JANUARY 17,2004 I
(1)Call to Order -The regular meeting of the Waukee City Council was called to order
by Mayor Pro Tem Jeff Mertz at 7:00 PM.
(2)Pledge of Allegiance
(3)Roll Call-The following members were present:Council members Nicholas Gruber,
Donald Bailey,Jr.,JeffV.Mertz and Darlene Stanton.Mayor Tony Oberman and
Council member Bill Peard were absent.
(4)Open Forum -No one present wished to address an issue not on the agenda.
(5)Agenda Approval-Mayor Pro Tern Mertz requested item 21 be brought forward to
6b.Darlene Stanton moved to approve the agenda with that change.Nick Gruber
seconded the motion.Roll call:Ayes:Stanton,Gruber,Bailey,Mertz,Nays:None.
Absent:Peard.Motion carried 4 -0 -I.

E.Motion:Setting February 7,2005 as the date of a public hearing on an amendment to
Chapter 301,Waukee Municipal Code,Zoning Ordinance of the City of Waukee,
Iowa,by re-zoning certain properties along 6'h Street,North ofthe Downtown
District,from C-1(Community and Highway Service Commercial District)to R-2
(One and Two Family Residential District);and amend the Official Zoning Map to
show rezoning
F.Approving Payment Estimate No,1 to Peterson Contractors,Inc.for the Southfork
Culvert Extension in the amount of$31,218.90
Mayor Pro Tern Mertz requested the approval of the consent agenda include a change in
6E so that the date of the public hearing will be February 14 and not February 7.Darlene
Stanton moved to approve the consent agenda as modified.Don Bailey,Jr.seconded the

(6b)Receive/File:Waukee Public Library Annual Report FY2004 presented by Library
Director Linda Mack and Library Board member Becky Johnson Library Board
member Becky Johnson presented portions of the Annual Report to the Council.All
Council members appreciate the efforts,loyalty,creativity and perseverance of the library
staff who have adjusted to an increased (1)number of patrons,(2)usage of material and
(3)participation in activities since moving into the building on Warrior Lane.Council
member Bailey asked for a report on the Library's finances and goals for the coming
year.Nick Gruber moved to receive and file the Public Library Annual Report,Darlene
Stanton second.Roll call:Ayes:Gruber,Stanton,Bailey,Mertz.Nays:None.Absent:
Peard.Motion carried 4 -0 -1.

(7)Mayor's Report:Mayor Pro Tem Mertz congratulated the Fire Department for
receiving a $56,000 grant from FEMA.Funds from this grant will be used to complete
the Protective Clothing Replacement Program,do some OSHA approved fire fighter's
physicals and purchase of some exercise equipment for physical strength improvements.
(8)Presentation:Recognizing those individuals who are not continuing as citizen
members of the various boards,commissions,and committees and who have provided
service to staff and to the Citizens of Waukee Mayor Pro Tem Mertz presented framed
Certificates of Appreciation to Mel Willets and Mary White both of whom served on the
Planning &Zoning Commission,Marge Schlaefer who served on the Utilities Committee
and Tom Tovrea who served on the Parks and Recreation Board.Rene-Herr and Mike
Bailey were not present to receive a certificate for service on the Parks and Recreation
Board.All of the Council members expressed their appreciation for the efforts in time
and energy that each volunteer gave to the City as members of the various committees.
(9)Resolution:Approving Final Platfor Re-plat of Legacy Pointe Plat 1,Lot 19
Darlene Stanton moved to approve the Final Plat.Nick Gruber second.Roll call:Ayes:
Stanton,Gruber,Mertz,Bailey.Nays:None.Absent:Peard.Motion carried 4 -0 -1.
(10)Resolution:Approving the Willowbrook Plat 4 Construction Plans Darlene
Stanton moved to approve this resolution.Don Bailey,Jr.second.Brief discussion.Roll
call:Ayes:Stanton,Bailey,Mertz,Gruber.Nays:None.Absent:Bill Peard.Motion
carried 4 -0 -1.
(11)Resolution:Authorizing city staff to negotiate with the Wastewater Reclamation
Authority (WRA)for City of Waukee membership in the WRA and authorizing a
payment of $40,660 to initiate negotiations Nick Gruber moved to approve this
resolution.Darlene Stanton second.Council member Bailey stated he felt this item
should go before the Utilities Committee prior to approval for payment.Mr.Bailey
thought the Committee should have the opportunity to vote on it;however,the time
frame for review of the request by the Council,the date of the next Utilities Committee
meeting (January 18,2005)and the deadline for responding to the WRA would not
permit more than discussion.Dim Bailey,Jr.moved to postpone consideration of this
resolution until the January 24,2005 meeting.Darlene Stanton second.'Roll call:Ayes:

