(2)Pledge of Allegiance (3)Roll Call-The following members were present:Tony Oberman,Mayor,and Council members Nicholas Gruber,Donald Bailey,Jr.,JeffV.Mertz,Bill Peard and Darlene Stanton. (4)Open Forum -Dennis Carroll,905 60th St.,West Des Moines,spoke to the Council conceming the inside lights of the Iowash Car Wash located at Legacy Point.Council indicated Mr.Carroll would need to remediate the lighting so as to diminish the spillage. (5)Agenda Approval-Mark Arentsen asked the council to remove Item D from the Consent Agenda.Jeff Mertz moved;Darlene Stanton second to approve the agenda as modified.Ayes:Mertz,Stanton,Bailey,Peard,Gruber.Nays:None.Motion carried 5- O. (8)Resolution:Approving Site Plan (Revised)for Williams Pointe Condominiums Darlene Stanton moved to approve the resolution.Jeff Mertz second.Planning Director Chad Weaver recommended approving the inclusion of garages along SE Brick Drive and SE University Avenue.Roll call:Ayes:Stanton,Mertz,Peard,Bailey,Gruber. (9)Public Hearing:On a proposal to enter into a l Z-month.lease agreement with Downing Development for the Storage of City-owned Equipment Mayor Oberman opened the public hearing.Mark Arentsen indicated the City had received no written comments prior to the meeting.No one present wished to address the council.Mayor Oberman closed the public hearing, (10)Resolution:Approving a l Z-month.lease agreement with Downing Development for the Storage of City-owned Equipment Nick Gruber moved to approve the resolution. (11)Public Hearing:On an amendment to Chapter 301,Waukee Municipal Code, Zoning Ordinance of the City of Waukee,Iowa,by re-zoning and changing certain property therein from A-I (Agricultural District)to C-4 (Office Park Commercial District);and amend the Official Zoning Map to show re-zoning (Richard Schwartz Property)Mayor Oberman opened the public hearing.Mark Arentsen indicated the City received a copy of the meeting minutes prepared by David Harrison of Design Alliance, Inc.The meeting held on October 26,2004,which included Michael Harris,Mr.and Mrs.Mark Owens,Amanda Fairchild,Richard Schwartz,Jerry Cobb,Kim Cobb,Dennis Ernst and David Harrison was convened to discuss the site plan for the funeral home 449.51 119.45 831.82 58.22 916.48 707.97 171.54 720.90 101.38 976.32 I 4 anticipated to be located on the eastern half of the Schwartz property.During the Council meeting Mike Adams,1455 Rosewood Court,Dr.Amanda Fairchild,1410 Rosewood Court,Michael Harris,1435 Rosewood Court,and Mark Christian,1400 Rosewood Court -all neighbors of the Schwartz property -and John Sieck,realtor associated with Williams Pointe spoke against re-zoning from Agricultural District to Office Park Connnercial District.The predominate concerns were with the devaluation of property and the close proximity to a funeral horne.Mr.Richard Schwartz of 648 56th St.,owner of the property explained the improvements made to the property,the attempts to sell the property as residential property and recently the possible sale of one half of the property to Dennis Ernst,funeral horne director.David Harrison,of Design Alliance,Inc. explained the site plan and assured horne owners that a buffering of pine trees on east, west and north sides would ensure privacy for the property owners.Dennis Ernst was present to discuss his intentions as possible future owner ofthe east half ofthe property. The council members appreciated the neighbors'sharing of concerns and thoughts on the re-zoning and encouraged the neighbors to participate in the next meeting.Mayor Oberman closed the public hearing. (12)Ordinance:To amend Chapter 301,Waukee Municipal Code,Zoning Ordinance of the City of Waukee,Iowa,by re-zoning and changing certain property therein from A-I (Agricultural District)to C-4 (Office Park Commercial District);and amend the Official Zoning Map to show re-zoning (Richard Schwartz Property)Jeff Mertz introduced the ordinance,Darlene Stanton moved to have the first reading in title only. Don Bailey second.Roll call:Ayes:Stanton,Bailey,Mertz,Gruber,Peard.Nays:None. Motion carried 5 -O.Mark Arentsen read the ordinance in title only. (13)Public Hearing:On an amendment to Chapter 301.13,Waukee Municipal Code, Zoning Ordinance of the City of Waukee,Iowa,"R-3"Multi-Family Residential District,by repealing Section 301.13,and substituting in lieu thereof Section 301.13 "R-3"(Rental Multi-Family Residential District),amending specifications and regulations for the R -3 District to allow for rental occupancy only;providing for the administration and enforcement thereof,providing for the repeal of all ordinances in conflict therewith;and amending the official zoning map to include said zoning district Mayor Oberman opened the public hearing.City Administrator Mark Arentsen indicated the City had not received any written comments prior to the hearing.No one present wanted to address the issue.Mayor Oberman closed the public hearing. (14)Ordinance:To amend Chapter 301.13,Waukee Municipal Code,Zoning Ordinance of the City of Waukee,Iowa,"R-3"Multi-Family Residential District,by repealing Section 301.13,and substituting in lieu thereof Section 301.13 "R-3"(Rental Multi-Family Residential District),amending specifications and regulations for the R- 3 District to allow for rental occupancy only;providing for the administration and enforcement thereof,providing for the repeal of all ordinances in conflict therewith; and amending the official zoning map to include said zoning district Nick Gruber introduced the ordinance.Darlene Stanton moved to have the first reading in title only. (15)Public Hearing:On an amendment to Chapter 301.13,Waukee Municipal Code, Zoning Ordinance of the City of Waukee,Iowa,to establish a zoning district to be 5 known as "R-3A"(Owner Occupied Multi-Family Residential District),providing for the administration and enforcement thereof,providing for the repeal of all ordinances in conflict therewith;and amending the official zoning map to include said zoning district Mayor Oberman opened the public hearing.City Administrator Mark Arentsen indicated the City had not received any comments in writing prior to the hearing.No one present wished to addres the council on the issue.Mayor Oberman closed the public hearing. (16)Ordinance:On an amendment to Chapter 301.13,Waukee Municipal Code, Zoning Ordinance of the City of Waukee,Iowa,to establish a zoning district to be known as "R-3A"(Owner Occupied Multi-Family Residential District),providing for the administration and enforcement thereof,providing for the repeal of all ordinances in conflict therewith;and amending the official zoning map to include said zoning district Darlene Stanton introduced the ordinance.Jeff Mertz moved to have the first reading in title only.Nick Gruber second.Roll call:Ayes:Mertz,Gruber,Stanton, Peard,Bailey.Nays:None.Motion carried 5 -O. (17)Ordinance:To amend Chapter 106,Waukee Municipal Code,Posting Places,by deleting Chapter 106 and inserting in lieu thereof a revised Chapter 106 for the purpose of updating places for public posting of agendas or other public notices, required or permitted to be posted by law;and providing for a penalty for unlawful removal of such notices (second reading)Nick Gruber moved to have the second reading in title only,waive the third reading and place this ordinance on its fmal passage. Darlene Stanton seconded the motion.Roll call:Ayes:Gruber,Stanton,Mertz,Bailey, Peard,Nays:None.Motion carried 5 -O.Mark Arentsen read the ordinance in title only.Mayor Oberman declared this ordinance passed and duly adopted.
