APRIL 18,2005
(1)Call to Order -The regular meeting ofthe Waukee City Council was called to order
by Mayor Oberman at 7:00 PM.
(2)Pledge of Allegiance
(3)Roll Call-The following members were present:Tony Oberman,Mayor,and
Council members Nicholas Gruber,JeffV.Mertz,Bill Peard and Darlene Stanton.
Council member Bailey absent.
(4)Open Forum -Martha DeWitt,550 6th St.,Waukee,Iowa 50263 stated her
opposition to the Des Moines Menace General Publici Upper 90 Club Beer Tent
to be located in Centennial Park,south and west ofthe sand volleyball courts and
north ofthe baseball diamonds.
(5)Agenda Approval-Jeff Mertz moved to approve the agenda with item 6C pulled to
discuss separately.Darlene Stanton second.Roll call:Ayes:Mertz,Stanton,Peard,
Gruber.Nays:None.Absent:Bailey.Motion carried 4 -0 -1.
(Sa)Honoring Cass Topinka,EMS Coordinator for the Waukee Fire Department Cass
Topinka,EMS Coordinator for the Waukee Fire Department has been accepted by a
private contractor whose company is scheduled to be in Iraq for two years to fight fires.
Cass Topinka did a great deal for the City the short time she was employed here.Mayor
Oberman read the resolution and presented it to Ms.Topinka.

the FY2005 Budget
J.Motion:Setting May 2,2005 as the date for a Public Hearing to amend Chapter 301,
Waukee Municipal Code,Zoning Ordinance ofthe City of Waukee,Iowa,by
rezoning and changing certain property therein from R-3 [Rental Multi-Family
Residential District]and C-l [Community and Highway Service Commercial
District]to R-4 [Row Dwelling and Townhome District];and amend the Official
Zoning Map to show rezoning (a parcel to be known as The Village at Grace Wood)
K,Motion:Setting May 2,2005 as the date for a Public Hearing on an Ordinance to
amend Chapter 301,Waukee Municipal Code,Zoning Ordinance of the City of
Waukee,Iowa,by amending Section 30 1.8(M),General Regulations -Fences,Walls
and Hedges,by replacing said section in its entirety with language that reads "Fences,

Walls and Hedges,Notwithstanding other provisions of this ordinance,fences,walls
and hedges may be permitted in any required yard or along the edge ofany yard;
provided that no fence,wall or hedge shall exceed four (4)feet in height within the
building setback area adjacent to any public right-of-way,Six (6)foot high fences
are allowed only outside front yard building setback areas,(A 'front'yard may be
along the side or the rear of a home if adjacent to a street.)Fences,walls and hedges
in any district other than M-I,M-IA and M-2 Districts not exceeding six (6)feet in

questions and issues,which were not resolved,Alan Oatsvall,General Manager of the
Des Moines Menace,spoke to the Council.Martha DeWitt,550 6th Street,Waukee
spoke against having a beer tent and selling beer on park property,No action was taken
on this item,

(7)Mayor's Report:During the past two weeks:Developer Roundtable,Mid-Iowa
Association of Local Governments meeting with Dr.Dave Wilkerson from the Wankee
Schools,Dallas Connty Mayor's Meeting where the Endow Iowa program was discnssed.

All council members and mayor attended "Foolin Around in April."Benefits Committee
Meeting will be next Thursday and Freight Round Table meeting -a subcommittee of the
MPO will be held.
(8)PROCLAMATION:This item moved to 5A.
(9)Quarterly Report:Fire,Police and Library Departments will present a quarterly
report of activities Assistant Fire Chief Mark Schmitt spoke on behalf of the fire
department;Chief Larry Phillips for the Police Department and Linda Mack,Library
Director for the Public Library.
(10)Presentation:Mid American Energy Items of Interest by Paul B.Priest,Vice
President,Employee,Labor Relations and HR Compliance,MidAmerican Energy Mr.
Priest,a Waukee resident living at 730 West Branch Drive,gave a power point
presentation conceming recent improvements and advancements at Mid American,Mr.
Priest also indicated MidAmerican Energy was committed to holding the rate at the same
level for residential users through the year 20 II.In addition,a rate plan equalizing rates
among residential,industrial and commercial was filed in October 2004.Mr.Priest also
discussed recent projects and constructions and recognition awards received by
MidAmerican Energy.
(11)Presentation:Property and liability insurance renewal by Mark Currie of
Insurance Associates Mr.Currie,also a Waukee resident and a long time insurance
representative for the City of Waukee spoke to the Council concerning a three year
agreement with Iowa Community Assurance Pool (rCAP)where rCAP would provide
property and liability insurance for the City at the current rate.No member of the
Council voiced an opinion critical of the insurance program.
(12)Resolution:approving Site Plan for Lund Motors Jeff Mertz moved to approve the
resolution.Nick Gruber second.The Conncil praised Mr.Lund for the design ofthe
building and of the lot and indicated it was a big improvement for that comer.Bob Lund,
owner of the property,thanked the Council for their encouraging words and indicated that
he wanted to not only remodel his business;but also to improve that comer of downtown.
Katie Kinsey of Engineering Design Services discussed the Site Plan from the
perspective of the engineer.Trisha Wicks of Well ness by Wicks who lives at 505 Gray
Ave,spoke on behalf of the Design Review Committee of the Downtown Business Group
consisting of the following members:Trisha,Aun Ford,Gary Poris,LalTY Crannell,and
Lyn Schafer.Ms.Wicks stated the group along with City staff reviewed the building and
they "love it."Roll call:Ayes:Mertz,Gruber,Stanton,Peard.Nays:None.Absent:
Bailey.Motion carried 4 -0 -I.
(13)Resolution:Approving the Agreement with Veenstra &Kimm,Inc.to provide
engineering services for the Preliminary Schematic Design of University Avenue
Reconstruction Project from Alice's Road to L.A.Grant Parkway Nick Gruber moved
to approve the resolution.Jeff Mertz second.Roll call:Ayes:Gruber,Mertz,Stanton,
Peard.Nays:None.Absent:Bailey.Motion carried 4 -0 -I.
(14)Resolution:Approving the Agreement with Veenstra &Kimm,Inc.to provide
engineering design and construction services on the 4't.Street Pavement Improvements
Bill Peard moved to approve the resolution.Darlene Stanton second.Roll call:Ayes:
Peard,Stanton,Gruber,Mertz,Nays:None.Absent:Bailey.Motion carried 4 -0 -1.
(15)Discussion:Conceptual Plan for directional signage for developers in Waukee
After all Council members presented their thoughts concerning this topic,the division of

