(1)Call to Order -The regularly scheduled meeting of the Waukee City Council was
called to order by Mayor Tony Oberman at 7:00 PM.
(2)Pledge of Allegiance
(3)Roll Call-The following members were present:Mayor Tony Oberman,and
Council members Nicholas Gruber,Donald Bailey,Jr.,Mike Watts,Bill Peard and
Darlene Stanton.
(4)Open Forum -No one present wished to address an issue not on the agenda.
(5)Agenda Additions /Approval-Items #9 
 were removed from the agenda
prior to the meeting.Mike Watts moved to approve the agenda as modified.Bill Peard
seconded the motion.Ayes:Watts,Peard,Gruber,Bailey,Stanton.Nays:None.Motion
carried 5-0.

(7)Mayor's Report:Mayor reported on the dinner and visit with Tom Dawson,
Washington D.C.consultant.The mayor attended the Dallas County Mayor's
Association Meeting,the Aquatic Center Meeting.He attended the Municipal Leader's
Training,Part 1.He and Council member Darlene Stanton accepted the Smoothness
Award for asphalt paving on Warrior Lane and SE University Ave.Tbis award was
given to the City by the Asphalt Paving Association ofIowa for Municipal Street Paving
in 2003.The paving was engineered by Veenstra &Kimm,Inc.and completed by
Grimes Asphalt Paving,Inc.The mayor will be attending the MPO meeting and the
Greater DM Partnership Meeting during the coming week.
(8)Resolution:Approving honoring Mike Watts for his dedicated service to the citizens
of Waukee as council member during the previous four years Don Bailey,Jr.moved to
approve the resolution.Darlene Stanton second.Roll call:Ayes:Bailey,Stanton,Peard,
Gruber,Watts.Nays:None.Motion carried 5 -O.Mayor Oberman read the resolution
into the record and presented a signed copy of the resolution to Mike Watts who is
leaving the Council after serving four years.

HONORING MIKE WATTS FOR IDS DEDICATED SERVICE TO THE CITIZENS OF
WAUKEE AS COUNCIL MEMBER
DURING THE PREVIOUS FOUR YEARS
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,during his years on the Council,Mike has always been an energetic,willing,reliable can-do
SOli of guy;AND,
'''HEREAS,it was Mike who was usually one of the first to ask the difficult questions,to challenge the
unspoken assumptions,to promote discussion about an issue which seemed cut and dried and which,in
retrospect,was neither;AND,
WHEREAS,it was Mike,always cognizant of ensuring good for the greater community,who challenged
citizens,council members and staff to think big,to think outside of the "box",to expect more for ourselves
and for the City ofWankee,to be thank-full for whal we have and to grasp the possibilities for the future;
AND,
WHEREAS,it was Mike who time after time cleared his throat,stated his thoughts,held firmly to his
convictions and changed the course of whatever action was in front of the council;AND,
\VHEREAS,it was Mike who has made a difference during his time on the Council -not by words alone
but by actions has he done this.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Councit in session this tS'"day of
December 2003 that it hereby acknowledges and expresses heartfelt gratitude for the accomplislunents and
contributions of Mike Watts who as council member from January 2000 to January 2004 gave his all for
the betterment of us all who are residents of the City of Waukee.

(9)Receive/File:Report from Y1lfCA on Partner with Youth Program This item was
removed from the agenda.
(10)Public Heariug:On a loan agreement in the principal amount of $485,000 and
the date for the sale of the $485,000 General Obligation Refunding Bonds,Taxable
Series 2004,to be issued in evidence of the City's obligation thereunder Mayor
Oberman opened the public hearing.Mark Arentsen indicated we had not received any
written comments prior to the hearing.No one present wished to address the council on
this issue.Mayor Oberman closed the public hearing.

