(1)Call to Order -The regular meeting ofthe Waukee City Council was called to order
by Mayor Oberman at 7:00 PM.
(2)Pledge of Allegiance
(3)Roll Call-The following members were present:Mayor Tony Oberman,Mayor Pro
Tern Nicholas Gruber,and Council members Donald Bailey,Jr.,Jeff V,Mertz,and
Darlene Stanton.Council member Bill Peard absent.
(4)Open Forum -No one appeared to address the Council during the Open
Forum.
(5)Agenda Approval-Council member Bailey moved to approve the agenda as written
with the following exceptions:delete Items 21,22,and 23 from the agenda.Council
member Stanton seconded the motion.Roll call:Ayes:Bailey,Stanton,Mertz,Gruber.

(7)Mayor's Report:Mayor Oberman mentioned the recent special meetings held by the
Council:one on annexation,and another j oint meeting with the Planning &Zoning
Commission.Another joint meeting with P&Z is scheduled for August 23.The mayor
commended the Parks and Rec Board for the 4th of July celebration,especially the parade
and fireworks.Last week,the mayor attended an informational meeting on the West
Metro Airport.The meeting was held to update those communities that took part in the
feasibility study.Also in attendance were Council members Mertz and Gruber.Mayor
Oberman stated that the results of the study were positive,and that the airport would be a
good investment.Linda Schaut of the Greater Dallas County Development Alliance will
soon give a presentation to the Council regarding the airport,most likely in a special
meeting.The reception for Citizen ofthe Year John Werner was held;the mayor extends
his congratulations and thanks.On Wednesday,July 21,the reception for Volunteer of
the Year Carleen Evans will be held.Mayor Oberman encouraged everyone to attend,
and thanked Carleen for her work in the community.The mayor's upcoming schedule

includes meetings with the Waukee Area Chamber of Commerce and Greater Des
Moines Partnership,the Mid Iowa Association of Local Govermnents,and the MFO.A
special City Council meeting is scheduled for Monday,July 26 for an update on capital
improvement projects;perhaps Linda Schaut will give her presentation at this meeting.
Mayor Oberman encourages everyone to attend the Waukee Area Chamber of Commerce
golf outing on July 28.
(8)Presentation:A representative of the Greater DM Partnership will be discussing
the recent Washington,D.C.Trip Jackie DiGiacinto,Director of Public Relations and
Public Policy for the Greater DM Partnership,addressed the Council.She also
coordinates the annual Washington,D.C.trip.This past year was the 25th anniversary of
the Washington trip,and Ms.DiGiacinto presented a certificate of appreciation from the
Partnership,thanking the City of Waukee for sending representatives on the trip.She
also thanked the Waukee Area Chamber of Commerce and Community Development
Committee for sending a representative.Mayor Oberman stated that the trip was great,
and very well-organized.
(9)Resolution:Approving agreement pursuant to Iowa Code Chapter 28E between the
City of Waukee,Iowa and the City of West Des Moines,Iowa for the provision of
Information Technology Support Services Council member Stanton moved to approve.
Council member Bailey seconded the motion.Daryl Greifzu,IT manager for the City of
West Des Moines,was in attendance to answer any questions.City Administrator Mark
Arentsen expressed his appreciation to the City of West Des Moines for the IT work they
had done thus far.Council member Bailey asked about the fiscal impact of the
agreement.Mr.Arentsen stated that each department already budgets for IT services,and
those funds will apply to the agreement.$40,000 is projected for the agreement.Mayor
Pro Tern Gruber expressed his appreciation to the City of West Des Moines for their
willingness to work with Waukee on IT services.Mayor Oberman also stated his

