WAUKEE CITY COUNCIL MINUTES

(A)Call to Order -The regular meeting of the Waukee City Council was called to order by
Mayor Peard at 6:49 p.m.
(B)Roll Call -The following members were present:Mayor Peard and Council Members
Bailey,McGee,Mertz,Stanton,Watts.Absent:None.
(C)CLOSED SESSION -Motion by Council Member Stanton,seconded by Council Member
Mertz,to close the regular session.Roll call:Ayes:Stanton,Mertz,McGee,Watts,Bailey.
Nays:None.Motion carried 5 -O.
Closed Meeting:Held by Council Pursuant to Iowa Code §20.17(3)to discuss the City's
Plan for Union Contract Negotiations -Motion by Council Member Mertz,seconded by
Council Member Stanton,to open the regular session.Roll call:Ayes:Mertz,Stanton,
Watts,McGee,Bailey.Nays:None.Motion canied 5 -O.The Council entered regular
session at 7:16 p.m.

(E)Mayor's Report -Mayor Peard reported that he,the council members and certain City
staff had attended a workshop with Kevin Pokomy ofHR-OneSource.The mayor also had
met with Representative Ralph Watts on several occasions,as well as Jay Byers of the
Greater Des Moines Partnership,regarding Project Destiny.He and Jody Gunderson had
just returned from a successful trip to Washington,D.C.,where the two also met with
Senator Charles Grassley and attended his radio talk show.The mayor then asked for more
citizen volunteers who are needed to make Waukee's overnight RAGBRAl stop a success.
He also reminded those in attendance ofthe upcoming Simon Estes concert on May 5'h and
the RAGBRAI Expo on May 6'h.Also on May 6'h is the city-wide garage sale.The mayor
concluded his report by commending the City employees responsible for making the Sugar
Creek Municipal Golf Course look so inviting.

Motion by Council Member Bailey,seconded by Council Member Stanton,to approve
the Consent Agenda with the removal of items D and H for further discussion.Roll
Call:Ayes:Bailey,Stanton,McGee,Mertz,Watts.Nays:None.Motion carried 5 -O.
Motion by Council Member Bailey,seconded by Council Member Stanton,to approve
consent agenda items D and H.Council Member Bailey asked for clarification on some
points regarding items D and H,specifically as it seemed the proposal would mix two
revenue streams in order to payoff the bonds.He expressed his confusion as to how
the financing would work,as the Downing Development payoff was $100,000.00
greater than needed,and stated that such concerns were less prevalent prior to the
implementation ofTIF districts.John Gibson and Linda Burkhart explained that the
Downing Development payoff was currently an estimate,with the correct amounts to
be provided after property taxes have been assessed;any extra money above and
beyond that amount would be applied toward the University Avenue widening project.I
Council Member Bailey requested a report showing from where all the funds for the
project would come,where they would be applied,and from which TIF district they

would come.He then asked why older businesses such as Olson Brothers and
Heartland Co-op were included in a TIF district;Jody Gunderson explained that all
downtown business had been included in a TIF district in order to finance the
downtown redevelopment project and that the City would only collect those funds
based on increase valuation of the properties.Roll call:Ayes:Stanton,Mertz,Watts,
McGee.Nays:Bailey.Motion carried 4 -1.
2)Ordinance:Consideration of approval of an ordinance to amend Chapter 301,Zoning
Ordinance,City of Waukee,Iowa by changing certain specifics of the Glynn Village
Planned Development Narrative by deleting Glynn Village Planned Development
Exhibit "A"and by inserting in lieu thereof a revised Exhibit "A";and amend the
Official Zoning Map to show rezoning [second readingj-Motion by Council Member
Watts,seconded by Council Member Stanton,to approve the second reading in title only,
waive the third reading,and place the ordinance on final passage.Brad Deets briefed the
Council on the changes made to the planned development narrative since the ordinance
was introduced and the first reading approved.The changes include a 20%minimum
hard surface requirement on the front elevation of the townhomes with accent brick on
the side and rear elevations,and a 20%minimum hard surface requirement on all
elevations of the clubhouse.The changes to the townhome requirements would make it
consistent with the requirements of an R-4 Row Dwelling and Townhome district.Mr.
Deets then distributed renderings showing a basement egress window on the southern
side of all units on the north side of SE Booth Ave.Council Member Mertz asked for
clarification as to the location of the egress windows in relation to the front porches of the
units.He then stated that certain areas of stone on the clubhouse could be increased to
surround the windows,thereby increasing the hard surface percentage.At this point,Joe
Pietruszynski of Hubbell Realty addressed the Council to introduce architect Greg
Wattier ofG.E.Wattier Architects.Mr.Wattier explained the interior layout of the
clubhouse,as well as black wrought-iron fencing proposed around the perimeter of the
structure and the use of different colors and widths of siding.Council Member Bailey
asked about the proposed parking areas;Mr.Wattier explained that there would be
parking off the street as well as off the alley,adding up to 33 total parking spaces.The
townhomes were then discussed,with designer Matt Hackett of Hubbell Realty
describing the egress windows and explaining that the lower level of the units on the
north side of SE Booth Ave.would include finished living space.He also stated that
plantings would be added around the egress window wells.Both Mr.Hackett and Mr.
Pietruszynski stated that the units would resemble those existing in the Creekside
development in Ankeny.Council Member McGee expressed concern that the plantings
around the window wells might interfere with means of egress;Mr.Deets stated that the
Code Compliance office had reviewed the concept and it would meet egress
requirements.Council Member Bailey asked if cultured stone was an approved hard
surface material;Mr.Deets replied in the affirmative.Council Member Watts amended
his motion to approve the second reading of the ordinance,waive the third reading,and
place the ordinance on final passage provided the narrative is amended to change all
references to masonry to "brick or cultured stone,"and that the developer present for
review a more accurate depiction of the look of the egress window wells;Council
Member Stanton amended the second.Council Member Mertz asked where the hard

