(2)Pledge of Allegiance (3)Roll Call-The following members were present:Council members Nicholas Gruber, JeffV.Mertz and Darlene Stanton.Mayor Tony Oberman and Council members Don Bailey,Jr.and Bill Peard were absent. Council member Peard present shortly after Roll Call. (4)Open Forum -No one present wished to address the Council on an issue not on the agenda. (5)Agenda Approval-Jeff Mertz stated that Item #15 was removed from the agenda and that Item 6M would be considered separately from the consent agenda.Jeff Mertz moved;Darlene Stanton second to approve the agenda as modified.Roll call:Ayes: Mertz,Stanton,Gruber,Peard.Nays:None.Absent:Bailey.Motion carried 4 -0 -1. Motion carried 4 -0 -1. 6M.Resolution:Approving Proposal of CH2M Hill to complete a National Environmental Policy Act Environmental Impact and Pre-location Study for the Alice's Road &1-80 Interchange I I Jeff Mertz moved to approve the resolution.Darlene Stanton second.Jody Gunderson, Community Development said that the number of hours needed to complete the project by CH2M Hill had been reduced resulting in a decrease in the estimated maximum of the bid by $6,331 for a new total of $105,703.Mr.John Halzworth ofCH2M Hill was present to answer any questions.Roll call:Ayes:Mertz,Stanton,Gruber,Peard.Nays: None.Absent:Bailey.Motion carried 4 -0 -1. Mayor Pro Tern visited earlier with Police Chief Phillips who stated as of 12/20104,60 families including 107 children were served by the Waukee Christmas Drive. 8 (8)Mayor's Appointment:Appointing Isaiah McGee to the Library Board of Trustees to jill a vacancy created by the change in residency of board member Chris Berry Mayor Pro Tern Gruber announced the appointment. (9)Resolution:Approving the appointment of Isaiah McGee to the Library Board of Trustees to jill a vacancy created by the change in residency of board member Chris Berry Darlene Stanton moved to approve the appointment ofIsaiah McGee to the Library Board.Jeff Mertz second.Roll call:Ayes:Stanton,Mertz,Peard,Gruber. Nays:None.Absent:Bailey.Motion carried 4 -0 -l. (10)Mayor's Appointment:Appointing the primary and alternate member for the Des Moines Area Metropolitan Planning Organization and the primary and alternate member for the Des Moines Area MPO's Transportation and Technical Committee Mayor Pro Tern Gruber announced the appointment of Bill Peard as the MPO Primary Representative with Alternates being Mayor Tony Oberman and City Administrator Mark Arentsen and announced the appointment of Jody T.Gunderson to the MPO TTC Primary Representative position and Chad Weaver as the alternate to this position. (11)Resolution:Approving the appointment of the primary and alternate member for the Des Moines Area Metropolitan Planning Organization and the primary and alternate member for the Des Moines Area MPO's Transportation and Technical Committee Darlene Stanton moved to approve the MPO appointments.Jeff Mertz second.Roll call:Ayes:Stanton,Mertz,Peard,Gruber.Nays:None,Absent:Bailey. (12)Proclamation:Recognizing the Accomplishments of Dr.Veronica Stalker during her tenure as Superintendent of the Waukee Community School District Mayor Pro Tern Gruber read the proclamation recognizing Dr.Veronica Stalker for her accomplislnnents in the City of Waukee while superintendent of the Waukee Community School District.Mayor Pro Tern Gruber presented a framed proclamation to Dr.Stalker. (13)Resolution:Approving the independent auditor's reportfor jiscalyear ending June 30,2004 Jay Hom and Dave Ellis of Denman &Company,LLP,Certified Public Accountants &Business Consultants,were present to review with the Council,The Independent Auditor's Report for FY2004.The City of Waukee is substantially in compliance with Government Auditing Standards,issued by the Comptroller General of the United States.Jeff Mertz moved to approve Denman &Company's Final Report. Darlene Stanton second.Council member Mertz asked Mark Arentsen to report to the Council on how recommendations in the audit report would be addressed.Roll call: Ayes:Mertz,Stanton,Peard,Gruber.Nays:None.Absent:Bailey.Motion carried 4 ~0 -l. (14)Presentation:This item removed from the agenda prior to the meeting. (15)Discnssion:Planning &Zoning Recommendation for Zoning Options for property located at 1450 SE University Ave.(Schwartz Property)This item removed from the agenda and postponed until the first meeting in January 2005. (16)Presentation:Results of the Waukee Park &Recreation Survey Kathleen Larson and Oleg Stakhanov of the Iowa State University Extension were present to discuss tile findings of tile Parle and Recreation Survey completed earlier this year.A random sample of793 adults and 286 youth received surveys.50%of the adults and 40%of the youth returned the surveys.Half of all respondents were people under 45 years old,with children under 18 years and who had lived in Waukee for less than 5 1 I 9 years.The report indicated a high satisfaction with current recreational facilities and activities;but,at the same time a low rate of some facilities'and particularly programs' use was noted.The Outdoor Aquatic Center is a high priority