(2)Pledge of Allegiance (3)Roll Call-The following members were present:Tony Oberman,Mayor,and Council members Nicholas Gruber,Donald Bailey,Jr.,JeffV.Mertz and Darlene Stanton.Council member Bill Peard absent. (4)Open Forum -Mary DU11bar,President of the Waukee Library Foundation, lives at 1029 Sixth Street,West Des Moines and works for the Waukee State Bank.Ms.Dunbar informed the Council of the activities of the Foundation during the past year.Those activities included the purchase of seven computers for patrons of the library,three staff computers,a server for the benefit of patrons and updating of the library circulation.Due to generous gifts,the Foundation was also able to purchase window blinds for the meeting room,the Waukee history room and the fireplace area.The Public Library Endowment and Foundation is part of the Greater DM Foundation.Funds received by the Library Foundation are invested in the Greater DM Foundation to help them grow for the purchase of books and special needed materials,A recent fund raiser dinner netted $1,000, which will be invested in the endowment fund.I (5)Agenda Approval-Item 13 was removed from the agenda and revisions to the 03- 07-05 Workshop Minutes were presented to the Council prior to the meeting.Nick Gruber moved to approve the agenda as changed;Darlene Stanton seconded.Ayes: Gruber,Stanton,Bailey,Mertz.Nays:None.Absent:Peard.Motion carried 4 -0 -1. TOTALS 14,344.28 29,084.47 420.00 825.37 256.82 2,826.93 $662,367.20 I (7)Mayor's Report:the Mayor attended the ribbon cutting ceremony for the Kum and Go store at the Comer of Ashworth Drive/L.A.Grant Parkway and SE University Ave.; attend the Council Workshop on Monday,the seventh;the Employee Benefits Committee Meeting.The Mayor also extended his appreciation to all city employees who assisted in the remodeling of City Hall,Matt J ermier,Parks and Recreation Director and Public Works for the recent Park and Recreation brochure distributed to residents and to the Chamber of Commerce and to the City for the congratulatory message regarding the mayor's selection for the Forty under Forty,which was printed in the DM Record. (8)Public Hearing:On the voluntary annexation of property and providing a transition for the imposition of taxes of property owned by Gary and Mary White Mayor Oberman opened the public hearing.Mark Arentsen stated that written comments were not received prior to the public hearing.Deputy Clerk Cathy Paardekooper spoke to the possible changes in the law relating to the transition of the imposition taxes.Per Ms. Paardekooper attomey Huscher indicated that the City might be in the situation of transitioning the taxes for this property over ten years as opposed to the current five. J ody Gunderson,Director of Community Development stated that the change in the law provided an option as to five or ten years.No other person wished to speak to the issue. Mayor Oberman closed the public hearing. (9)Resolution:Approving the Voluntary Annexation of Property and Providing a Transition for the Imposition of Taxes owned by Gary and Mary White Darlene Stanton moved to approve the resolution.Nick Gruber second.Mayor Oberman suggested that the motion include permission fOTcity staff to follow through with changes to the transition of the imposition of taxes,if appropriate.Council members Stanton and Gruber approved the change in the motion.Roll call:Ayes:Stanton,Gruber, Bailey,Mertz.Nays:None.Absent:Peard.Motion carried 4 -0 -1. (10)Resolution:Approving and authorizing staff to send Requests for Proposals to engineering firms in the area for the plllpose of reviewing the Wastewater Reclamation Authority's membership proposal for the City of Waukee Jeff Mertz moved to approve the resolution.Don Bailey,J1'.second.City staff anticipate paying $5,000 to $10,000 for the review of the proposal.Roll call:Ayes:Mertz,Bailey,Stanton,Gruber.Nays:None. Absent:Peard.Motion carried 4 -0 -1. (11)Public Hearing:On plans and specifications,proposed form of contract and estimate of cost for construction ofR-22 Water Main Improvements Mayor Oberman opened the public hearing.Mark Arentsen stated that written comments conceming this issue had not been received prior to the hearing.No one present wished to address the issue during the hearing.Mayor Oberman closed the public hearing. (12)Resolntion:Finally Approving and Confirming detailed plans,specifications, estimate of cost and form of contract Darlene Stanton moved to approve the resolution. Jeff Mertz second.At this time the water line will be run parallel to the Xenia Rural J I 5 Water lines,which are offset from the road.Roll call:Ayes:Stanton,Mertz,Gruber, Bailey.Nays:None.Absent:Peard,Motion carried 4 -0 -1. (13)Resolution:This item removed from the agenda prior to posting. (14)Resolution:Approving the Designation of Sidewalk Improvement Area for Calendar Year 2005 Darlene Stanton moved to approve.Don Bailey,Jr.second. Council member Bailey stated that staff and council have yet to adopt anything to assist low income individuals in payment for repair,replacement or construction of new sidewalks.Mr.Bailey thinks that a method for assistance should be incorporated into the Sidewalk Improvement Ordinance.TIns has not been done;so Mr.Bailey is not voting for this resolution.Roll call:Ayes:Stanton,Mertz,Gruber.Nays:Bailey.Absent: Peard.Motion carried 3 -1 -1. (15)Resolution:Approving Rules and Procedure for City of Waukee Ad Hoc and Advisory Committees and appointed now and in the future Jeff Mertz moved to approve this resolution.Darlene Stanton second.Roll call:Ayes:Mertz,Stanton, Gruber,Bailey.Nays:None.Absent:Peard,Motion