surface material would be located on the front elevation of the townhomes;Mr.Hackett
pointed out the areas,including the porch roof piers.There was additional discussion on
the hard surface requirement for the townhomes.Roll call:Ayes:Watts,Stanton,Bailey,
Mertz,McGee.Nays:None.Motion carried 5 -O.Becky Schuett read the ordinance in
title only;Mayor Peard declared the ordinance duly adopted.
3)Resolution:Consideration of approval of the site plan for Glynn Village Clubhouse ~
Motion by Council Member Bailey,seconded by Council Member Mertz,to approve the
resolution.Roll call:Ayes:Bailey,Mertz,McGee,Stanton.Nays:Watts.Motion
carried 4 -1.
4)Resolution:Consideration of approval of the site plan for Glynn Village Townhomes>-
Motion by Council Member Mertz,seconded by Council Member Stanton,to approve the
resolution subject to final review of the egress window wells.Roll call:Ayes:Stanton,
Mertz,Watts,McGee,Bailey.Nays:None.Motion carried 5 ~O.
5)Resolution:Consideration of approval of the site plan amendment for Williams Pointe
Condominiums -Motion by Council Member Stanton,seconded by Council Member
McGee,to approve the resolution,After a brief discussion,Council Member Stanton
amended the motion to approve the resolution provided the uplights for the fireplaces are
fully shielded;Council Member McGee amended the second.Roll call:Ayes:Stanton,
McGee,Mertz,Watts,Bailey.Nays:None.Motion carried 5 -O.
6)Resolution:Consideration of approval of the site plan for Community State Bank-
Motion by Council Member Watts,seconded by Council Member Mertz,to approve the
resolution.Council Member McGee wondered if the number of banks along the
University Avenue corridor had reached a saturation point;Jody Gunderson anSWered]
that the state grants bank charters based on many criteria,including the number of banks
within a given area.Council Member Stanton stated that the proposed wall pack lights
must be fully shielded.Brad Deets stated that the property owner had consented to sign a
petition and waiver for future University Ave.improvements,but that the executed
waiver had not yet been received by the City.Council Member Watts amended the
motion to approve the resolution provided a signed petition and waiver for University
Ave.improvements is received;Council Member Mertz amended the second.Roll call:
Ayes:Watts,Mertz,Stanton,Bailey,McGee.Nays:None.Motion carried 5 -O.
7)Resolution:Consideration of approval of the Mosquito Control Proposal from Wilson
Bros.Pest Control ~Motion by Council Member Stanton,seconded by Council Member
Mertz,to approve the resolution.Roll call:Ayes:Stanton,Mertz,McGee,Watts,Bailey.
Nays:None.Motion carried 5 -O.
8)Resolution:Consideration of approval of the Sugar Creek Municipal Golf Course
Policy and Procedures Manual ~Motion by Council Member Stanton,seconded by
Council Member Mertz,to approve the resolution.After a brief discussion,Council
Member Stanton amended the motion to approve the resolution provided all references to
individual employees by name be replaced with job titles;Council Member Mertz
amended the second.Roll call:Ayes:Stanton,Mertz,Watts,Bailey,McGee.Nays:
None.Motion carried 5 ~O.
9)Resolution:Consideration of approval of clarifying the language in Section 220 of the
City of Waukee Personnel Policy and Procedure Manual ~Motion by Council Member I

10)Ordinance:Consideration of approval of an ordinance to amend Chapter 301,Zoning
Ordinance,City of Waukee,Iowa by rezoning and changing certain property therein
from A-I [Agricultural District]to C-l [Community and Highway Service Commercial
District],and amend the Official Zoning Map to show rezoning (a parcel to be known
as the Scaglione property)[second reading]-Motion by Council Member Watts,
seconded by Council Member Bailey,to approve the second reading in title only,waive
the third reading,and place the ordinance on final passage.Roll call:Ayes:Watts,
Bailey,Stanton,McGee,Mertz.Nays:None.Motion carried 5 -O.Becky Schuett read
the ordinance in title only;Mayor Peard declared the ordinance duly adopted.
11)Ordinance:Consideration of approval of an ordinance enacting Chapter 204A titled
"Storm Water Management Utility"establishing the storm water management utility,
establishing the storm water management district,providing for its management and
operation,and establishing and imposing rates;and procedures for collecting rates for
storm water management within the corporate limits of the City of Waukee,Iowa [intro
and first reading]-Council Member Stanton introduced the ordinance;motion by
Council Member Bailey,seconded by Council Member McGee,to approve the first
reading in title only.Council Member Bailey stated that the Utilities Committee had
reviewed and approved the ordinance last year.John Gibson explained that a public
forum meeting regarding the proposed ordinance will be held on May 10,2006 at 7:00
p.rn.in the Council Chambers.Council Member Bailey asked if there were any areas in
the city that would need attention first once the ordinance is adopted;Mr.Gibson replied
that the Little Walnut Creek Dr.crossing in Sahu Acres was an area of concern,Council
Member Bailey also mentioned his concern with the area to the east of the Public Safety
Building.Mr.Gibson then explained that the fees associated with the utility will be
triggered at the time of water meter installation.Council Member Mertz expressed
concern about runoff and silt fencing;Mr.Gibson explained that such matters would be
addressed as part of a construction site ordinance to be proposed at a later date.Roll call:
