(1)Call to Order -The regular meeting ofthe Waukee City Council was called to order
by Mayor Oberman at 7:00 PM.
(2)Pledge of Allegiance
(3)Roll Call-The following members were present:Tony Oberman,Mayor,and
Council members Nicholas Gruber,Donald Bailey,Jr.,JeffV.Mertz,Bill Peard and
Darlene Stanton.
(4)Open Forum -No one present wished to address the council on an issue not
on the agenda.
(5)Agenda Approval-Council member Darlene Stanton requested a discussion ofthe
Developers'Roundtable be added to the agenda.The item was added as 25b.Darlene
Stanton moved approval of the agenda as modified.Don Bailey,Jr.seconded the motion.

H.Motion:Setting February 28,2005 as the date of a public hearing on an amendment
to Section 301.31,Waukee Municipal Code,Zoning Ordinance of the City of
Waukee,Iowa,Schedule of Fees,by deleting from the line commencing with the
words,"Construction Inspection,"the words,"$50.00/hour,and inserting in lieu
thereof the words,"$60.00/hour,so that the hourly rate for construction inspection is
$60.00 per hour.
I.Motion:Setting March 14,2005 as the date for a public hearing on a voluntary
annexation of property and providing a transition for the imposition of taxes

(7)Mayor's Report:attended (1)the Freight Round Table meeting,a subcommittee of
the MPO,which was convened to analyze transportation distribution system of freight in
the metro area;(2)the Pre-view party for the Iowa Health Clinic to be built at the SE
comer of Warrior Lane and Hickman Rd.;(3)a meeting with Waukee Chamber president
Jolm Aunen and Chamber of Commerce Director Nancy Shirk;(4)the Developers'
Roundtable meeting;(5)the Dallas County Mayors'Meeting;(6)the Dallas County
Conference Board Committee.Upcoming schedule:Ribbon cntting for Shottenlcirk
Auto;Employee Benefits Sub Committee for Waukee meeting on Thursday;meeting
with representatives of the school district.
(8)Receive/File:Greater Dallas County Development Alliance (GDCDA)Linda
Schaut,Executive Director of the GDCDA,presented the annual report for the
organization.A report of the Economic Development Activity for Dallas County and
Waukee in which the Alliance participated during the past year and during the past fiscal
year was submitted.A compiled report of a survey submitted to eight companies who
located in the City of Waukee ranked the City above a 4 point on a 1 to 5 point scale in
nine out of twelve categories.A motion to receive/file the report was moved by council
member Nick Gruber and seconded by J effMertz.Roll call:Ayes:Gruber,Mertz,Peard,
Stanton,Bailey.Nays:None.Motion carried 5 -O.
(9)Resolution:Approving one year lease at $11.50 per square foot with Home Instead
Senior Care for office space at 234 Highway 6 Darlene Stanton moved to approve the
resolution.Bill Peard second.Brief Discussion.Roll call:Ayes:Stanton,Peard,Bailey,
Mertz,Gruber.Nays:None.Motion carried 5 -O.
(10)Resolution:Approving Construction of a temporary Water Main Extension for the
Mining Camp community Jeff Mertz moved to approve.Nick Gruber second.The
Council briefly discussed the history of Mining Camp,which now includes 17 homes,the
history of the city's distribution of water along NE Alice's Road and plans for this water
main extension.Roll call:Ayes:Mertz,Gruber,Bailey,Peard,Stanton.Nays:None.
Motion carried 5 -O.
(11)Resolution:Approving the detailed plans,specifications,Notice of Hearing,
Notice to Bidders and Form of Contract for the R-22 Water Main Improvements and
setting March 8,2005 at 2:00PM as the date and time for Receipt of Bids therefore and
March 14,2005 as the date for a Public Hearing thereon Don Bailey,JI.moved to
approve this resolution.Darlene Stanton second.No discussion.Roll call:Ayes:Bailey,
Stanton,Gruber,Peard,Mertz.Nays:None.Motion carried 5 -O.
(12)Resolution:Approving Final Plat for Parkview Crossing Plat 7 Nick Gruber
moved to approve;Jeff Mertz second.All documents completed.Legals reviewed and
approved by attorney Huscher.Roll call:Ayes:Gruber,Mertz,Bailey,Peard,Stanton.
Nays:None.Motion carried 5 -O.
(13)Public Hearing:On a Golf Course Revenue Loan Agreement in the Principal
Amount of $950,000 Mayor Oberman declared the public hearing open.Mark Arentsen
indicated the City had not received any written comments prior to the hearing.Council

