(A)Call to Order -The regular meeting ofthe Waukee City Council was called to order by
Mayor Oberman at 7:00 p.m.
(B)Pledge of Allegiance
(C)Roll Call-The following members were present:Mayor Tony Oberman and Council
Members Nicholas Gruber,Donald Bailey,Jr.,JeffV.Mertz,Bill Peard,and Darlene Stanton.
(D)Open Forum -Jolm Durner of the American Legion state headquarters and
Michelle Steinmetz of the American Legion national headquarters addressed the
Council.Mr.Werner stated that the American Legion was hoping to form a post in
Waukee,and so far had a great response.He thanked the City and Chamber of
Commerce for their support,and stated that an organizational meeting would be held
on January 17 at the Community Center.Council Member Peard suggested a link be
posted on the City website that would connect with the American Legion website.
Chet Chedester,220 Wankee Ave.,next addressed the Council.He stated that he
believed questions called in to the mayoral and council candidates forums had been
censored,as the questions he called in were not asked during the forums.He also
stated his belief that a double-standard was in place regarding the enforcement of the
sign ordinance,particularly regarding temporary real estate and political signs.Mayor
Oberman asked Dennis Dowell to contact Mr.Chedester following the meeting to
discuss the matter further.
Council Member Stanton then addresses the Council,stating her concern with certain
City employee health insurance issues.She asked that the Council discuss the matter
at the next regular meeting.
(E)Agenda Approval-Motion by Council Member Gruber,seconded by Council Member
Stanton,to approve the agenda.Mark Arentsen asked that item H2 be moved prior to HI,and
I2 prior to l l .Council Member Gruber amended his motion to include the changes suggested
by Mr.Arentsen;Council Member Stanton amended the second.Roll call:Ayes:Gruber,
Stanton,Bailey,Peard,Mertz.Nays:None.Motion carried 5 -O.
(F)Mayor's Report -Mayor Oberman reported that he had attended the Developer's
Roundtable meeting,the Freight Roundtable meeting,and the Talia Lehman ceremony.He
commended Talia for her fundraising work.Mayor Oberman also attended the shared water
tower dedication ceremony,along with John Gibson and representatives from West Des
Moines and Clive.Upcoming events include attending the Mid Iowa Association of Local
Governments,the Freight Roundtable meeting and the MFO meeting.Mayor Oberman
reminded everyone that the Waukee Community Schools Foundation dinner and auction
would be on November 18.He then offered his congratulations to the Wankee High School
football team in making the playoffs,and encouraged everyone to vote on Tuesday,
November 8.
(G)Presentations:
(1)Resolution:In recognition of the achievements of Chad Weaver,Director of
Planning for the City of Waukee.Mayor Oberman read the resolution and presented Chad
Weaver with a framed copy of the resolution and a plaque.Council Member Peard then
expressed his thanks to Mr.Weaver for his hard work and dedication to the City dnring a
period of explosive growth.
(2)Quarterly Reports:Fire,Police and Library Departments.Acting Fire Chief
Schmitt,Police Chief Phillips and Library Director Mack presented reports.
(II)Public Hearings:
(2)On an ordinance to amend Chapter 301,Waukee Municipal Code,Zoning Ordinance
of the City of Waukee,Iowa,by rezoning and changing certain property therein from
R-3 [Rental Multi-Family Residential District]to C-l [Community and Highway
Service Commercial District];and amend the Official Zoning Map to show rezoning
(a parcel known as 620 Walnut St.)Mayor Oberman opened the public hearing and
asked if any written correspondence regarding the rezoning had been received;Mark
Arentsen replied in the negative.No one present addressed the Council.Council
Member Bailey asked why the property in question was for sale;Chad Weaver stated
that the property owner no longer wished to locate his plumbing contracting business
on the site,but wished to pursue C-2 zoning instead of C-I.City staff would favor the
C-2 zoning.City Attorney Brick stated that the Planning &Zoning Commission
would first need to approve the rezoning from R-3 to C-2,then it could be considered
by the Council.Mayor Oberman declared the public hearing closed.
(I)On an ordinance to amend Chapter 301,Waukee Municipal Code,Zoning Ordinance
of the City of Waukee,Iowa,by rezoning and changing certain property therein from
C-IA [Neighborhood Commercial District]to R-3 [Rental Multi-Commercial
District],and then from C-IA [Neighborhood Commercial District]and R-3 [Rental
Multi-Family Residential]to PD-l [Planned Development Overlay District];and
amend the Official Zoning Map to show rezoning (a parcel known as Williams Pointe
Plat 9)Mayor Oberman opened the public hearing and asked if any written
correspondence regarding the rezoning had been received;Mark Arentsen replied in
the negative.Erin Ollendike of Civil Design Advantage (CDA)addressed the Council
on behlaf of Regency Commercial Services.Also in attendance were Mike Simonson
and Todd Wiskus of Simonson and Associates.Chad Weaver explained that the plat
would not exceed allowable density,and that the design of the mixed use building
would be addressed during the site plan process.He also stated that the PD could
allow for one large temporary sign instead of the multiple smaller signs allowed by
ordinance;the developer preferred to have one smaller sign per lot.Council Member
Mertz favored one large sign;Council Member Stanton slaled no preference,but had
no issue with one sign per lot.Mayor Oberman declared the public hearing closed.
(3)On an ordinance to repeal existing Chapter 604 (and its subsections)of the Waukee
Municipal Code and enact in lieu thereof Chapter 604 (Subsections 604.1-604.6)
titled "Residency Restrictions for Sex Offenders"regulating the residency of
convicted sex offenders within the corporate limits of the City of Waukee,Iowa and
providing penalties for violations Mayor Oberman opened the public hearing and
asked if any written correspondence regarding the rezoning had been received;Mark
Arentsen replied in the negative.Scott Helgeson,990 SE Brentwood Dr.,addressed
the Council.He stated that he was on the sex offender registry and explained the
nature of his crime.He then presented certain statistics to the Council regarding those
persons on the sex offender registry,and stated that not everyone on the registry,
including himself,was a risk to reoffend.Council Member Pcard commended Mr.

