(1)Call to Order -The regularly scheduled meeting of the Waukee City Council was
called to order by Mayor Tony Oberman at 7:00 PM.
(2)Pledge of Allegiance
(3)Roll Call-The following members were present:Mayor Tony Oberman,and
Council members Nicholas Gruber,Donald Bailey,Jr.,Bill Peard and Darlene Stanton.
Council member Mike Watts absent.
(4)Open Forum -No one present wished to address the council about an item not on the
agenda.
(5)Agenda Additions /Approval-Items 10,11 and 12 were pulled from the agenda
due to failure to file requested legal documents in a timely manner.Nick Gruber moved
to approve the agenda with the deletion of items 10,11 and 12.Bill Peard seconded the
agenda as modified.Ayes:Gruber,Peard,Stanton,Bailey.Nays:None.Absent:Watts.
Motion carried 4 -0 -1.

D.Motion:Setting December 15,2003 as the date for a Public Hearing to amend
Chapter 301,Section 301.13,Waukee Municipal Code,Zoning Ordinance by
deleting §301.13(A)(2)and inserting in lieu thereof the following:"Multiple family
dwellings (apartments and condominiums),exclusive of row dwellings and
townhomes,consisting of not more than twenty-four (24)dwelling units in one
building."
E.Motion:Setting December 15,2003 as the date for a Public Hearing to amend
Chapter 301,Section 301.14,Waukee Municipal Code,Zoning Ordinance by
deleting said section and by inserting in lieu thereof a revised §301.14,''''R-4''Row
Dwelling and Townhome District"

(7)Mayor's Report:The Mayor attended the MFO meeting last week.Upcoming
meetings include meeting with Tom Dawson,Dallas County Mayors Association
Meeting,Council Workshop Meeting to discuss the budget,Municipal Leadership
Academy sponsored by the Iowa League of Cities.
(8)Resolution:Approving setting a date for a public hearing on a loan agreement in
the principal amount of $485,000 and the date for the sale of the $485,000 General

Obligation Refunding Bonds,Taxable Series 2004,to be issued in evidence of the
City's obligation thereunder Nick Gruber moved to approve.Darlene Stanton second.

carried 4 -0 -l.
(9)Resolution:Approving Final Plat for Parkview Crossing Plat 5 Public Works
Director John Gibson indicated that all requested legal documents had been turned in and
had been reviewed by the city attorney.City staff recommended approving the final plat.
Nick Gruber moved to approve the resolution,Darlene Stanton second.Roll call:Ayes:

(13)Resolution:Approving Construction Plans for William's Pointe Plat 5 J ohn
Gibson indicated that the traffic study was completed.It has been reviewed and
recommendations have been included in the construction plans fOTthe present time.Nick

(14)Public Hearing:On an Ordinance to amend Chapter 301,Waukee Municipal
Code,Zoning Ordinance of the City of Waukee,Iowa,by re-zoning and changing
certain property therein from M-l (Light Industrial District)to C-l (Community and
Highway Service Commercial District);and amend the Official Zoning Map to show
re-zoning (Mid States Ford)Mayor Oberman opened the public healing.No written
comments were received prior to the hearing.No one present wanted to address the
issue.MayOT Oberman closed the public hearing.
(15)Ordinance:Approving an Ordinance to amend Chapter 301,Waukee Municipal
Code,Zoning Ordinance of the City of Waukee,Iowa,by re-zoning and changing
certain property therein from M-l (Light Industrial District)to C-l (Community and
Highway Service Commercial District);and amend the Official Zoning Map to show
re-zoning (Mid States Ford)Darlene Stanton introduced the ordinance.Nick Gruber
moved to have the first reading in title only.Bill Peard seconded the motion.Roll call:
Ayes:Gruber,Peard,Stanton,Bailey.Nays:None.Absent:Watts.Motion canied 4 -0

(16)Ordinance:Approving an ordinance to amend Chapter 301,Waukee Municipal
Code,Zoning Ordinance of the City of Waukee,Iowa,by deleting Legacy Pointe
Planned Development Exhibit E,the Narrative of the Specifics of the Legacy Pointe
Planned Development,and inserting in lieu thereof a revised Exhibit E,and amend the
Zoning Map (third reading)Darlene Stanton moved to have the third reading in title
only and to place this ordinance on its final passage.Nick Gruber second.Council
member Bailey requested more information with respect to the concerns stated by
Attorney Jim McKinney for his client,Carole Crate whose driveway abuts the entryway
into and out of Legacy Pointe.City Attorney Paul Huscher addressed some of the issues
raised by Mr.Mclvinney regarding the entry way and the closesness of it to Carole

Crate's Drive way.Mr.Huscher also stated that a Planned Development Overlay
District,which is the zoning for Legacy Pointe,is "intended to provide flexibility in the
design of planned projects;to encourage innovation in project design that incorporates
open space and other amenities;and to insure compatibility of developments with the
surrounding urban environment.The PD (Planned Development)District is intended to
promot developments that will be advantageous to the City of Waukee and its urban form
by permitting project design that will surpass the quality of development resulting from
application of the regulations of conventional zoning districts."(§3 0 1.15(P)1,Waukee
Municipal Code)Mr.Huscher said that re-zoning of Legacy Pointe to a Planned
Development (PD)allowed the City Council to deviate from a strict interpretation of the
zoning regulations for anyone zone and to modify and adjust the plans appropriately.
The street in question is directly south across the highway li-mn a street already
constructed in Clive,Council member Gruber spoke in support of the street construction.

-1 -1.Mark Arentsen read the ordinance in title only.Mayor Oberman declared the
ordinance passed and duly adopted.

Gibson,Mile Briedis,Bill Peard,Don Bailey,Jr.and Nick Gruber.
At the close of the meeting Mayor Oberman asked for a motion to adjoum.Nick Gruber
moved.Bill Peard second.Ayes:All.Nays:None.Motion carried 4-0.