member Bailey,Jr.asked several questions and did not speak in favor of this issue.Jon
Burmeister,Managing Director of Public Financial Management explained the borrowing
of$925,000 (instead ofthe $950,000)and the method of paying the loan.The Charter
Banle ofWauleee and the Waukee State Bank have joined efforts to provide the City with
a revenue loan agreement in the amount of $925,000.Council members Mertz,Stanton,
and Gruber spoke in favor ofthe proposed golf course purchase.Mayor Oberman closed
the public hearing.
(14)Resolution:Authorizing Loan Agreement and providing for issuance of Golf
Course Revenue Note Nick Gruber moved to approve the resolution.Jeff Mertz second.
Mayor Oberman spoke briefly in favor of the purchase of the golf course.Roll call:
Ayes:Gruber,Mertz,Stanton.Nays:Bailey,Peard.Motion carried 3 -2.
(15)Public Hearing:On a General Obligation Golf Course Loan Agreement in the
Principal Amount of $700,000 Mayor Oberman declared the public hearing open.Mark
Arentsen indicated the City had not received any written comments prior to the hearing.
Council member Bailey asked several questions concerning repayment of this loan.Mr.
Arentsen stated the tax levy was the source of funds to pay the loan.No other comments
were entered on the record by members of the audience or the council.Mayor Oberman
declared the public hearing closed.
(16)Resolution:Authorizing Loan Agreement and providing for issuance of General
Obligation Golf Course Note,and providing for levy of taxes Darlene Stanton moved to
approve the resolution.Jeff Mertz second.Roll call:Ayes:Stanton,Mertz,Peard,
Gruber,Nays:Bailey.Motion carried 4 -l.
(17)Public Hearing:On an ordinance to amend Chapter 301,properties along 611•
Street,North of the Downtown District.from C-1(Community and Highway Service
Commercial District)to R-2 (One and Two Family Residential District);and amend the
Official Zoning Map to show re-zoning Mayor Oberman opened the public hearing.
Mark Arentsen indicated that the City received a letter from the Waukee Triangle
Business Group,dated 02-11-04,opposing the change in zoning.The downtown business
district has for many years been supportive of business growth along 6th Street going
from downtown to the north.This would extend commercial from downtown north on
sixth street to Hickman.Larry Crannell of Charter Banle,as a representative of the
Waukee Triangle Business Group,spoke against the change in zoning.Council members
Gruber and Bailey,who knew the reason for the change in zoning from residential to
commercial,stated that the growth in downtown north along 6th street has not
materialized.Both council members were in favor of changing the commercial zoning
back to residential to accommodate the needs of those currently residing in the area.
Council member Peard and Stanton spoke in favor of changing the zoning.This change
does not effect the Comprehensive Plan.Mayor Oberman declared the public hearing
closed.
(18)Ordinauce:To amend Chapter 301,properties along 6th Street,North of the
Downtown District,from C-1 (Community and Highway Service Commercial District)
to R-l (One and Two Family Residential District);and amend the Official Zoning Map
to show re-zoning Jeff Mertz introduced the ordinance.Don Bailey,Jr.moved to have
the first reading in title only.Darlene Stanton second.No discussion.Roll call:Ayes:
Bailey,Stanton,Mertz,Peard,Gruber.Nays:None.Motion carried 5 -O.Mark J.
Arentsen read the ordinance in title only.

(19)Ordinance:To amend Section 303.140,Waukee Municipal Code,Subdivision
Regulations Ordinance of the City of Waukee,Iowa,to provide that subdividers shall
be responsible for payment of all costs of installing the natural gas system within all
new subdivisions by deleting Section 303.140,and inserting in lieu thereof,"The
subdivider shall be responsible for the payment of all costs of installing the natural gas
system within all new subdivisions.The necessary piping and appurtenances shall be
installed by the City and all costs,including costs of yardage and material handling,
engineering,inspection,administrative fees,and all other fees above and beyond the
normal construction shall be billed to and paid by the subdivider."(intro and first
reading)Don Bailey,Jr.introduced the ordinance.Nick Gruber moved to have the first
reading in title only,waive the second and third reading and place this ordinance on its
final passage.Jeff Mertz second.Roll call:Ayes:Gruber,Mertz,Bailey,Stanton,Peard.
Nays:None.Motion carried 5 -O.Mark Arentsen read the ordinance in title only.
Mayor Oberman declared the ordinance passed and duly adopted.
(20)Ordinance:To amend Chapter 213A of the Municipal Code of the City of
Waukee,Providing for the Assessing of Fees or Charges for the Collection,Processing
and Marketing of Solid Waste and Recyclable Materials within the city limits of the
City of Waukee,Iowa,is amended as to Sections 213A.3(A)and 213A.3(B)to include
Collection of Yard Waste from April 1 through November 30 each year,and to increase
collection charges for single family residences and for a dwelling of two (2)or three (3)
units.from $12.39 to $13.83;to provide that each mobile home in a mobile home park
shall be treated as a single family dwelling;and further amended as to Section
213A.3(C)to delete any provision for mobile homes in mobile home parks in said
subsection.(intro and first reading)Nick Gruber introduced the ordinance.Darlene
Stanton moved to have the first reading in title only.Jeff Mertz second.City Attorney
Paul Huscher indicated that sub-paragraph E had not been included in the title of the
ordinance and requested an amendment to include it.Nick Gruber moved to approve the
amendment.Darlene Stanton second.Council member Bailey commended Waste
Management for the excellent service extended to the residents of Waukee.Council
member Peard agreed and stated that Waste Management has increased its level of
service through the years.Some of the proposed fee increase in this ordinance will free
City residents from the necessity of purchasing red (orange)stickers to place on yard
wastes.Yard wastes must still be placed in bio-degradable bags or in a trash container,
which does not exceed 30 gallon capacity.(Plastic garbage bags are not to be used for
yard wastes.)Ifthe ordinance passes,those individuals who have red (orange)stickers at
home may redeem them for the purchase price at City Hall,230 Highway 6.Roll call on
the amendment to the title:Ayes:Gruber,Stanton,Bailey,Peard,Mertz,Nays:None.

