(2)Pledge of Allegiance (3)Roll Call-The following members were present:Tony Oberman,Mayor,and Council members Nicholas Gruber,Donald Bailey,Jr.and JeffV.Mertz.Bill Peard and Darlene Stanton absent. (4)Open Forum -Connie Comito addressed the council concerning the turn off into the Casey's General Store being built on the SW corner of Warrior and Highway 6.There is great concern that an out of control automobile could crash into the play area of the day care located on Laurel St.City Ach:rrinistrator Mark Arentsen said because of the tum,it is next to impossible to have an accident as mentioned occur.Even so,the request was made that the City construct a berm or install a fence which would divert a car from crashing into the day care area. Council member Bailey asked Mr.Arentsen to research the idea of constructing a berm and the method for payment. (5)Agenda Approval-Mayor Oberman requested that items 17 through 23 be deleted from the agenda;because he felt that issues had not been completely discussed by Attorney Lillis and City Staff.Jeff Mertz moved to approve the agenda as modified. (6)Consent Agenda- A.Approving 04-30-04 Payroll &05-12-04 Bill List B.Approving 05-03-04 &05-07-04 City Council Minutes C.Approving Change Order No.2 for TK Concrete,Inc.,for Warrior Lane Sidewalk and Storm Sewer Improvements project in the amount of $3,169.00,an increase in the contract amount D.Approving Partial Payment Estimate #4 for TK Concrete,Inc.for Warrior Lane Sidewalk and StOlID Sewer Improvements project in the amount of $29,548.33 E.Resolution:Approving Mosquito Control Proposal from Wilson Brothers Pest Control in the amount of$8,100 for 1'1ten applications and $790.00 for each additional application thereafter F.Resolution:Approving Notice of Hearing on Proposed Plans and Specifications and Proposed form of Contract for the Seal Coat Project for the City of Waukee,Iowa, and taking of Bids thereof G.Motion:Approving June 7,2004 as the date for a public hearing on an ordinance to amend Chapter 301.27,Waukee Municipal Code,Parking and Loading Areas,Section 301.27(B),Off Street Parking Area Required,by deleting the word:"space,"and inserting in lieu thereof the words:"a minimum number of spaces;"so that the heading reads:"In all districts,in connection with every industrial,commercial, business,trade,or institutional,recreational,or dwelling use,and similar uses,a minimum number of spaces for parking and storage of vehicles shall be provided in accordance with the following schedule:" H.Motion:Approving June 7,2004 as the date for a public hearing on an ordinance to amend Chapter 301.27,Waukee Municipal Code,Parking and Loading Areas, 1 Section 301.27(B)(6),Off Street Parking Area required,by adding to the "Multi- family dwelling -I or 2 bedroom -Two (2)parking spaces,"the following:"per unit.One (1)garage parking space may be counted as a parking space in fulfillment of the parking requirements,provided there is no less than one (1)open parking space for each dwelling unit and one not reserved parking space for each ten dwellling units."So that Section 301.27(B)(6)reads:"Dwellings -(a)Single Family Dwelling -Two (2)parking spaces accessible to the street.(b)Duplex Family Dwelling- Four (4)parking spaces accessible to the street.(c)Multi-Family Dwelling -I or 2 bedroom -Two (2)parking spaces per unit.One (1)garage parking space may be counted as a parking space in fulfillment of the parking requirements,provided there is no less than one (I)open parking space for each dwelling unit and one not reserved parking space for each ten dwelling units." 