for or against was 2 -2:Nick and Jefffor;Darlene and Bill against.Chuck Thomas of
the Builder's Association and Robert Lundstrom ofJerry's Homes were for the concept.
Council member Peard would like to see a prototype ofthe sign.Council member
Stanton said she would expect to see:(I)statement of need;(2)a list of the sites being
considered;(3)how many accessory signs and where located on map;(4)which flags and
signs coming down and when;(5)how long will signs remain up.
(16)Ordinance:To amend Chapter 304,Waukee Municipal Code,Site Plan
Requirements of the City of Waukee,Iowa,by deleting sub-section304.5(M)(2),Multi-
Family Dwellings in All Districts and by adding in lieu thereof a revised Section
304.5(M)(2),Townhome and Multi-Family Dwellings in All Districts (second reading)
Jeff Mertz moved to have second reading in title only.Darlene Stanton second.Robert
Lundstrom of Jerry's Homes presented a different matrix for percentage of hard surface
requirement for townhome construction.Of the recommendations made by Mr.
Lundstrom,the following were accepted by the Council:(I)in the category of exterior
building materials,the first sentence in section'a'will read:All apartments,
condominiums and three story above grade townhomes shall incorporate,at a minimum,
forty percent (40%)brick or stone into the overall building design;(2)the three story
requirements will be removed from the chart or matrix;and (3)Column B in the chart in
section 'b'will be renamed to "Adjacent to collectors and arterials as classified in our
Major Street Plan."Joe Schmitz representative of Planning &Zoning spoke to the
Council with respect to the actions taken by P &Z when they approved this ordinance.
Jeff Mertz moved to amend his motion with the following to be included in the original

(17)Resolution:Approving Preliminary Plat for Glynn Village Plat I Jeff Mertz
moved to approve.Darlene Stanton second.Doug Saltsgaver with Engineering Resource
Group,2413 Grand Ave,Des Moines and Joe Pietrusznski,Development Manager of
Hubbell Realty Co.presented Glynn Village,Plat 1.Glynn Village is currently made up
of five plats.Development will depend on access and availability of water and sewer.
Plat I consists of 140 single family lots,proposed trails and a club house to be located in
the southem portion of the plat.Lots 142 (entrance feature),and Lots 142 and 148
(detention basin)will be owned and maintained by the homeowners association.Signage
for the entry way to the development will be unique to the development and conservation
theme.All outstanding issues have been addressed or resolved.Roll call:Ayes:Mertz,
Stanton,Peard,Gruber.Nays:None.Absent:Bailey.Motion carried 4 -0 -1.
(18)Resolution:Approving the committee and process for the FY2005 City
Administrator Evaluation Bill Peard moved to approve the resolution.Jeff Mertz
second.Council discussed the method for the review One of the four Council members

did not think staff input should be part of the evaluation of a managing supervisor due to
individuals who are supervised having quite frequently a reason to cast disparaging
remarks about the supervisor affecting them most directly.Because the Council set goals
for the City Administrator to improve his work performance,at least two of the four
Council members desired to maintain the same review process as last year,so that the
improvement could be measured more accurately.One of the four Council members

Administrator indicated he thought the process is fine except that annonymous comments
cannot be validated and he would prefer that a method to ensure the opportunity to
ascertain the validity of comments be part of the process and that questions written in a
negative manner be eliminated.City attomey Paul Huscher indicated that a closed
session,if requested by the City Administrator,would be permitted under the Code of
Iowa.However,the response of individual staff members is requested outside of the
closed session and Mr.Huscher states he does not find anything in the Code which states
that evaluations of supervisors are to be annonymous.After further discussion,Council
member Mertz would like to use the previous years evaluation form and method so that
the comparison between last year and this year would be based on the same process.
After continued discussion,the Mayor called the Roll:Ayes:Mertz,Stanton,Gruber,
Peard.Nays:None.Absent:Bailey.Motion carried 4 -0 -1.
(19)Resolution:Approving and accepting Conlin Properties Offer to fund street
improvements and authorizing issuance of building permit Bill Peard moved to
approve the resolution.Jeff Mertz moved to approve the resolution.Darlene Stanton
second.Conlin Properties has agreed to pay $24,900.00 after the City has installed a 3.5
foot wide section of street paving,curb and gutter along Warrior Lane adjacent to the
existing apartment complex.Roll call:Ayes:Peard,Mertz,Stanton,Gruber.Nays:
None.Absent:Bailey.Motion carried 4 -0 -1.