(12)Public Hearing:On the Sale of the Library Building located at 500 6'"Street
Mayor Pro Tern J effMertz opened the public hearing.Written proposals were received
from Jerry D.Armstrong ($200,000.00);Barry and Constance Nelson ($135,000.00);
Illumina,L.L.C.($75,000.00);and Frank Koss ($10,001.99).Council discussed the
proposals and determined that further discussion would be necessary before a proposal
was accepted or all proposals were rejected.City Attorney Paul Huscher indicated the
Notice of Public Hearing was a solicitation of proposals,which stated in effect that the
"City was interested in selling the property;if you're interested in buying it,tell us upon
what basis you'd like to try to buy it."Mr.Huscher stated the proposal process was not
an agreement whereby the City would sell the property on the basis of a bid;but on the
basis that met the City's needs and requirements including a bid price.The City has the
right to accept a proposal as written,reject all proposals and negotiate with anybody in
the future about a proposal.The Notice of Public Hearing states the City of Waukee
reserves the "right to reject all proposals,accept one of the proposals or enter into a
development agreement with one of the submitters."Other participants in the public

hearing were:(1)Denny Do1mage,3273 Ashworth Road,requested a definition of
"stipulations"as used by Council member Bailey.Mr.Bailey responded by saying the
stipulation was not one "of use or what would happen to the project."(2)Becky Johnson,
320 Parkview Drive,member of the Public Library Board of Trustees,suggested to the
City that the sale of the old public library should in some way benefit the new public
library,if in no other way than to permit the Foundation members to participate in the
negotiations for acceptance of the proposals to ensure receiving the highest possible
amonnt for the property to help repay the debt the Library Foundation owes the City.(3)
Barry Nelson,13947 Oale Brook Drive,Urbandale,one of the proposal submitters,
notified the Council that he had secured a pre-approved construction loan that expires
January 25,2005 and would like to know the timeframe in which a decision might be
made.Several Conncil members responded by saying that a decision would hopefully be
reached within the next week or two.No specific timeframe was mentioned.No other
individuals present wished to address the Conncil.Mayor Pro Tem Mertz closed the
public hearing.
(13)Resolution:Approving the Sale of the Library Building located at 500 6/11 Street
Council member Nick Gruber moved to postpone this item to the next Council meeting.
Darlene Stanton second.(The next Council meeting will be a special meeting on January
24,2005.)Roll call:Ayes:Gruber,Stanton,Bailey,Mertz.Nays:None.Absent:Bill
Peard.Motion carried 4 -0 -1.

opened the public hearing.No written comments were received prior to the hearing.No
one present wished to address the council on this issue.Mayor Pro Tem Mertz closed the
public hearing.

(Multi-Family Residential District)and R-4 (Row Dwelling and Townhome Dwelling
District)to R-2 (One and Two Family Residential)and R-4 (Row Dwelling and
Townhome Dwelling District)(Willow Brook Plats 1 and 2)(intro and first reading)
Nick Gruber introduced the ordinance.Don Bailey,Jr.moved to have the first reading in
title only.Darlene Stanton second.Roll call:Ayes:Bailey,Stanton,Gruber,Mertz.
Nayes:None.Absent:Peard.Motion carried 4 -0 -1.Mark Arentsen read the
ordinance in title only.
(16)Ordinance:Item removed from the agenda.
(17)Ordinance:To amend Chapter 200,Waukee Municipal Code,Civil Ordinances,
Section 218,by incorporating the 2004 City of Waukee Sidewalk Program for the
purpose of clarifying and improving the requirements of abutting property owners to
maintain sidewalk and parking and to construct new sidewalks where required;and by
renumbering each successive section in said Chapter in numerical order (intro and
first reading)Darlene Stanton introduced the ordinance.Nick Gruber moved to have the
first reading in title only.Darlene Stanton second.Council member Bailey questioned
how the City would provide assistance to low income individuals or families to help with

the cost of sidewalk maintenance or construction.He stated withont that information he
conld not support the ordinance.Roll call:Ayes:Gruber,Stanton,Mertz.Nays:Bailey.
Absent:Peard.Motion carried 3 -I -1.Mark Arentsen read the ordinance in title only.
(18)Ordinance:To establish a Connection Fee District and Feesfor connection of
property in said district to the R22 Sewer District to recover the equitable portion of the
costs thereof (intro and first reading)Nick Gruber introduced the ordinance.Darlene
Stanton moved to have the first reading in title only.Jeff Mertz second.Roll call:Ayes:
Stanton,Mertz,Bailey,Gruber.Nays:None.Motion carried 4 -0 -1.Mark Arentsen
read the ordinance in title only.
(19)Ordinance:To establish a Connection Fee District and Fees for connection of
property in said district to the Hickman Sewer District 2001 to recover the equitable
portion of the costs thereof (second reading)Darlene Stanton moved to have the second
reading in title only.Jeff Mertz second.Roll call:Ayes:Stanton,Mertz,Gruber,Bailey.
Nays:None.Absent:Peard.Motion carried 4 -0 -1.Mark Arentsen read the
ordinance in title only.
(20)Motion:Setting 2/14,2/28,3/14 and 3/28 for February and March regular City
Council meetings Darlene Stanton moved to approve these dates for the regular
meetings during February and March.Jeff Mertz second.Roll call:Ayes:Stanton,
Mertz,Bailey,Gruber.Nays:None.Absent:Bill Peard.Motion carried 4 -0 -1.
(21)Receive/File:Waukee Public Library Annual Report FY2004 presented by Library
Director Linda Mack and Library Board Member Becky Johnson This item was
moved to Item 61.
(22)Resolution:Endorsing the actions of the Dallas County Board of Supervisors in
restricting the availability of products containing a combination of pseudoephedrine
and other ingredients needed in the manufacture of methamphetamine,an illegal drug
in the State of Iowa Don Bailey,Jr.moved to approve this resolution.Darlene Stanton
second.Council members Bailey,Mertz and Gruber spoke in support of the Dallas
County Board of Supervisors effort to limit availability of ingredients used in the
manufacture of methamphetamine.Roll call:Ayes:Bailey,Stanton,Mertz,Gruber.
Nays:None.Absent:Bill Peard.Motion carried 4 -0 -1.