Helgeson for his courage in speaking in public about this issue.Mayor Oberman stated
that the purpose of the ordinance was not necessarily to address those that were low
risk to reoffend,but that percentage of sex offenders that were likely to reoffend.
Council Member Stanton explained that the City Attorney was working on alternative
language for the ordinance that might be less strict in the limitations on residency for
sex offenders.Council Members Mertz and Gruber stated that the state legislature
needed to review their ruling and procedures,especially in regard to risk assessment.
Isaiah McGee,760 SE Willow Brook Dr.,addressed the Council,stating that he'd had
prior experience working with youth offenders and found that many ofthem are
concerned that they themselves may reoffend.Mayor Oberman declared the public
hearing closed.

consent agenda.Council Member Bailey questioned a bill from Trilix Marketing Group in
the amount of $9,449.49.J ody Gunderson explained that Trilix had recently made significant
upgrades to the City website,such as interactive subdivision maps,City calendar upgrades,
and the ability for City staff to update and amend information without requesting it be done
through Trilix.Council Member Bailey requested a report of past expenses and future
proj ections for website administration.Council Member Gruber reminded the Council that
Trilix had recently won a national award for their City website design,and that the website
was an effective marketing tooL Council Member Stanton asked if an RFP could be done in
the future for a yearly contract.Roll call:Ayes:Gruber,Mertz,Peard,Bailey,Stanton.Nays:

4)RESOLUTION:Consideration of Proposal ofCH2M HILL to prepare the
Environmental Assessment document for the Alice's Roadl105'h St.1-80 Interchange Motion
by Council Member Mertz,seconded by Council Member Stanton,to approve the resolution.
John Holzwarth ofCH2M Hill was in attendance.Council Member Bailey asked if the
proposed cost of $229,000 was typical;Mr.Holzwarth answered that a brand new study
usually cost between $200,000-$600,000.Mr.Holzwarth also stated that the study should
take 10 months to complete.Jody Gunderson explained that the City Council of West Des
Moines had yet to take action on the proposal,but that the West Des Moines City staff
supported the proposal.Council Member Bailey asked if the contract had gone out to bid;
Mr.Gunderson replied that it was done through the RFP process in August 2003 and that
CH2M Hill was chosen by Waukee,West Des Moines and the Iowa Department of
Transportation (IDOT).Council Member Bailey proposed that a vote on the resolution be
postponed in order to further study the proposal.City Attorney Brick stated that he had yet to
review the proposal and as such was unable to render an opinion at the moment.Council
Member Bailey suggested a special meeting be held next week to consider the resolution;
Council Member Gruber suggested the resolution be approved contingent on City Attorney
review and approval.Council Member Bailey asked that the record show his opinion that,
when spending a quarter of a million dollars in tax money,the Council should have at least
one day to review the proposal.Council Member Mertz amended his motion to approve the
resolution contingent on the review and approval of the City Attorney;Council Member
Stanton amended the second.Roll call:Ayes:Mertz,Stanton,Peard,Bailey,Gruber.Nays:

5)RESOLUTION:Consideration of the Addendum to the Telecommunications Leases
Space agreement between the City of Waukee and the Waukee Community School Motion by
