HomeMy WebLinkAbout2004-03-01-Special MinutesWAUKEE CITY COUNCIL MINUTES SPECIAL MEETING MARCH 1,2004 (1)Call to Order -The special meeting of the Waukee City Council was called to order by Mayor Oberman at 6:00 PM. (2)Roll Call-The following members were present:Tony Oberman,Mayor,and Council members Nicholas Gruber,Donald Bailey,Jr.,JeffV.Mertz,Bill Peard and Darlene Stanton. (3)Discussion:Of the City's position on/otential voluntary annexation agreements with small lot owners on L.A.Grant and 312"Street Council reviewed and discussed two different pre-annexation agreements -one prepared by city staff and the other prepared by Stan and Jane Vennard.Two different areas were discussed:(1)animals;(2)80 linear foot assessment for street,curb,gutter,storm sewer and other associated improvements. After the discussion of existing animals on land proposed for annexation,the general consensus of the council was that members would like to know (I)what kind of animals;(2)how many animals;and (3)what the property owners are thinking.A strong council sentiment is that ownership of the animals would be based on a timeline of a set number of years which could be renewed at the pleasure of the council after the expiration of the initial period.One or two council members preferred to not set a time frame;but allow the animals to remain as long as the property is owned by the CUITentowners of record. Council and staff discussed street,curb,gutter,storm sewer and other associated improvements. Items discussed were:(I)installation of a rural cross section with no curb or storm sewer vs. regular street paving,curb,gutter and storm sewer;(2)assessment of 80 linear feet only;(3) payment by developers for improvements associated with development;(4)transitional tax abatement;(5)sanitary sewer connections;(6)TIF funding of the opposite side ofthe road. During the conversation it was suggested by council member Mertz that we initially construct rural cross sections (much like SE Warrior Lane)in the area proposed to be annexed.Once development begins,developers would be expected to install curb,gutter and storm sewer at the developers'expense.Council member Stanton was in agreement with this proposal.Council member Bailey indicated he would support a city/developer agreement where the full cost of paving both sides of the road could be paid by the owner of the development on one side of the road.It would be part of the agreement to repay the developer for the construction ofthe other half of the road once the property is sold or developed.Toward the end of the conversation council agreed to a worst case scenario for developers and for private owners where the property owner would pay 100%of a rural cross section or paving,curb,gutter and storm sewer, whichever was to be installed.Continuation ofthis discussion will occur at 6:00 PM,March IS.
