(1)Call to Order -The regular meeting of the Waukee City Council was called to order
by Mayor Oberman at 7:00 PM.
(2)Pledge of Allegiance
(3)Roll Call-The following members were present:Tony Oberman,Mayor,and
Council members Nicholas Gruber,Donald Bailey,Jr.,JeffY.Mertz and Darlene
Stanton.Bill Peard absent.
(4)Open Forum -Jim Phillips,240 Bel Aire Dr.indicated the City was paying
too much money to send out apology letters for the Sidewalk Letter,which should
not have been sent out.Council member Bailey said he was researching the
incident.Mike Watts,675 Third St.,mentioned (1)the sign for the golf course
should have been a "monument-style"sign and (2)the water tower shared by
Clive,West Des Moines and Waukee was to have 'West Side Water Storage'
written on it instead of City of West Des Moines.Public Works Director John
Gibson stated the agreement signed by all three cities had the City of West Des
Moines name on the tower.
Mayor Oberman introduced and welcomed Steve Brick,attorney with the Brick
Gentry Law Firm.They Blick Gentry Law Finn are the attorneys for the City of
Waukee,having begun July 1,2005.

Painted Woods Plats 2 and 3 from A-I (Agricultural District)to R-1 (Single Family
Residential District)
K.Motion:Setting July 25,2005 as the date for a Public Hearing on an 80/20
Annexation with consideration of the Annexation taking place immediately after the
public hearing
Don Bailey,Jr.moved to approve Items A through G,and Items I and J and to pull out
for separate consideration Items Hand K.Darlene Stanton second.Jeff Mertz requested
that Item I be pulled out for an individual vote.Council members Bailey and Stanton
agreed to that change and added it to their motion.Roll call on Items A through G and
Item J:Ayes:Bailey,Stanton,Mertz,Gruber.Nays:None.Absent:Peard,Motion
canied4-0-1.
Council member Bill Peard present at 7 :05.
H.Resolution:Approving Certificate of Completion for Conlin Curb and Gutter
Improvement Proj ect
Don Bailey,Jr.moved to approve Item H.JeffY.Mertz second.The total project cost
had not been determined;however,the project was to be accepted by the City;so that the
final cost could be ascertained and billed.Roll call:Ayes:Bailey,Mertz,Gruber,
Stanton,Peard.Nays:None.Motion carried 5 -O.
L Motion:Setting August 1,2005 as the date for a public hearing on Exterior Lighting
Ordinance
Don Bailey,Jr.moved to approve the motion.Darlene Stanton second.Council member
Mertz stated this item had not been approved by Planning &Zoning Commission.
Although P&Z has worked on this project for some time,they have not officially
reviewed the final product nor have they voted on it.Mr.Mertz indicated he would be
voting "no"on this item because our procedure is to have the various committees,boards
or commissions,when appropriate review the action coming before the Council prior to
the Council's review of it.After more discussion,all Council members decided to vote
"no"on this item until the Planning &Zoning Commission has the opportunity to review
it.Roll call:Ayes:None.Nays:Bailey,Stanton,Mertz,Gruber,Peard,Motion defeated

K.Motion:Setting July 25,2005 as the date for a Public Hearing on an 80/20
Annexation with consideration of the Annexation taking place immediately after the
public hearing
Don Bailey,Jr.moved to approve this item.Jeff Mertz second.Council member Bailey
discussed this item indicating that an 80120 is not something we have done in the past.
He stated we started one in 2001,which became an voluntary annexation.Mr.Bailey
wanted to make sure procedure was followed and asked to have a closed session during
the July 18,2005 meeting with the City Attorney present.Mr.Bailey thinks that litigation
is imminent.Mr.Bailey asked for any additional information be distributed to council
members.Roll call:Ayes:Bailey,Mertz,Stanton,Gruber,Peard.Nays:None.Motion
carried 5 -O.

