(1)Call to Order -The regular meeting ofthe Waukee City Council was called to order
by Mayor Oberman at 7:00 PM.
(2)Pledge of Allegiance
(3)Roll Call-The following members were present:Tony Oberman,Mayor,and
Council members Nicholas Gruber,Donald Bailey,Jr.,JeffV.Mertz and Darlene
Stanton.Council member Bill Peard absent.
(4)Open Forum -Beverly White of 450 Laurel Street has lived in her apartment
building for thirteen years.This is the 8th time her apartment has been flooded in
this building.Warren Hunsberger,the landlord,improved the drainage around the
building and connected it to the street storm sewer.This year it was determined
that there was blockage in the tile at the street connection and the water came
back into the apartment.She wanted to know ifthere was anything that could be
done.Consensus of the council was to investigate the situation and attempt to
prevent a recurrence.Public Works Director John Gibson will keep Mrs.White
and the council informed as to the progress of the project.
Don Bailey,Jr.mentioned that the Frisbee Golfhas brought more young people to
the park,which is great.There have also been an increased number of individuals
exceeding the speed limit in the park,which is not as great.Council member
Bailey wished to inform the council and will be visiting with Chief Phillips
concerning the speeding in the park.

following exceptions:delete Item 14 from the agenda and move items 6E,6F and 6G

M.Motion:Setting June 21,2004 as the date for a public hearing on an amendment to
Section 303.158(A),Waukee Municipal Code,Development Capital Fees for
Community Facilities,Wastewater Treatment Capital Fees ofthe City of Waukee,
Iowa,by deleting Subsection 303.158(A)(3)and by deleting the table in Subsection
303.158(A)(4)and by inserting in lieu thereof in Subsection 303.l58(A)(3)the
sentence:"Non-residential,commercial or other development -the fee shall be the
fee set out in subparagraph 4 hereof."and by inserting in lieu thereof a revised table
reflecting a doubling in non-residential per fixture unit fees in Subsection
303.158(A)(4)
N.Motion:Setting June 21,2004 as the date for a public hearing for the following three
ordinances related to amending Chapter 301,Providing for a Schedule of Fees:
(I)To amend Chapter 301,Waukee Municipal Code,Section 301.31,Providing
for a Schedule of Fees,ordinance of the City of Waukee,Iowa,by deleting
"$45.00",defined as the construction Inspection Fee;and by inserting in lieu
thereof "$50.00".
(2)To amend Chapter 301,Providing for a Schedule of Fees,Ordinance of the
City of Waukee,Iowa,by adding the paragraph:"Costs incurred by the City of
Waukee for the use of City Department of Public Works Employees shall be
reimbursed to the City of Waukee at the employee's hourly rate plus 15%.Those
costs associated with the use of Public Works Equipment shall be reimbursed to
the City at the same rate as listed in the Iowa Department of Transportation
Schedule of Equipment Rates,Current Edition."
(3)To amend Chapter 301,Providing for a Schedule of Fees,Ordinance of the
City of Waukee,Iowa,by adding the words:"A late payment charge of 1.5%
shall be added to the past due amount if the invoice is not paid in full within
thirty (30)days of the date of the invoice."
O.Motion:Setting June 21,2004 as the date for a public hearing for the following three
ordinances related to residential off-street parking:
(I)To amend Chapter 301.27,Waukee Municipal Code,Parking and Loading
Areas,Section 301.27(C)(3),In Case of Any Building,Structure,or Premises,by
adding to said subsection the words:"...and away from the traveled roadway of
public streets;"so that said section reads:"Any lighting used to illuminate any
off-street parking area,including any commercial parking lots,shall be so
arranged as to reflect the light away from adjoining premises in any "R"District,
and away from the traveled roadway of public streets."
(2)To amend Chapter 301.27,Waukee Municipal Code,Parking and Loading
Areas,by inserting Section 301.27(D),"Parking Regulations for Single Family
Residential Lots;"so as to provide for the development and maintenance of off-
street parking for single family residential lots;and by re-Iettering each
successive section therein in alphabetical order.
(3)To amend Chapter 301.27,Waukee Municipal Code,Parking and Loading
Areas,Section 301.27(C)(2),In Case of Any Building,Structure,or Premises,by
deleting the said section and inserting in lieu thereof,"Any off-street parking
area,including any commercial parking lot shall be surfaced with an asphaltic or
Portland cement binder pavement or such other permanent impervious surface as
shall be approved by the City Council.

Des Moines MPO and appointing Chad Weaver as the altemate to the DMMPO

Q.Resolution:Setting July 12,2004 as the public hearing date for an ordinance to
provide for the establishment ofthe Water Tower Connection Fee District,pursuant
to Section 384.3 8 of the Code ofIowa
R.Approving Partial Payment No.2 to Iowa Signal and Electric Co,for Hickman Rd
Street Lighting Project -Phase II in the amount of $36,266,82

Don Bailey,Jr.moved to approve Item 6E;Jeff Mertz second.John Gibson indicated all
comment letters had been addressed.Park land area agreement for approximatelyI6
acres located north of Williams Pointe and South of Legacy Pointe has not changed.

