gruber,Peard,Watts.Nays:None.Motion carried 5 -O. (9)Resolution:Approving Agreement with Immanuel Lutheran Church for the construction of 320 linear feet of four foot wide sidewalk at the church's eastern boundary Council member Mike Watts moved to approve the resolution as written.Don Bailey,Jr.second.Jim Bemer,represented the Lutheran Church on this issue.The Immanuel Lutheran Church Council had proposed that the Lutheran Church would pay for 25%of the cost of a 4 foot wide standard sidewalk across the eastern boundary running along side Warrior Lane.The resolution submitted for approval restates this proposal.At the time of approval of the site plan for the addition to the Lutheran Church, a stipulation of that approval was the Lutheran Church's acquisition of a performance bond to cover construction of a sidewalk in the location currently being discussed.The Lutheran Church did not acquire a performance bond.Jim Berner indicated since that time that the eastem most 17 feet of the property was given to the City for widening and construction ofthat portion of Warrior Lane from Ashworth Drive to University Avenue, Depending on the design of the roadway,some or all of that 17 feet might not be used in the widening of Warrior Lane.Also an easement was obtained from the Lutheran Church when the sidewalk at the Library was moved fi'0111 the south side ofthe Library property to the north side ofthe property,After considerable discussion Mr.Watts and Mr.Bailey stated they were in favor of agreeing to a one time payment of 25%ofthe cost of a 4 foot wide sidewalk across the eastern boundary of the Lutheran Church rather than asking the Church to pay for construction ofthe entire sidewalk.Roll call:Ayes:Watts,Bailey. Nays:Gruber,Peard,Stanton.Motion defeated 2 -3. (10)Resolution:Approving the Independent Auditor's Final Reportfor Fiscal Year Ending June 30,2003 Mike Watts moved to approve the report.Nick Gruber second. Dave Ellis and JoAnne Miller fi'0111 Denman and Company,LLP were present to answer any questions.Mr.Ellis spoke to the council and explained the findings and recommendations for this past fiscal year.Roll call:Ayes:Watts,Gruber,Stanton,Peard, Bailey.Nays:None.Motion carried 5 -O. (11)Resolution:Approving Veenstra &Kimm,Inc.as Engineers for the Sugar Creek Pump Station and Trunk Sewer Project for the area generally located west of L.A. I J J 5 j Grant Parkway and north of 312'1.Street Mike Watts moved to approve the resolution. Bill Peard second.City Engineer Mile Briedis explained this current project and explained potential projects for the future,Roll call:Ayes:Watts,Peard,Bailey,Gruber, Stanton.Nays:None.Motion carried 5 -O. (12)Resolution:Approving the Revised Personnel Policy and Procedures Handbook dated October 2003 Council member Nick Gruber moved to approve.Don Bailey,Jr. seconded the motion and asked to change "Contact with Media -press releases"so that all department heads housed at City Hall would be required to submit his/her press release to the City Administrator before submitting to the press.Nick Gruber indicated he would accept the change.Roll call:Ayes:Gruber,Bailey,Walts,Stanton,Peard. Nays:None.Motion carried 5 -O. (13)Ordinance:Approving an ordinance to amend Chapter 301,Waukee Municipal Code,Zoning Ordinance of the City of Waukee,Iowa,by deleting Legacy Pointe Planned Development Exhibit E,the Narrative of the Specifics of the Legacy Pointe Planned Development,and inserting in lieu thereof a revised Exhibit E,ami amend the Zoning Map (second reading)Darlene Stanton moved to have the first reading in title only.Council member and Mayor Pro Tem Bill Peard second.Roll call:Ayes:Stanton, Peard,Bailey,Gruber,Watts.Nays:None.Motion carried 5 -O.Mark Arentsen read the ordinance in title only. (14)Motion:Setting December 1,2003 as the date for a Public Hearing on an Ordinance to amend Chapter 301,Waukee Municipal Code,Zoning Ordinance of the City of Waukee,Iowa,by re-zoning and changing certain property therein from M-1 (Light Industrial District)to C-1 (Community and Highway Service Commercial District);and amend the Official Zoning Map to show re-zoning (Mid States Ford) Council member Mike Watts moved to approve the motion.Nick Gruber second.Brief Discussion.Roll call:Ayes:Watts,Gruber,Stanton,Peard,Bailey.Nays:None.Motion canied 5 -O. (15)Discussion:Consider Dates for Strategic Planning Session with Tim Shields There was a short discussion that resulted in setting January 29,2004 as the date to meet with consultant Tim Shields to discuss future growth options and plan for capital improvements.In addition a meeting to discuss the budget will occur December 8,2003 at 6:30 at the Waukee Public Library REPORTS were presented by Mark Arentsen,Linda Burkhart,John Gibson,Mik Briedis,Mike Watts,Don Bailey,Jr.and Nick Gruber.