1.Resolution:Approving Certificate of Completion for Westgate Plat 6 Nick Gruber moved to approve the Consent Agenda.Jeff Mertz second.Brief discussion concerning mosquito spraying.The first spraying will occur before May 20th this year. (8)Public Hearing:On an amendment to the FY2004 Budget Mayor Oberman opened the public hearing.No written comments had been received prior to the beginning ofthis hearing.No one present wished to address the council on this issue.Mayor Oberman closed the public hearing. (9)Resolution:Approving an amendment to the FY2004 Budget Council member Bailey moved and Council member Gruber seconded the motion to approve the FY2004 Budget Amendment.A brief discussion comparing the current budget with next year's budget for licenses,permits and fees with the thought that we might have under budgeted for the coming year.Council member Bailey felt we had consistently underestimated the amount of revenue for licenses,permits and fees.He asked council to keep an eye on the revenue item.Roll call:Ayes:Bailey,Gruber,Mertz.Nays:None.Absent:Peard and Stanton.Motion carried 3 -a -2. (10)Resolution:Approving 28E Agreement with the Waukee Community School District for the School Resource Officer Program Council member Bailey moved to approve the resolution.Council member Gruber second.This has been a very successful program for the school as well as the Police Department.The true beneficiaries of the program have been the students and their parents.Roll call:Ayes:Bailey,Mertz,Gruber. (11)Resolution:Approving Intergovernmental28E Agreement for issuance and prosecution of violations occurring on or near roadways which are the common boundary of Clive and Waukee Council member Gruber moved to approve the resolution.Council member Mertz second.Everyone supports the beneficial sharing of resources between cities.Roll call:Ayes:Gruber,Mertz,Bailey.Nays:None.Absent: Peard,Stanton.Motion carried 3 -a -2. (12)Resolution:Approving Site Plan for Waukee High School Concession Stand Council member Mertz moved and Council member Bailey second the approval of the site plan for the Wankee High School Baseball/Softball Concession Stand.Brief discussion.Roll call:Ayes:Mertz,Bailey,Gruber.Nays:None.Absent:Peard,Stanton. Motion carried 3 -0-2. 5 (13)Resolution:Approving Preliminary Plat for Hunsberger Proprietor Plat 2 Council member Bailey moved to approve the resolution.Council member Mertz second.Greg Pierce of Nilles Associates,Inc.,306 S.Ankeny Blvd.,Ankeny,presented the preliminary plat for approval.Bike Trail location was discussed.There is a trail running north and south;but none running east and west at this time.V &K comment letters indicated that the proj ect was in substantial conformance with the Waukee subdivision regulations.Roll call:Ayes:Bailey,Mertz,Gruber.Nays:None.Absent: Peard,Stanton.Motion carried 3 -0 -2. (14)Resolution:Approving Final Plat for Hunsberger Proprietor Plat 2 Council member Mertz moved to approve;Council member Gruber second.Brief discussion. (15)Resolution:Approving Preliminary Plat for Painted Woods Jeff Mertz moved to approve this resolution.Nick Gruber second.Public Works Director John Gibson indicated that an agreement has been reached with the developer on ever~thing.Mark Arentsen indicated that a Development Agreement will be on the June 7'Agenda.Roll call:Ayes:Mertz,Gruber,Bailey.Nays:None.Absent:Peard,Stanton.Motion carried 3 -0-2. (16)Resolution:Approving Purchase of storm warning siren to be located at Centennial Park Nick Gruber moved to approve the storm warning siren.Don Bailey, Jr.second.Police Chief Larry Phillips indicated where this siren would be located.He also stated that this siren was part of the master plan.The next siren to be installed is scheduled for the vicinity of the 117 mile marker of the interstate.Roll call:Ayes: Gruber,Bailey,Mertz.Nays:None.Absent:Peard,Stanton.Motion carried 3 -0 -2. Mark Arentsen agreed.Jeff Mertz changed his motion to reflect postponement of this item and Nick Gruber seconded the changed motion.Roll call:Ayes:Mertz.,Gruber, Bailey.Nays:None.Absent:Peard,Stanton.Motion carried 3 -0 -2. ) 1 6 (25)Ordinance:To amend Chapter 401,Municipal Code of the City of Waukee,Iowa, §401.4(B)(1l),Maintenance of Premises,by deleting said section and inserting in lieu thereof,"Vehicles parked on any surface that is not Portland cement or asphalt or any such other permanent impervious surface in a portion of a yard exposed to public view."