SPECIAL MEETING
NOVEMBER 14,2005
(1)Call to Order -The special meeting of the Waukee City Council was called to order by
Mayor Oberman at 7:02 p.m.
(2)Roll Call-The following members were present:Mayor Oberman and Council Members
Bailey,Gruber,Mertz,Peard and Stanton.Absent:None.
(3)Agenda Approval-Motion by Stanton,seconded by Mertz,to approve the agenda as
written.Ayes:Stanton,Mertz,Peard,Bailey,Gruber.Nays:None.Motion carried 5 -O.
(4)Motion:Consideration of November 21,2005 as the date for a Public Hearing to amend
Chapter 301,Waukee Municipal Code,Zoning Ordinance of the City of Waukee,Iowa,by
rezoning and changing certain property therein from cos [Conservation and Open Space
District]to A-I [Agricultural District];and amend the Official Zoning Map to show rezoning
(parcels known as 1825 6th St.and Lot 2,Government Lot 12).Motion by Mertz,seconded by
Stanton,to set the public hearing date.Roll Call:Ayes:Mertz,Stanton,Gruber,Bailey,Peard.
Nays:None.Motion carried 5 -0
(5)Resolution:Consideration of construction plans for St.Boniface/Warrior Lane extension.
Motion by Peard,seconded by Mertz,to approve the resolution.John Gibson distributed revised
copies ofthe construction plans,stating the taper coming off Warrior Lane from the south will be
constructed as soon as possible.Council Member Gruber asked about the right-tum only at the
northern entrance/exit for St.Boniface Church,stating that directing such traffic to the south
would be problematic.Mr.Gibson replied that there would be a left tum lane on Warrior Lane
to access University Ave.,and that the church was aware that they may lose some access when
University Ave.is extended to the west.Roll Call:Ayes:Peard,Mertz,Bailey,Gruber,Stanton.
Nays:None.Motion carried 5 -O.
(6)Resolution:Consideration of the request of Steve Gerberich to install a temporary
sculpture entitled "Waukee Tree Angle"at Triangle Park for the Thanksgiving and Christmas
holidays,with an installation date of November 19,2005.Motion by Bailey,seconded by
Stanton,to approve the resolution.John Gibson stated that Mr.Gerberich had initially requested
the closure of Ashworth Drive in order to install the sculpture,but that Public Works had
preferred the closure of Walnut St.as it typically has less through traffic and would cause less
disruption,Mr.Gerberich agrees to the Walnut St.closure.Council Member Bailey then
explained that,in lieu of a monetary donation from the City to help offset the cost of installation,
it had been requested that the City offer insurance coverage instead as Mr.Gerberich's New
York-based insurance carrier was not licensed in Iowa.Mark Arentsen stated that he had
discussed the matter with Mark Currie,the City's insurance agent,and Mr.Currie agreed that the
City could insure the value ofthe tree up to $1,000.Liability insurance would cover any claim
made against the City.Council Member Gruber questioned whether a monetary donation to the
artist would have contradicted ordinances recently approved by the Council regarding donations
for charitable and non-profit projects.Council Member Stanton thanked Council Member Bailey
for his work in helping this proj ect come to fruition.Council Member Peard stated that Waste
Management would help provide recycled materials to the artist for use in the sculpture,as well
as a possible monetary contribution.Cindy De Pond of the Waukee Area Arts Council (W AAC)
then addressed the Council,stating that the project would have a positive economic impact on
the community and would draw visitors to the Triangle area during the holidays.She also stated
that area school children would be asked to donate recyclable items to be used in the sculpture.
Steve Brick,City Attorney,questioned if the City's intent was for the insurance to cover Mr.
Gerberich's liability or if it would just cover the City in the event of a claim.Mr.Arentsen
replied that he would research the matter,but that it was his understanding that insurance would
just cover the City's liability.Council Member Stanton inquired as to whether a written
statement from Mr.Gerberich releasing the City from any liability due to his installation of the
sculpture would be adequate;Mr.Brick replied in the affirmative.Roll Call:Ayes:Bailey,
Stanton,Peard,Mertz,Gruber.Nays:None.Motion carried 5 -O.

(7)Resolution:Consideration of support for the "Waukee Tree Angle"temporary scuplture
project and a contribution of $2,000 from the City for the installation tltereof.Motion by
Gruber,seconded by Stanton,to approve the resolution.Council Member Mertz asked if the
downtown business owners were in support of the project;Cindy De Pond of the Waukee Area
Arts Council (W AAC)replied in the affmnative.After some discussion,Gruber amended his
motion to remove a contribution of $2,000 from the City in lieu of consideration of in-kind
liability insurance regarding the project;Stanton amended the second.Roll Call:Ayes:Gruber,
Stanton,Peard,Mertz,Bailey.Nays:None.Motion carried 5 -O.
(8)Resolution:Consideration of the street closure of Ashworth Dr.between s"St.and 6'"St.]
for November 19,2005 for the installation of the "Waukee Tree Angle"temporary sculpture at
Triangle Park.No action taken on this item.
(9)Resolution:Consideration of the street closure of Walnut St.between s"St.and 6'ft St.for
November 19,2005 for the installation oftlte "Waukee Tree Angle"temporary sculpture at
Triangle Park.Motion by Stanton,seconded by Gruber,to approve the resolution.Roll Call:
Ayes:Stanton,Gruber,Bailey,Mertz,Peard.Nays:None.Motion carried 5 -O.
(10)Resolution:Consideration of directing the installation of sidewalk and storm sewer at
Sugar Creek Apartments along L.A.Grant Parkway.Prior to the motion,Council Member
Bailey questioned the necessity of a resolution and suggested the matter be resolved with a letter
from Mark Arentsen to the property owner directing them to install the sidewalks.Council
Member Mertz saw no reason not to approve the resolution as well.Motion by Bailey,seconded
by Mertz,to approve the resolution.Roll Call:Ayes:Bailey,Mertz,Peard,Gruber,Stanton.
Nays:None.Motion carried 5 -O.
Mayor Oberman asked for a motion to adjourn.Motion by Gruber,seconded by Stanton.Ayes:
All.Nays:None.Motion carried 5 -O.

(4)Resolution:Consideration of the street closure of Ashworth Dr.between 5'"St.and 6th St.
for November 19,2005 for the installation of the "Waukee Tree Angle"temporary sculpture at
Triangle Park.Motion by Bailey,seconded by Mertz,to approve the resolution.Mayor
Oberman asked if Walnut St.would remain open,as the Council had previously passed a
resolution closing that street instead for the installation of the sculpture;Mark Arentsen replied
in the affirmative.Council Member Mertz asked if insurance coverage issues had been
addressed;Mr.Arentsen again replied in the affirmative.Roll Call:Ayes:Bailey,Mertz,Peard,
Gruber.Nays:None.Motion carried 4 -O.