(11)Resolution:Approving taking additional action to enter into a Loan Agreement in
the principal amount of $485,000 Nick Gruber moved to approve the resolution.
Darlene Stanton second.A brief discussion ensued during which time Scott Sanders
finn Public Financial Management (PFM)answered questions.Mr.Sanders stated the
savings generated by refunding would be $30,000 over the life of the funding or about
$6,000 per year over a 5 year period.Roll call:Ayes:Gruber,Stanton,Peard,Bailey,
Watts.Nays:None.Motion carried 5 -O.
(12)Resolution:Approving setting a date for a public hearing on a loan agreement in
the principal amount of $1,090,000 and the date for the sale of the $1,090,000 General
Obligation Water Bonds,Taxable Series 2004,to be issued in evidence of the City's
obligation thereunder Mike Watts moved to approve.Darlene Stanton second.Council
member Bailey requested information concerning the cost of the project and whether
connection fees would be instituted for undeveloped land.Public Works Director John
Gibson stated the borrowing would be spent on construction of the new water tower and
the necessary connections,Reserve in the water fund would be used to construct a main
replacement in the older part of town.The engineers and bond counsel were reviewing
the possibility of connection fee districts and if approved,implementation of them would
be as soon as possible.Roll call:Ayes:Watts,Stanton,Peard,Bailey,Gruber.Nays:
None.Motion carried 5 -O.
(13)Receive/File:This item deleted from the agenda prior to the meeting.
(14)Resolution:Approving Preliminary Plat for Hickory Commercial Plat 1 Mike
Watts moved to approve.Bill Peard second.Erik Gilbertson with Cooper Crawford &
Associates presented information concerning the Preliminary Plat and the Final Plat of
Hickory Commercial Plat I and also Casey's General Store #3 Site Plan.Mr.Eli Wirtz,
counsel for Casey's General Stores,answered more specific questions concerning the
Casey's Site Plan.Council member Darlene Stanton extended her appreciation for the
methods and ways utilized to reduce the glare and the light spillage to neighboring areas.
Roll Call:Ayes:Walts,Peard,Bailey,Gruber,Stanton.Nays:None.Motion carried 5 -
O.
(15)Resolution:Approving Final Plat for Hickory Commercial Plat 1 Mike Watts
moved to approve.Darlene Stanton second.Roll Call:Ayes:Watts,Stanton,Gruber,
Peard,Bailey.Nays:None.Motion carried 5 -O.
(16)Resolution:Approving Site Plan for Casey's General Store #3 (Highway 6 and
Warrior Lune)Mike Walls moved to approve the resolution.Nick Gruber second.
Mike Watts encouraged the Council and City Staff to attempt to regulate the number and
location of convenience stores so that they were spaced appropriately throughout the city.
Council member and Mayor Pro Tem Bill Peard indicated he was in agreement with
Council member Watts and thought it was good to raise the issue.Roll Call:Ayes:
Watts,Gruber,Bailey,Stanton,Peard.Nays:None.Motion carried 5 -O.
(17)Resolution:Approving Construction Plans for Windfield Development II,
Walkout Revisions Mike Watts moved to approve the resolution.Darlene Stanton
second.The original design of the preliminary plat had to be changed due to street
design and due to the water flow from other areas.Enough soil was moved to create
detention ponds where houses could be elevated to create walk-outs.These were
predominately located at the ends of Cul-de-Sacs.Roll call:Ayes:Watts,Stanton,
Gruber,Peard,Bailey.Nays:None.Motion carried 5 -O.

Municipal Code,Zoning Ordinance by deleting §301.13(A)(2)and inserting in lieu
thereof the following:"Multiple family dwellings (apartments and condominiums),
exclusive of row dwellings and townhomes,consisting of not more than twenty-four
(24)dwelling units in one building."Mayor Oberman opened the public hearing.Mark
Arentsen indicated we had not received any written comments prim to the heating.No
one present wished to address the council on this issue.Mayor Oberman closed the
public hearing.
(20)Ordinance:Approving an ordinance to amend Chapter 301,Section 301.13,
Waukee Municipal Code,Zoning Ordinance by deleting §301.13(A)(2)and inserting in
lieu thereof the following:"Multiple family dwellings (apartments and condominiums),
exclusive of row dwellings and townhomes,consisting of not more than twenty-four

in lieu thereof a revised §301.14,""R-4"Row Dwelling and Town/tome District"(intro
and first reading)Nick Gruber introduced the ordinance.Darlene Stanton moved to
have the first reading in title only.Nick Gruber second.Roll call:Ayes:Stanton,
Gruber,Peard,Bailey,Watts.Nays:None.Motion carried 5 -O.Mark Arentsen read
the ordinance in title only.
(23)Ordinance:Approving an Ordinance to amend Chapter 303,Waukee Municipal
Code,Section 303.148 by deleting from said section the words "acceptance of the
improvements by the city council"and by inserting in lieu thereof:"submitting the
final plat for city council approval"so that Section 303.148 reads:"The subdivider
shall at the time of submitting the final plat for city council approval,post maintenance
bonds in an amount described herein as sufficient and as approved by the city attorney
as to form,sufficiency and manner of execution as set forth in these regulations"
(intro and first reading)Council member Don Bailey,Jr.moved to have the first
reading in title only.Nick Gruber second.Mr.Bailey thanked Paul Huscher for bringing
this to the council's attention.Roll call:Ayes:Bailey,Gruber,Stanton,Peard,Watts.
Nays:None.Motion carried 5 -O.Mark Arentsen read the ordinance in title only.
(24)Ordinance:Approving an Ordinance to amend Chapter 301,Waukee Municipal
Code,Zoning Ordinance of the City of Waukee,Iowa,by re-zoning and changing
certain property therein from M-l (Light Industrial District)to C-l (Community and

Highway Service Commercial District);and amend the Official Zoning Map to show
re-zoning (Mid States Ford)(second reading)Nick Gruber moved to approve the second
reading of this ordinance in title only.Darlene Stanton second.Roll Call:Ayes:Gruber,
Stanton,Peard,Watts,Bailey.Nays:None.Motion carried 5 -O.Mark Arentsen read
the ordinance in title only.