(7)Mayor's Report:Mayor Oberman mentioned and thanked again Tom Tovrea,
Waukee Citizen of the Year and Margaret Stone,Waukee Volunteer of the Year.The
mayor participated in the groundbreaking for Glynn Village.He extended his
appreciation and thanks to Parks and Recreation and to Public Works for another,even
better,Fourth of July.The mayor reminded everyone of upcoming important dates.
(8)Resolution:Awarding Certificates of Appreciation for Years of Service for City
Employees who have worked 5 years or more Nick Gruber moved to approve the
resolution.Bill Peard second.Roll call:Ayes:Gruber,Peard,Stanton,Mertz,Bailey.
Nays:None.Motion carried 5 -O.Mayor Oberman read the resolution and presented
the gifts and certificates of appreciation to employees who were present and who had
worked for the City for five,ten,fifteen,twenty-five or thirty years.
(9)Resolution:Approving 28E Agreement with the Cities of Urbandale,Clive,West
Des Moines and Altoona for Sanitary Sewer Rehabilitation Project J eff Mcrtz moved
to approve;Darlene Stanton second.Council member Mertz applauded the efforts of
Public Works in securing tins agreement to share costs in sewer repairs.Roll call:Ayes:

(19)Resolution:Approving the Council Policy requiring replacement of a regularly
scheduled Council meeting occurring on a holiday with a meeting on a date exactly
one week later Don Bailey,Jr.moved to approve.Jeff Mertz second.Council member
Gruber indicated he felt the Council,as well as staff,should be permitted to request a
vote to change date from the next Monday to some other day during the week of the
Holiday,when circumstances require it.Roll call:Ayes Bailey,Mertz,Stanton,Gruber,
Peard.Nays:None.Motion carried 5 -O.By Council vote,it was determined the date
and time of a meeting to replace the meeting falling on a holiday,would,by resolution be
the Monday immediately following the Holiday.However after further discussion,
Attomey Brick indicated that a resolution could be approved at any time to change the
meeting to a different day.
(20)Public Hearing:On an ordinance to amend Chapter 301,Waukee Municipal
Code,Zoning Ordinance of the City of Waukee,Iowa,by re-zoning and changing
certain property therein from M-l (Light Industrial District)to R-3 (Rental Multi-
Family District),R-2 (One and Two Family Residential district),R-4 (Row Dwelling
and Townhome District)and C-l (Community and Highway Service Commercial
District);and then to PD-l (Planned Development Overlay District)(Williams Pointe
II -Brick Property)Mayor Oberman opened the public hearing.Cathy Paardekooper
stated written comments had not been received prior to the hearing.Erin Ollendike of

Civil Design Advantage,L.L.c.spoke in favor of the re-zoning.Bill Spencer of Regency
was also present but did not speak.No others present wished to address the Council.

Two Family Residential district),R-4 (Row Dwelling and Townhome District)and C-l
(Community and Highway Service Commercial District);and then to PD-l (Planned

(25)Public Hearing:On an ordinance to amend Chapter 301,Waukee Municipal
Code,zoning Ordinance of the City of Waukee,Iowa,by adding section 30l.18A,"c-
IB"Large Scale Commercial District,to provide space for large retail and professional
offices and efficient development of major retail shopping areas with single structures
over 50,000 square feet Mayor Oberman opened the public hearing.Cathy
Paardekooper stated no written comments were received prior to the hearing;however,
three individuals called requesting information about the ordinance.Jane Olson,905
Ashworth Dr.,addressed the Council concerning a Big Box store locating on the current
west edge of Waukee.Council member Mertz responded to Ms.Olson's concems.No
other person wished to address the Council on this issue.Mayor Oberman closed the
public hearing.
(26)Ordinance:To amend Chapter 301,Waukee Municipal code,zoning Ordinance
of the City of Waukee,iowa,by adding Section 301.18A,"C-IB"Large Scale
Commercial District,to provide space for large retail and professional offices and
efficient development of major retail shopping areas with single structures over 50,000
square feet (intro and first reading)Don Bailey,Jr.introduced the ordinance.Nick

Rates,to provide that water rates for users outside the City limits shall be the same as
those within the City limits of the City of Waukee,by deleting the third subparagraph
thereof,and by adding to the previously fourth subparagraph of Section 203.2,the words,
"Water furnished to users outside the City limits of the City of Waukee shall be furnished
at the same rate that is charged for water furnished for users within the City limits of the