for recreational facilities. In addition about half of all Waukee respondents under 44 years,have children and have lived in the city less than 5 years.These individuals (1)tend to give lower rating to existing recreational opportunities;(2)use current facilities the most;and (3)express the greatest support for new facilities and pro grams,The Recreational Director for the City of Waukee was hired by the City after this survey was completed.Many of the changes he has made have benefited the Waukee programs.Council member Peard suggested that this survey established the base line independent of staff,boards,council members or committees and that it would be interesting to repeat the survey every few years to determine our progress.Public Works Director Gibson stressed the survey was a snapshot where the program was prior to hiring the first full time Recreational Director. (17)Resolution:Approving Settlement Agreement with Gilcrest/Jewett Lumber Co. Darlene Stanton moved to approve.Bill Peard second.Dan Manning of Connolly Law Finn,317 6th Avenue,Suite 300,Des Moines,present to represent Gilcrest/Jewett Lumber Co.introduced the Settlement Agreement.Council member Stanton had requested a change which disallowed the penalty for completion not occurring prior to 12-31-05 when the cause of the delay was due to certain natural calamities such as an early winter or rainy summer or fall.Council member Stanton included this in her motion.Council member Peard agreed to second the changed motion.Roll call:Ayes: Stanton,Peard,Mertz,Gruber.Nays:None.Absent:Bailey.Motion carried 4 -0 -1. (18)Resolution:Approving Site Plan (Revised)for Gilcrest/Jewett Lumber Co.Bill Peard moved to approve.Jeff Mertz second.Council member Stanton mentioned using shielded lights and the City's desire to curtail dispersed lighting.Ms.Stanton suggested incorporating a 15 year plan into the Site Plan whereby approval of the Site Plan would also include an agreement by Gilcrest/Jewett Lumber Co.to upgrade its lighting to include some ways of shielding neighbors and drivers from lighting glare during the next 15 years.Attorney Manning indicated that he and his client could not make a fifteen year commitment this evening;however,he also said that "when and if we expand our site or anything along those lines that we will have to live with the ordinances that are in place at the time that we come to you and ask for the site plan to be amended."Council member Stanton agreed that if Gilcrest/Jewett "came through with any new site plans or changes that would be the time we could address the current ordinances."Roll call: Ayes:Peard,Mertz,Stanton,Gruber.Nays:None.Absent:Bailey.Motion carried 4 -0 -1. (29)Discnssion:City's position on the League of City's /Iowa State Association of Counties Property Tax Reform Proposal Council members discussed this topic briefly. It was suggested that Council have a workshop session to discuss the Tax Reform Proposal.That meeting was scheduled for January 10,2005.Council member Peard also suggested that Council members be prepared to attend some of the state government sessions so to be present to discuss the tax reform proposal with representatives and senators.All Council members felt that tax reform must occur.Mr.Peard also recommended having a televised question and answer with Representative Watts and Senator Behn concerning tax reform. (30)Discussion:Potential City Parkland Purchases This item was briefly discussed by Marle Arentsen.Both the Park Board and the Planning &Zoning Commission have discussed the possibility of acquiring park land in the southern part of Waukee and that the land be used for active as well as passive recreation.After further discussion,it was suggested by Mr.Arentsen that the City Council go into closed session January 3,2005 at 6:OOPM prior to the Council meeting starting at 7:OOPM. (31)Discussion:Design Standards for the construction of townhomes Director of Planning Chad Weaver presented design standards for the construction of townhomes to the Council.This item had been discussed during a P &Z meeting.The Council members were generally in favor of these standards and commended Mr.Weaver and P&Z for their efforts over the past several months.It was recommended by Mr.Weaver and informally approved by the council members to remove the items underlined in the proposed Design Standards for Townhomes.Those changes were to remove the following: 12 4c(i)"Use to Define Neighbords.In large multi-family projects over 100 units, subtle variations in color and materials shall be used where practicable to define neighborhoods."(removed in its entirety) 4c(ii)(a)"...The balance of net exterior wall area may be lap siding andlor stucco."(the underlined shall be removed) 6b(ii)Articulation of Rear Walls (a)Rear walls of detached garages and carports that back onto the perimeter street shall be articulated through the use of one or more of the following elements:(1)Windows;(2)A trellis;or (3)a variety of roof planes.(removed in its entirety)This item will be presented to the Developer's Roundtable and then to P&Z before returning to council.
