JUNE 21,2004 I
(1)Call to Order -The regularly scheduled meeting of the Waukee City Council was
called to order by Mayor Oberman at 7:07 PM.
(2)Pledge of Allegiance
(3)Roll Call-The following members were present:Tony Oberman,Mayor,and
Council members Nicholas Gruber,JeffV.Mertz and Darlene Stanton.Council
members Peard and Bailey absent.
(4)Open Forum -Geoff Wearmouth addressed the council concerning the
Waukee Businesses project called Marcom.It is a marketing device for those
businesses in Waukee who wish to participate.The commercials air two different
times -once in the spring/summer and a second time in the summer/fall.Mr.
Weannouth asked the council for $750 for partnering with Waukee Businesses.
Council member Gruber suggested $1,000.All council members present
supported the project.
Mayor Oberman asked the Council to clarify which dates would be scheduled for
the council meetings in July.Those present agreed on July 6 and July 19 with a
special meeting on the 26th.
(5)Agenda Approval-Items #10,16,17,18 and 19 were deleted from the agenda.Items
6B,6F and 6L were removed from the consent agenda and considered individually.Nick
Gruber moved to approve the agenda as modified.Darlene Stanton seconded.Ayes:

N.Motion:Setting July 12,2004 as the date for a Public Hearing to amend Chapter 301,
Waukee Municipal Code,Zoning Ordinance of the City of Waukee,Iowa,by adding
to Legacy Pointe Planned Development Exhibit E,Item 14D,permitting a shared
monument sign with certain conditions added thereto so that it reads:"Signage.One
monument sign will be allowed on lot B of the Legacy Pointe conunercial area.The
sign will be utilized for the tenants oflots 4 and 5.Said sign shall comply with the
size restriction set forth in §305 of the Waukee Code for a shared monument sign.All
other restrictions,including required setbacks,from §305 will be followed.No
monument sign will be allowed on either of these individual lots.No other monument
signs shall be allowed on this lot with the exception of an entry monument for the
development (as permitted by §305);"and amend the official Zoning Map.
O.Approving Partial Payment Estimate #4 (Final)for Van Hauen &Associates,Inc.for
work completed on R-22 Sanitary Sewer Improvements,Contract I in the amount of
$39,472.50
P.Approving Partial Payment Estimate #5 (Final)for The Underground Co.,Ltd.for

Darlene Stanton requested review ofthe 05-27-04 minutes and a revision in those
minutes.The revision presented was moved as part ofthe approval of this item by

6F.Approving Change in Outdoor Service Area for MipFour Inc.DBA Mickey's Irish
Pub for Tuesday,June 22 and 29;July 6,13,20 and 27;August 3,10,17,24
Darlene Stanton asked that the council not approve August 24 because school was in
session.Steve McFaddon,owner of Mickey's Irish Pub,suggested that he would
discontinue the band with beer garden stations remaining open for this date.Linda
Burkhart,Treasurer,suggested that the 17th was the evening before the first day of
school;so that date was also included as a date for no band with beer garden stations
remaining open.Council member Stanton moved to approve the Outdoor Service Area
for all ofthe dates with the exception of no band for August 17 and 24.Council member
Mertz second.Roll call:Ayes:Stanton,Mertz,Gruber.Nays:None.Absent:Bailey,
Peard.Motion carried 3-0 -2.
6L.Resolution:Approving Construction Plans for Painted Woods
John Gibson,Public Works Director,asked council to approve the construction plans
subject to staff and engineer review and approval of the lift station.Council member
Mertz so moved.Council member Stanton second.Roll call:Ayes:Mertz,Stanton,

(7)Mayor's Report:The Mayor spoke about the recent trip to Washington,D.C.by
Chamber of Commerce Chairman Ron Stallman,the Mayor,Council member Jeff Mertz,
City Administrator Mark Arentsen.In the many meetings held with Washington staff,
the neighboring communities of Clive and WDM were supportive of Waukee's effort to
secure funding for the Interstate 80 /Alice's Rd Interchange.The hip was organized by
the Greater DM Partnership.The Mayor attended the MFO meeting.The Mayor
reminded council of the Planning &Zoning joint meeting on the 28th.

received prior to the meeting.In addition no one present wished to address the Council
on this issue.Mayor Oberman closed the public hearing.

(10)Resolution:Approving Development Agreement with Painted Woods Development
Joint Venture,LC for Painted Woods This item deleted from the agenda.
(11)Resolution:Approving Site Plan for Westside Plaza Jeff Mertz moved to approve
the resolution.Nick Gruber second.Matt Keller of Vantage Point,2100 Dixon,D.M.,
the architects for the project stated that the building was to be 12,840 sq.ft.with a dance
studio in one half and special office space in the other half.He also indicated the outside
surface would now be 100%brick.Mark Lee of Lee Engineers and Surveyors,3031 NWss"St.discussed the project by reviewing V &K letter dated 06-10-04.John Gibson,
Public Works Director requested that council approve the resolution contingent upon
accommodating a future storm sewer connection by leaving two pipes which will fit into
the triple wide intake at the right-of-way.There will be round corners at the entrance/exit
to provide space for sidewalks.Mik Briedis,of V &IC addressed several items of concern.
After further discussion of the various items mentioned in the V &K letter,it was
suggested by Mayor Oberman that the resolution for this item would be approved
contingent on resolving all open items listed on the V &K letter.Scott Jones and his wife,

