HomeMy WebLinkAbout2005-05-02-Regular MinutesWAUKEE CITY COUNCIL MINUTES MAY 2,2005 Both the mayor and mayor pro tem were absent at this meeting.Therefore,the four council members present:Nick Gruber,Don Bailey,Jr.,Bill Peard,Darlene Stanton agreed or did not disagree with the suggestion that Bill Peard preside over the meeting. (1)Call to Order -The regular meeting of the Waukee City Council was called to order by Council member Peard at 7:00 PM. (2)Pledge of Allegiance (3)Roll Call-The following members were present:Council members Nicholas Gruber, Donald Bailey,Jr.,Bill Peard and Darlene Stanton.Mayor Tony Oberman and Council member Jeff V.Mertz absent.Council member Mertz will participate in a portion of the meeting via telephone. (4)Open Forum -No one present wished to address the council about an issue not on the agenda. (17)Public Hearing:On an amendment to Chapter 301,Waukee Municipal Code, Zoning Ordinance of the City of Waukee,Iowa,be rezoning and changing certain property therein from R-3 [Rental Multi-Family Residential District]and C-1 [Community and Highway Service Commercial District}to R-4 [Row Dwelling and Townhome District};and amend the Official Zoning Map to show rezoning (a parcel to 5 be known as The Village at Grace Wood)Presiding Officer Peard opened the public hearing.Mark Arentsen stated that written comments pertaining to this issue were not received prior to the hearing.Bob Gibson of Triton Homes,1802 SE Delaware in Ankeny,spoke to the Council describing the project and answering questions.The townhomes will be valued at $116,000 to $120,500 and will be for sale.They will each have a two car drive-under garage.Council member Bailey asked how Dartmoor will be handled to the north of this property.Council member Bailey requested staff prepare additional information concerning the proposed street(s)through these lots.Presiding Officer Peard closed the public hearing. (18)Ordinance To amend Chapter 301,Waukee Municipal Code,Zoning Ordinance of the City of Waukee,Iowa,be rezoning and changing certain property therein from R-3 [Rental Multi-Family Residential District]and C-1 [Community and Highway Service Commercial District]to R-4 [Row Dwelling and Townhome District];and amend the Official Zoning Map to show rezoning (a parcel to be known as The Village at Grace Wood)(intra and first reading)Nick Gruber introduced the ordinance. (19)Public Hearing:On an Ordinance to amend Chapter 301,Waukee Municipal Code,Zoning Ordinance of the City of Waukee,Iowa,by amending Section 301.8(M), General Regulations -Fences,Walls and Hedges,by replacing said section in its entirety with language that reads "Fences,Walls and Hedges.Notwithstanding other provisions of this ordinance,fences,walls and hedges may be permitted in any required yard or along the edge of any yard;provided that no fence,wall or hedge shall exceed four (4)feet in height within the building setback area adjacent to any public right-of- way.Six (6)foot high fences are allowed only outside front yard building setback areas.(A 'front'yard may be along the side or the rear of a home if adjacent to a street.)Fences,walls and hedges in any district other than M-1,M-1A and M-2 Districts not exceeding six (6)feet in height are permitted within limits of side and rear yards.In M-1,M-1A and M-2 Districts fences and walls shall not exceed a height of eight (8)feet."Presiding Officer Peard opened the public hearing.Mark J.Arentsen stated that no written comments were received prior to the hearing.Brief Discussion. Mark 1.Arentsen stated that no written connnents were received prior to the healing. Chad Weaver,Director of Planning,stated that green space is a function of the overall number of acres in that 20%of the number of acres is equivalent to a certain percentage of land set aside for green space.Council member Stanton requested information and documentation which would help to determine the con-elation between density and green space and the effect that would have on community.Presiding Officer Peard closed the public hearing. (25)Ordinance:To amend Chapter 207 A,Waukee Municipal Code,providing for the Powers and Duties of Waukee Park and Recreation Board,relative to the operation and 7 management of Sugar Creek Municipal Golf Course (intra and first reading)Darlene Stanton introduced the ordinance.Nick Gruber moved to have the first reading in title only,waive the second and third readings and place this ordinance on its final passage. (26)Ordinance:To amend Chapter 207,§207.4(W)to providefor a $30.00 user fee for enclosed shelters,and a $10.00 user fee for unenclosed shelters,except for charitable organizations;and to provide for a $30.00 deposit for all users of all park shelters (intra and first reading)Nick Gruber introduced the ordinance.Don Bailey,Jr.moved to have the first reading in title only including the change from "enclosed"shelters to "open"shelters,waving the second and third reading and placing this ordinance as modified on its final passage.Jeff Mertz second.Roll call:Ayes:Bailey,Mertz,Gruber, Stanton,Peard.Nays:None.Motion carried 5 -O.Mark Arentsen read the ordinance in title only.Presiding Officer Peard declared the ordinance passed and duly adopted. (27)Ordinance:To amend Chapter 304,Waukee Municipal Code,Site Plan Requirements of the City of Waukee,Iowa,by deleting sub-section 304.5(M)(2),Multi- Family Dwellings in All Districts and by adding in lieu thereof a revised Section 304.5(M)(2),Townhome and Multi-Family Dwellings in All Districts (third reading) Jeff Mertz moved to have the third reading in title only and to place this ordinance on its final passage.Darlene Stanton second.Council member Bailey discussed this ordinance briefly and then indicated he would vote "yes"for this ordinance in the interest of working with the rest of the Council at this time.Roll call:Ayes:Mertz,Stanton,Bailey, Peard,Gruber,Nays:None.Motion carried 5 -O.Mark J.Arentsen read the ordinance in title only.Presiding Officer Peard declared the ordinance passed and duly adopted. During the discussion of the following item,Council member Mertz ended his participation in this meeting at 7:50 PM. (28)Discussion:Big Box Development Issues Council discussed a number of issues with respect to Big Box Businesses such as Big Targets,Costco,Wahnart and other businesses located in big,square,nondiscript buildings.Location,hours of business, noise level,employee pay levels were among issues discussed.TIllS item will be presented to Planning &Zoning Commission for further research and proposed action. REPORTS:Reports were given by Mark Arentsen,Jody Gunderson,Linda Burkhart, Jolm Gibson,Mik Briedis,Chad Weaver,Darlene Stanton,and Nick Gruber.