(10)Public Hearing:On plans and specifications,proposed form of contract and
estimate of cost for construction of the Warrior Park Grading Improvements for the
City of Waukee,Iowa,and the taking of bids therefore Mayor Oberman opened the
public hearing.Mr.Arentsen stated that no written comments were received prior to the
public hearing.No one present wished to address the Council on this issue.Mayor
Oberman closed the public hearing.
(11)Resolution:Finally approving and confirming plans,specifications.forms of
contract and estimate of cost for the Warrior Park Grading Improvements Mayor Pro
Tern Gruber moved to approve.Council member Mertz seconded the motion.Roll call:
Ayes:Gruber,Mertz,Bailey,Stanton.Nays:None.Motion carried 4 -0 -I.
(12)Resolution:Approving Awarding Contract for Warrior Park Grading
Improvements Mayor Pro Tern Gruber moved to approve.Council member Mertz
seconded the motion.Roll call:Ayes:Gruber,Mertz,Stanton,Bailey.Nays:None.
Motion carried 4 -0 -1.
(13)Public Hearing:On an ordinance providing for the establishment of the Water
Tower Connection Fee District,pursuant to section 384.38 of the Code of Iowa Mayor
Oberman opened the public hearing.Mr.Arentsen stated that no written comments were

this issue.Mayor Oberman closed the public hearing.
(14)Ordinance:To provide for the establishment of the Water Tower Connection Fee
District,pursuant to Section 384.38 of the Code of Iowa (intro and first reading)
Council member Stanton introduced the ordinance.Mayor Pro Tern Grubermoved to
have the first reading in title only.Council member Stanton seconded the motion.
Council member Bailey stated that the Utilities Committee had approved the ordinance,
and he hopes that the next step will be to lower water utility rates.Roll call:Ayes:
Gruber,Stanton,Bailey,Mertz.Nays:None.Motion carried 4 -0 -1.Mr.Arentsen
read the ordinance in title only.
(15)Public Hearing:On designation of the amended Waukee Urban Renewal Area
and on urban renewal plan amendment for the 2004 Addition to the Waukee Urban
Renewal Area Mayor Oberman opened the public hearing.Mr.Arentsen stated that a
letter was received from the Dallas County Board of Supervisors expressing no position
on the matter.Director of Community Development J ody Gunderson stated that he met
with Alice Wicker,Dallas County Supervisor,who appeared pleased with the direction
the City was going on urban renewal.Mayor Oberman closed the public hearing.
(16)Resolution:Approving the declaration of necessity and establishment of an urban
renewal area,pursuant to Section 403.4 of the Code of Iowa and approve urban
renewal plan amendment for the 2004 Addition of the Waukee urban Renewal Area
Council member Stanton moved to approve.Council member Mertz seconded the
motion.Council member Bailey expressed his support for deleting certain properties
from the Urban Renewal Area,but questions the effect the added properties will have on
the general fund.Roll call:Ayes:Stanton,Mertz,Gruber.Nays:Bailey.Motion carried
3-1-1.
(17)Ordinance:To provide for the Division of Taxes 0/1 taxable property in the 2004
Addition to the Waukee urban Renewal Area,pursuant to Section 403.19 of the Code
of Iowa (intro and first reading)Council member Mertz introduced the ordinance.
Council member Bailey moved to have the first reading in title only.Council member
Stanton seconded the motion.Mayor Pro Tern Gruber asked for an amendment to the
motion to waive the second and third readings and place the ordinance on final passage.

(18)Resolution:Approving and adopting Final Assessment Schedule for the R-22
Sanitary Sewer Improvements Project and Amending,Confirming and Levying
Assessments Mayor Pro Tern Gruber moved to approve.Council member Stanton
seconded the motion.Council member Bailey stated that he thought a 9%interest rate on
special assessments was too high,and that he would support 5%.Roll call:Ayes:
Gruber,Stanton,Mertz.Nays:Bailey.Motion carried 3 -1 -1.
(19)Resolution:Approving Supplemental Agreement with Kirkham Michael
Consulting Engineers in the amount of $25,000 for the Interchange Justification
Report,Interstate 80 at Alice's Road /1 05th Street Council member Stanton moved to
approve.Council member Mertz seconded the motion.Shawn Foutch of Kirkham
Michael was in attendance to answer any questions.Council member Mertz stated that