F.Resolution:Approving Construction Plans for Williams Pointe Plat 6
Don Bailey,Jr.moved to approve Item 6E;Jeff Mertz second.After a brief discussion
council member Bailey moved his motion contingent upon receiving a letter from Mr.
Schwartz indicating that he accepted the change in water routes to avoid a long standing
water problem.Council member Mertz seconded the changed motion,Roll call:Ayes:
Bailey,Mertz,Gruber,Stanton.Nays:None,Absent:Peard,Motion carried 4 -0 -1.

G.Resolution:Approving Construction Plans for Parkview Crossing Plat 6
Don Bailey,JI.moved to approve Item 6G;Darlene Stanton second.Don Bailey
mentioned the lack of a map for this project.Rick Ross,830 Highway 6,representing
himself and Jerry Grubb,indicated that there were 50 acres in total,which are directly
east of what were plats 2 and 3 in Parkview Crossing.There are.1 10 single family lots
with approximately 15 acres of multi-family buildings abutting the commercial along the
Alice's Road extension to the interstate.A map had been provided at the beginning of
this process.Roll call:Ayes:Bailey,Stanton,Mertz,Gruber,Peard.Nays:None.

(7)Mayor's Report:attended a special meeting of the Board of Supervisors concerning
the Dallas County Airport;attended the open house for the administrative offices of the
school,attended the MFO meeting,toured the Pointe of Grace Church and spoke with
Pastor Jeff Mullen of the Church.The mayor commended the Waukee Chamber of
Commerce for the information commercials.Tim Shields,Director ofthe Institute of
Public Affairs and a strong advocate for cities,died during the past two weeks.He was
very helpful to the City of Waukee.Upcoming events include:trip to Washington D.C.
with Greater DM Partnership.Attendees include Arentsen,Mertz,Ron Stahlman,
President of the Waukee Chamber;and attend an MFO meeting.The mayor commended
the public safety officials for watching the weather and warning citizens during the past

(13)Resolution:Approving Preliminary Plat for Legacy Pointe Plat 3 Jeff Ewing of
Ewing Land Development,Pella,Iowa present to discuss the proj ect.This is the
residential development of 82 lots.Infrastmcture will be completed all at once.The
interior Park Trail goes up through the middle and will be taken care of the association.
Also,the detention pond will be maintained by the home owner's association.The east
west portion of the bike trail will be taken care of by Parks and Rec.Darlene Stanton

(14)Resolution:Approving Park Land acquisition agreement with Lemar Koethe and
Kurt Brewer This item deleted from the agenda.
(15)Resolution:Approving ordering detailed plans,specifications,notice of hearing,
notice to bidders and form of contract for the warrior Park Grading Project Nick
Gruber moved to approve.Darlene Stanton second.Brief Discussion conceming cost
and funding of this project:Estimated cost would be approximately $70,000 to $77,000
and would be funded out of the Capital Projects Fund.Roll call:Ayes:Gruber,Stanton,

(16)Resolntion:Approving detailed plans and specifications for the Warrior Park
Grading Project,notice of hearing,notice to bidders and form of contract;and setting
July 9 at 1:00PM as the date and time for receiving bids therefore and setting July 12,
2004 as the date for a public hearing thereon Nick Gruber moved to approve.Jeff
Mertz second.No discussion.Roll call:Ayes:Gruber,Mertz,Stanton,Peard,Bailey.
Nays:None.Motion carried 5 -O.
(17)Resolution:Approving installation of temporary traffic signals at the intersection
of Boone &University Avenue Don Bailey moved to approve;Jeff Mertz second.West
Des Moines will share some of the cost for this project.Darlene Stanton wanted to thank
resident Becky Roemer for addressing her concerns to the city administrator and to the
council as to the safety ofthis intersection.Quick action by staff,West Des Moines staff
and council will help to alleviate the congestion in this area and possibly avert accidents
in the future.Roll call:Ayes:Bailey,Mertz,Stanton,Peard,Gruber,Nays:None.

(18)Resolution:Approving the Des Moines Area Metropolitan Planning
Organization's Fiscal Year 2005 Unified Planning Work Program,for the period July
1,2004 through June 30,2005 Darlene Stanton moved to approve this resolution.Nick

shall be provided in accordance with the following schedule:"(introduce and have the

first reading in title only,waive the second and third readings and place this ordinance on
its final passage.Bill Peard seconded the motion.Brief discussion.Roll call:Ayes:

the ordinance.Mayor Oberman declared the ordinance passed and duly adopted.

for each ten dwelling units."So that Section 301.27(B)(6)reads:"Dwellings -(a)

(26)Ordinance:To amend Chapter 401,Municipal Code of the City of Waukee,Iowa,

(28)Public Hearing:On plans,specifications,proposed form of contract and estimate
of cost for Seal Coat Project Mayor Oberman opened the public hearing,Mr.Arentsen
indicated that no written comments were received prior to the public hearing.No one
present wished to address the council on this issue.Mayor Oberman closed the public
hearing.
(29)Resolution:Finally approving and confirming plans,specifications,form of