(third reading)Council member Mertz moved to have the third reading in title only and to place this ordinance on its fmal passage.Council member Gruber seconded the motion.Council member Bailey had voted on this issue previously because he thought the definition of surface was already in the code.Roll call:Ayes:Mertz,Gruber. Nays:Bailey.Absent:Peard,Stanton.Motion was defeated 2 -1 -2. (26)Ordinance:To amend Chapter 301.27,Waukee Municipal Code,Parking and Loading Areas,Section 301.27(C)(2),In Case of Any Building,Structure,or Premises, by deleting the said section and inserting in lieu thereof,"Any off-street parking area, including any commercial parking lot shall be surfaced with an asphaltic or Portland cement binder pavement or such other permanent impervious surface as shall be approved by the City Council.(third reading)Council member Gruber moved to have the third reading in title only and to place this ordinance on its [mal passage;Council member Mertz second.Council member Bailey who had voted "no"for this item the last two readings changed his vote to "yes"because he thought commercial parking lots were important.Roll call:Ayes:Gruber,Mertz,Bailey.Nays:None.Absent:Peard,Stanton. Motion carried 3 -0 -2.Mark Arentsen read the ordinance in title only. (27)Ordinance:To provide for the division of taxes levied on taxable property in the Revised Waukee Urban Renewal Area (2004 Amendment)(second reading)Council member Gruber moved to have the second reading in title only.Council member Mertz second.Council member Bailey had voted no on this item previously because he thought the ordinance covered bare ground rather than proposed developments.In addition he felt each parcel should be separate.Roll call:Ayes:Gruber,Mertz.Nays:Bailey. Absent:Peard,Stanton.Motion was defeated 2 -1 -2. (28)Ordinance:To amend Section 303.158(A),Waukee Municipal Code,Development Capital Feesfor Community Facilities,Wastewater Treatment Capital Fees of the City of Waukee,Iowa,by deleting Subsection 303.158(A)(3)and by deleting the table in Subsection 303.158(A)(4)and by inserting in lieu thereof in Subsection 303.158(A)(3) the sentence:"Non-residential,commercial or other development -the fee shall be the fee set out in subparagraph 4 hereof,"and by inserting in lieu thereof a revised table reflecting a doubling in non-residential per fixture unit fees in Subsection 303.158(A)(4).(second reading)Council member Bailey moved to have the second reading of this ordinance in title only.Council member Gruber second.Roll call:Ayes: Bailey,Gruber,Mertz.Nays:None.Absent:Peard,Stanton.Motion carried 3 -0 -2. Mrk Arentsen read the ordinance in title only. (29)Ordinance:To amend Section 304.5(M),Waukee Municipal Code,Chapter 304, Site Plan Requirements of the City of Waukee,Iowa by adding a new Sub-section 304.5(M)(5),Downtown Triangle District;and by re-numbering in numerical order each sub-section thereafter (intro and first reading)Council member Bailey introduced this ordinance.Council member Gruber moved to have the first reading in title only. Council member Mertz second.Brief discussion.Roll call:Ayes:Gruber,Mertz,Bailey. Nays:None.Absent:Peard,Stanton.Motion carried 3 -0 -2.Mark Arentsen read the ordinance in title only. 7 (30)Resolution:Approving Final Plat/or Westgate Plat 6 Don Bailey,Jr.moved to approve the resolution.Nick Gruber second.Planning and Zoning Commission approved this item at the 6:30 meeting prior to the regular meeting.Brief discussion conceming the trail easement.Roll Call:Ayes:Bailey,Gruber,Mertz.Nays:None. Absent:Peard,Stanton.Motion carried 3 -0 -2. REPORTS:Reports were given by Mark Arentsen,Jody Gunderson,Linda Burkhart, John Gibson,Mik Briedis,Chad Weaver,Paul Huscher,Jeff Mertz,and Don Bailey,Jr. Ms.Paardekooper stated that a public hearing regarding adoption of agenda item #12 had not been held as required.As a result the ordinance was not properly adopted and would not be published.The adoption process for this ordinance will need to be restarted.