change orders do not appear to be coming in to the City in a timely manner.Mr.
Gunderson explained that that the work done for this particular report was done at the
direction of the roOT and Federal Highway Administration,and was in addition to the
original contract.Roll call:Ayes:Stanton,Mertz,Bailey,Gruber,Nays:None.Motion
carried 4 -0 -1.
(20)Resolution:Approving Payment Estimate No.2 for Kirkham Michael Consulting
Engineers for the Alice's Road /105th Street 1-80 Interchange Justification Report in
the amount of$23,650 Council member Mertz moved to approve.Mayor Pro Tem
Gruber seconded the motion.Roll call:Ayes:Mertz,Gruber,Bailey,Stanton.Nays:
None.Motion carried 4 -0 -1.
(21)Resolution:Approving Pre-Annexation Agreement with Marvin E.and Iva Terry
This item deleted from the agenda.
(22)Resolution:Approving Pre-Annexation Agreement with Michael Phillips This
item deleted from the agenda.
(23)Resolution:Approving Pre-Annexation Agreement with Randolph Allison This
item deleted from the agenda.
(24)Resolutiou:Approving wage adjustment for non-represented employees for FY05
Mayor Pro Tem Gruber moved to approve.Council member Bailey seconded the
motion.Council member Stanton asked that the motion be amended to remove the City
Administrator portion,as the Performance Review is ongoing and not complete.Mayor
Pro Tem Gruber stated that the wage adjustment was for a cost-of-living increase,and it
didn't seem fair to exclude the position.Roll call:Ayes:Gruber,Stanton,Mertz.Nays:
Bailey.Motion carried 3 -1 -1.
(25)Resolution:Approving Lee Engineering request for payment of additional services
provided for the University Avenue widening design work in the amount of$4,890.00
Council member Bailey moved to approve.Council member Mertz seconded the motion.
Roll call:Ayes:Bailey,Mertz,Stanton,Gruber,Motion carried 4 -0 -1.

(27)Ordinance:To amend Chapter 401,Waukee Municipal Code,Maintenance of
Property,Section 401.4(B),Maintenance of Premises,by adding to said section,
Section401.4(B)(16)which reads asfollows:"Gravel driveways not maintained free of
weeds shall be declared a nuisance.Removal of vegetation in gravel will be required."
(intro and first reading)Council member Stanton introduced the ordinance.Council
member Mertz moved to have the first reading in title only.Mayor Pro Tern Gruber
seconded the motion.Council member Mertz suggested that the ordinance state "gravel
driveways not maintained free of weeds"be reworded to state "gravel driveways not
maintained free of vegetation."Mr.Arentsen stated the change would be made prior to
the next reading.Roll call:Ayes:Mertz,Gruber,Bailey,Stanton.Motion carried 4 -0-

(28)Ordinance:to amend Chapter 301,Waukee Municipal Code,Section 301.31,
Providing for a Schedule of Fees,Ordinance of the City of Waukee,Iowa,by deleting
"$45.00",Defined as the Construction Fee;and by inserting in lieu thereof "$50.00".

(29)Ordinance:To amend Chapter 301,Providing for a Schedule of Fees,Ordinance
of the City of Waukee,Iowa,by adding the paragraph:"Costs incurred by the City of
Waukee for the use of City Department of Public Works Employees shall be
reimbursed to the City of Waukee at the employee's hourly rate plus benefits plus 15%.
Those costs associated with the use of Public Works Equipment shall be reimbursed to
the City at the same rate as listed in the Iowa Department of Transportation Schedule
of Equipment Rates,Current Edition."(second reading)Council member Stanton
moved to have the second reading in title only.Council member Mertz seconded to
motion.Council member Bailey asked for clarification on "benefits".Public Works
Director John Gibson stated that benefits are currently at a flat rate,but will be changed
after passage of this ordinance to a line item for each person.Roll call:Ayes:Stanton,
Mertz,Bailey,Gruber.Motion carried 4 -0 -1.Mr.Arentsen read the ordinance in title
only.