(12)Resolution:Approving ordering the preparation of plans,specifications,notice of
hearing,notice to bidders and form of contract for the Wastewater Treatment Facility

for Receipt of Bids therefore and setting July 19,2004 as the date for a Public Hearing

lieu thereof in Subsection 303.158(A)(3)the sentence:"Non-residential,commercial or
other development -the fee shall be the fee set out in subparagraph 4 hereof,"and by
inserting in lieu thereof a revised table reflecting a doubling in non-residential per
fixture unit fees in Subsection 303.158(A)(4).(intro and first reading)Mayor

Capital Fees of the City of Waukee,Iowa,by deleting Subsection 303.158(A)(3)and by
deleting the table in Subsection 303.158(A)(4)and by inserting in lieu thereof in
Subsection 303.158(A)(3)the sentence:"Non-residential,commercial or other
development -the fee shall be the fee set out in subparagraph 4 hereof,"and by
inserting in lieu thereof a revised table reflecting a doubling in non-residential per
fixture unit fees in Subsection 303.158(A)(4).(intro and first reading)Darlene Stanton

plus 15%.Those costs associated with the use of Public Works Equipment shall be
reimbursed to the City at the same rate as listed in the Iowa Department of
Transportation Schedule of Equipment Rates,Current Edition."Mayor Oberman
opened the public hearing.City Administrator Mark Arentsen stated that no one had
submitted written comments on this issue.No one present wished to address the council
on this issue.Mayor Oberman closed the public hearing.

illuminate any off-street parking area,including any commercial parking lots,shall be
so arranged as to reflect the light away from adjoining premises in any "R"District;

public hearing.City Administrator Mark Arentsen stated that no one had submitted
written comments on this issue.Darlene Stanton suggested that the light fixture should
also be shielded.After some discussion Mark Arentsen suggested inserting the word
"shielded and"after the words "shall be"and before the words "so arranged."Joe
Schmidt asked whether this proposed ordinanced had to do with site plans and whether it
had to do with new construction.Chad Weaver stated that this ordinance is not part of
the site plan;but is part of the parking and loading section of the Zoning Code.It will
predominately deal with new development or complete relighting of old development.
Jeff Mertz was concerned that the new ordinance as changed by adding "shielded"would
create a problem in the downtown area.It was suggested that this ordinance exclude the
Downtown Zoning District.Mayor Oberman closed the public hearing.
(30)Ordinance:On an ordinance to amend Chapter 301.27,Waukee Municipal Code,
Parking and Loading Areas,Section 301.27 (C)(3),in Case of Any Building,Structure,
or Premises,by adding to said subsection the words:"...and away from the traveled

Code,Parking and Loading Areas,by inserting Section 301.27(D),"Parking
Regulations for Single Family Residential Lots;"so as to provide for the development
and maintenance of off-street parking for single family residential lots;and by re-
lettering each successive section therein in alphabetical order Mayor Oberman opened
the public hearing.Mark Arentsen indicated he had received an email from Darlene
Stanton.Council member Stanton began the discussion on the proposed ordinance by
questioning whether we would want to be more specific as to what is allowed in the back
yard parking including size of the parking space and type of vehicle.Discussion
continued on the type of vehicle especially a "work"vehicle such as a van or a wrecker.
The grandfather clause was discussed with respect to having a cement drive-way and a
graveled off street parking space vs.a graveled drive-way and a graveled off street
parking space.Grandfathering in graveled RV parking was also discussed.Nick Gruber,
Paul Huscher,Jeff Mertz,Joe Schmidt,Jim Phillips were among those speaking on this
issue.Mark Arentsen suggested sending this ordinance through P &Z for further
discussion.Mayor Oberman closed the public hearing.

asphaltic or Portland cement binder pavement or such other permanent impervious
surface as shall be approved by the City Council.Mayor Oberman opened the public
hearing.Mark Arentsen indicated he had not received any written comments.There was
much discussion about residential and commercial parking,both included in this
ordinance.In addition,the issues of new vs.old construction and the concept of non-
conforming use was discussed.Jim Phillips,240 Bel Aire Drive was concerned about
continuing to use gravel parking and drive-ways,which were already in place.City
Attorney Paul Buscher will review Section 301.7 and this proposed ordinance.Mayor
Oberman closed the public hearing.

dwelling units."So that Section 301.27(B)(6)reads:"Dwellings -(a)Single Family
Dwelling -Two (2)parking spaces accessible to the street.(b)Duplex Family
Dwelling -Four (4)parking spaces accessible to the street.(c)Multi-Family Dwelling
-1 or 2 bedroom -Two (2)parking spaces per unit.One (1)garage parking space
may be counted as a parking space in fulfillment of the parking requirements,provided

member Stanton suggested that her research indicated that open space parking in the