(21)Ordinance:To amend Chapter 301,Waukee Municipal Code,Zoning Ordinance
of the City of Waukee,Iowa,by re-zoning certain property therein from R-3 (Multi-
Family Residential District)and R-4 (Row Dwelling and Townhome Dwelling District)
to R-2 (One and Two Family Residential)and R-4 (Row Dwelling and Townhome
Dwelling District)(Willow Brook Plats 1 and 2)(second reading)Jeff Mertz moved to

(25)Discussion:City Policy regarding re-submittals of approved site plans This item
presented at the request of the Planning &Zoning Commission so that Council would
assist in defining when,where and at what level ofre-design it is necessary to re-submit
approved site plans for approval.Council members Stanton and Gruber both suggested
that a major re-design should return to the beginning of the Site Plan Approval with
payment of fees for consideration of site plan,Planning &Zoning approval and then
Council approval.Most of the council members agreed.A resolution stating the
council's support ofthis change wiII be on the 02-28-05 agenda.
(25b)Discussion:Developers'Roundtable Council member Stanton brought before the
council a concern that the Developers'Roundtable was stepping beyond the original
purpose of discussing and proposing to Council new or better ways of managing issues
that come before the Council and staff.The purpose of the ad hoc committee was to
discuss items prior to Planning &Zoning and prior to Council;so that developers'
concerns could be addressed in the planning stage as opposed to the action stage during a
councilor P&Z meeting.Council member Stanton mentioned to Council that an item
being discussed by the Developers'Roundtable had gone beyond the idea and discussion
phase and was weIl into the implementation phase.She indicated that according to the
January 31,2005 meeting outline it appeared designs for Development Directional
Signage had been completed,a bid had been received for construction,locations for the
SigJ1Shad been approved and according to that same meeting outline "SigJ1Sare planned
for instaIlation when weather permits."The process the mayor thought we were going to
use was that the Developers'Roundtable would outline recommendations,take them to

P&Z for input and approval and then take them to Council for their review.He indicated
that Development Directional Signage would be presented to the Council prior to any
action being taken by the committee.Council member Bailey indicated we have a
communication problem.He suggested we should be briefed on what is happening on
the various committees.Council member Gruber indicated that the concern (of this item
not going before Council)is a little premature in that the committee has to review a
discussion item and float a proposal of what could happen -when,where and how-
before presenting the discussion to Council.He indicated he didn't like sending memos
to council members in the discussion /research phase because what might be proposed
one day might be eliminated from the proposal the next day.Council member Peard
entered the conversation and indicated that the core duties of the Ad Hoc Committee
member from the Council was as a liaison from Council to the Committee and from the
Committee to the Council.He also indicated that proposals should be brought before the
council before action of any kind is taleen.
(26)Ordinance:To Amend Chapter 305,Section 305.4(8),Waukee Municipal Code,
Sign Ordinance,by adding as Subsection '4'the following:"Window Signs:All
window signs,whether temporary or permanent,shall be restricted to no more than ten
(10)percent of the size of the applicable window area.Typical window signs include,
but are not limited to:painted sign age,neon beverage signs,sale and product ads,etc.
Larger signage can be permitted on a temporary basis pursuant to items 5 and 6 below.
Exceptions to this item include seasonal non-commercial items and local or school
related events (e.g.,homecoming window painting)";and by renumbering in numerical