of the City of Waukee,Iowa,by adding the words:"A late payment charge of 1.5%
shall be added to the past due amount if the invoice is not paid in full within thirty (30)

(31)Ordinance:To amend Chapter 301.27,Waukee Municipal Code,Parking and
Loading Areas,Section 301.27 (C)(3),in Case of Any Building,Structure,or Premises,
by adding to said subsection the words:"shielded and ...and away from the traveled
roadway of public streets;"so that said section reads:"Any lighting used to illuminate
any off-street parking area,including any commercial parking lots,shall be shielded
and so arranged as to reflect the light away from adjoining premises in any "R"
District;and away from the traveled roadway of public streets."(second reading)
Council member Mertz moved to have the second reading in title only.Council member
Stanton seconded the motion.Council member Mertz amended his motion to include the
exemption of the C-2 Central Business District from the provisions of this ordinance.
Council member Stanton amended her second.Council member Bailey asked if the City
would contact the owner of Westwood Plaza to redirect or shield the lighting in the rear
of the building,as it can be seen from Highway 6.Mr.Arentsen stated that he would do
so.Council member Stanton informed the Council that the City was drafting an
ordinance that would address lighting on existing sites,and that the ordinance should be
before the Council soon.Roll call:Ayes:Mertz,Stanton,Bailey,Gruber.Nays:None.
Motion carried 4 -0 -1.Mr.Arentsen read the ordinance in title only.
(32)Ordinance:To amend Chapter 301.27,Waukee Municipal Code,Parking and
Loading Areas,Section 301.27(C)(2),In Case of Any Building,Structure,or Premises,
by deleting the said section and inserting in lieu thereof,"Any off-street parking area,
including any commercial parking lot shall be surfaced with an asphaltic or Portland
cement binder pavement or such other permanent impervious surface as shall be
approved by the City Council."(second reading)Council member Mertz moved to have
the second reading in title only.Mayor Pro Tem Gruber seconded the motion.Council
member Bailey asked if existing gravel driveways would be grandfathered in.City
Attorney Paul Huscher stated that would be the case;he also stated that the City is

considering requiring registration of non-conforming uses so that the claim of being
grandfathered in can be substantiated.Roll call:Ayes:Mertz,Gruber,Stanton.Nays:

(33)Ordinance:To amend Chapter 301.27,Waukee Municipal Code,Parking and
Loading Areas,Section 301.27(B)(6),Off Street Parking Area Required,by adding to
the "Multi-family dwelling -1 or 2 bedroom -Two (2)parking spaces,"the following:
"One (1)garage parking space may be counted as a parking space in fulfillment of the
parking requirements,provided there is 110 less than one (1)open parking space for
each one or two bedroom apartment and one (1)not reserved parking space for each
five one or two bedroom apartments."So that Section 301.27(B)(6)reads:"Dwellings
-(a)Single Family Dwelling -Two (2)parking spaces accessible to the street.(b)
Duplex Family Dwelling -Four (4)parking spaces accessible to the street.(c)Multi-
Family Dwelling -1 or 2 bedroom -Two (2)parking spaces per one or two bedroom
apartment.One (1)garage parking space may be counted as a parking space ill
fulfillment of the parking requirements,provided there is no less than one (1)open
parking space for each one or two bedroom apartment and one not reserved parking
space for each five one or two bedroom apartments."(third reading)Council member
Mertz moved to have the third reading in title only and place the ordinance on final
passage.Council member Stanton seconded the motion.Roll call:Ayes:Mertz,Stanton,
Bailey,Gruber.Nays:None.Motion carried 4 -0 -I.Mr.Arentsen read the ordinance
in title only.Mayor Oberman declared the ordinance passed and duly adopted.
