NOVEMBER 22,2004
(1)Call to Order -The special meeting of the Waukee City Council was called to order
by Mayor Oberman at 6:30PM.
(2)Roll Call-The following members were present:Tony Oberman,Mayor,and
Council members Nicholas Gruber,Donald Bailey,Jr.,JeffV.Mertz and Darlene
Stanton.Bill Peard present at 6:34PM.
(3)Agenda Approval-No changes.Darlene Stanton moved;Nick Gruber second to
approve the agenda as written.Ayes:All.Nays:None.Motion carried 5-0.
(4)Resolution:Approving Site Plan for Warrior Plaza,Plat 3 Don Bailey,Jr.moved to
approve the Site Plan.JeffV.Mertz second.Rob Meyers,Land Development Services,
Warren Phifer,VP,Regency Commercial Services and Ed Arp,Civil Engineering
Consultants were present to discuss the proj ect.There was discussion concerning the
mansard roofline wrapping around the east end,screening of the HVAC units on the roof
or full length screening across the back,one color for all screenings,snow load on
Fareway building,design tie-in with existing Phases 1 and 2 and continuation of
landscaping to screen back of building.From the discussion three requirements to
approval of the site plan were identified.Council member Bailey moved to amend his
motion to include:(1)continuation ofroofline on the east side of the Phase 3 building;
(2)ganging of the HVAC units and one color for all HVAC screening;and (3)reviewing
potential snow loading on Fareway building and correcting,if necessary.Council
member Mertz hesitated in seconding the amended motion because council tends to
approve building plans,whether preliminary plat,site plan,final plat,contingent on
certain requirements rather than approving a project that is complete without additional
requirements.Thereafter,Council member Mertz did second the amended motion.Roll
call:Ayes:Bailey,Mertz,Peard,Gruber,Stanton.Nays:None.Motion carried 5 -O.
(5)Resolution:Approving Site Plan for Iowa Methodist Medical Clinic JeffV.Mertz
moved to approve the resolution.Don Bailey,Jr.second.Marty Barkley of Simonson
and Associates and Ward Phifer of Regency Commercial Services discussed the most
recent design proposal of the Methodist Medical Clinic.Mr.Barkley indicated that the
buildings in Johnston and Waukee would be different in number of physicians and size of
building but similar architecturally.Mr.Phifer committed the developer to complete the
sidewalk along Warrior Lane from Highway 6 to Laurel Street.Council in its October
22,2004 meeting approved a motion that required in the design of the Clinic (1)a curved
front;(2)a pitched roof;(3)an entry feature including the pitched roof;(4)and revised
south elevation showing more relief and darker brick.The latest design presented at this
meeting did not include a pitched roof and included a different entry from the one
approved at the October 22 meeting.A majority ofthe council preferred the design of
the clinic building approved at the October 22 meeting.Roll call:Ayes:Mertz,Bailey.
Nays:Gruber,Stanton,Peard.Motion defeated 2 -3.

(6)Resolution:Approving Final Plat/or Parkview Crossing,Plat 6 Jeff Mertz moved
to approve the resolution.Bill Peard second.City Attorney Paul Huscher asked whether
a cash bond had been posted.Public Works Director J ohn Gibson indicated it had not yet
been posted.Mr.Gibson explained the project and stated that seeding,which was not
included previously,would increase the cash bond from $25,000 to $97,625.Mr.Gibson
has discussed with the developer and proposed a $25,000 cash bond and a $72,625 surety
bond.Rick Ross,representing Jerry's Home,stated the seeding would have been
completed,if concrete flume had been completed.Mr.Ross requested the council
approve a $100,000 performance bond instead of the $25,000 cash bond and $72,625
performance bond.Roll call:Ayes:Mertz,Peard,Bailey,Stanton,Gruber.Nays:None.
Motion carried 5 -0.The Council voted to approve the final plat contingent on receiving
a $25,000 cash bond and a $72,625 surety bond.

(7)Discussion:Bus Tour of Waukee to review the luminous intensity of various light
fixtures The bus tour consisted of (I)reviewing the amount of reflection from an asphalt
street vs.a concrete street and the overall luminosity in the older part of town vs.the
newer part;(2)the car wash on Hickman where one glass panel was darkened to lower
the intensity of the colored light fixtures;(3)the Hickman at Warrior Casey's where
recessed canopy lighting is used vs.the University at Boone Drive Casey's where the
lighting fixtures are mounted below the ceiling of the canopy.
After the bus tour,Mayor Oberman asked for a motion to adjourn.Jeff Mertz moved.
Darlene Stanton second.Ayes:All.Nays:None.Motion carried 5-0.
Meeting Adjourned at 9:10PM.