carried 4 -0 -1. (16)Resolution:Approving Land &Water Conservation Fund (LSCF)Sugar Creek Multi-purpose Trail Grant Application Nick Gruber moved to approve the resolution. Jeff Mertz seconded the motion.Planning Director Chad Weaver discussed the timeline for the conversion of the railroad track bed into a trail.The latest word was that the tracks would be pulled up this summer.Once the abandonment occurs the City can proceed to construct the trail.The City has already received through Mr.Weaver's efforts,$100,000 for construction of the trail.Mr.Gibson indicated that the City will have a preconstruction meeting with railroad representatives as to where the abandonment will end,which is a concern when joining the proposed railroad trail to the City's trail system.Roll call:Ayes:Gruber,Mertz,Stanton,Bailey.Nays:None. (17)Public Hearing:On an amendment to Chapter 301.19,"C-2"Central Business District,Waukee Municipal Code,Zoning Ordinance,"C-2"Central Business District, to remove reference to owner occupied dwelling units as a Principal Permitted Use by deleting §301.19(A)(2)and §301.19(A)(4)Mayor Oberman opened the public hearing. Mark Arentsen indicated that the City has not received any written comments prior to the public hearing.Council member Bailey wished to clarify whether the downtown businesses had been notified and whether this effects the current usage.Mark Arentsen indicated that the downtown businesses had been contacted and support the change to the Code.He also stated this change would not effect current uses.No other person wished to address the council on this issue.Mayor Oberman closed the public hearing. (18)Ordinance:To amend Chapter 301.19,"C-2"Central Business District,Waukee Municipal Code,Zoning Ordinance,"C-2"Central Business District,to remove reference to owner occupied dwelling units as a Principal Permitted Use by deleting §301.19(A)(2)and §301.19(A)(4)(intro and first reading)Jeff Mertz introduced the ordinance.Darlene Stanton moved to have the first reading in title only.Nick Gruber second,No discussion.Roll call:Ayes:Stanton,Gruber,Mertz,Bailey.Nays:None. Absent:Peard.Motion carried 4 -0 -1.Mark Arentsen read the motion in title only. (19)Public Hearing:On an amendment to Section 301.31,Waukee Municipal Code, Zoning Ordinance of the City of Waukee,Iowa,Schedule of Fees,by deleting from the line commencing with the words,"Construction Inspection,"the words,"$50.00/hour, 6 and inserting in lieu thereof the words,"$60.00Ihour,so that the hourly rate for construction inspection is $60.00 per hour Mayor Oberman opened the public hearing. (20)Ordinance:To amend Section 301.31,Waukee Municipal Code,Zoning Ordinance of the City of Waukee,Iowa,Schedule of Fees,by deleting from the line commencing with the words,"Construction Inspection,"the words,"$50.00Ihour,and inserting in lieu thereof the words,"$60.00Ihour,so that the hourly rate for construction inspection is $60.00 per hour (intro and first reading)Nick Gruber introduced the ordinance.Jeff Mertz moved to have the first reading in title only. (21)Ordinance:To amend Chapter 213A of the Municipal Code of the City of Waukee,Providing for the Assessing of Fees or Charges for the Collection,Processing and Marketing of Solid Waste and Recyclable Materials within the city limits of the City of Waukee,Iowa,is amended as to Sections 213A.3(A)and 213A.3(B)to include Collection of Yard Waste from April 1 through November 30 each year,and to increase collection charges for single family residences and for a dwelling of two (2)or three (3) units.from $12.39 to $13.83;to provide that each mobile home in a mobile home park shall be treated as a single family dwelling;and amended as to Section 213A.3(C)to delete any provision for mobile homes in mobile home parks in said subsection;and as to Section 213A.3(E)to provide that changes in provisions for fees set out in this ordinance may be made by resolution of the City Council;further amended as to Section 213A.3(D)to delete said subsection so that $8.00 is to 110 longer be charged residents for replacement of lost,stolen or damaged recycling containers;and by renumbering in alphanumeric order each subsection thereafter.(third reading)Darlene Stanton moved to have the third reading of this ordinance and to place it on its final passage.Nick Gruber second.Roll call:Ayes:Stanton,Gruber,Bailey,Mertz.Nays:None.Absent:Peard. Motion carried 4 -0 -1.Mark Arentsen read the ordinance in title only.Mayor Oberman declared the ordinance passed and duly adopted. (22)ORDINANCE:To Amend Chapter 305,Section 305.4(H),Waukee Municipal Code,Sign Ordinance,by adding as Subsection '4'the following:"Window Signs:All window signs,whether temporary or permanent,shall be restricted to no more than ten (l0)percent of the size of the applicable window area.Typical window signs include, but are not limited to:painted sign age,neon beverage signs,sale and product ads,etc. Larger signage can be permitted on a temporary basis pursuant to Sections 305.4(H)(5) and 305.4(H)(6)as renumbered.Exceptions to this include seasonal non-commercial items and local or school related events (e.g.,homecoming window painting)";and by renumbering in numerical order each subsection thereafter.(third reading)Nick Gruber moved to have the third reading in title only and place this ordinance on its final passage.Darlene Stanton second.Roll call:Ayes:Gruber,Stanton,Mertz.Nays: Bailey.Absent:Peard.Motion carried 3 -1 -1.Mark Arentsen read the ordinance in title only.Mayor Oberman declared the ordinance passed and duly adopted.
