WAUKEE CITY COUNCIL MINUTES
June 19,2006
(A)Call to Order -The regular meeting of the Waukee City Council was called to order by
Mayor Pro Tern Stanton at 7:05 p.m.
(B)Pledge of Allegiance
(C)Roll Call-The following members were present:Council Members Bailey,McGee,
Mertz,Stanton,Watts.Absent:Mayor Peard,
(D)Open Forum -No one addressed the Council during the Open Forum.
(E)Agenda Approval-Motion by Council Member Mertz,seconded by Council Member
McGee,to approve the agenda.At the suggestion of John Gibson,Council Member Mertz
amended the motion to approve the agenda with the removal of items JlC,JlD and J4;
Council Member McGee amended the second.Roll call:Mertz,McGee,Bailey,Stanton,
Watts.Nays:None.Motion carried 5 -O.
(F)Mayor's Report -Mayor Pro Tern Stanton had no report.
(G)Presentations:
1)ReceivelFile:Union negotiation summary -Motion by Council Member Bailey,
seconded by Council Member Mertz,to receive and file the summary.Roll call:Ayes:
Bailey,Mertz,McGee,Stanton,Watts.Nays:None.Motion carried 5 -O.Council
Member Stanton stated that the summary was now public record.
(H)Public Hearings:
1)On amending Chapter 301,Zoning Ordinance,City of Waukee,Iowa,by rezoning
and changing certain property therein from A-I [Agricultural District]to R-l [Single
Family Residential District],R-2 [One and Two Family Residential District],R-3A
[Owner-Occupied Multi-Family Residential District],R-4 [Row Dwelling and
Townhome Dwelling District]and C-IA [Neighborhood Commercial District];and
then by rezoning and changing certain property therein from C-IA [Neighborhood
Commercial District]to PD-I [Planned Development Overlay District];and amend
the Official Zoning Map to show rezoning [a parcel to be known as Fox Creek
Estates]-Mayor Pro Tem Stanton opened the pnblic hearing and asked if any written
correspondence regarding the rezoning had been received.John Gibson responded that
two letters in protest of the rezoning had been received:one from Mark Trost of
Stanbrough Development dated June 3,2006 and one from Sreeroopa Sarkar,a resident
of Gracewood,dated June 15,2006.Motion by Council Member Mertz,seconded by

Council Member Watts,to receive and file the protests.Roll call:Ayes:Mertz,Watts,
Bailey,McGee,Stanton.Nays:None.Motion carried 5 -O.At this time,Mark Lee of
Lee Engineers and Surveyors addressed the Council.Also in attendance were Clark
Kramme with Fox Creek Estates,architect Russ Ver Ploeg,and Matt Thomas of Lee
Engineers.Mr.Lee presented an overview of the project,including the proposed
Douglas Pkwy.extension.He stated that the proposed rezoning followed the future
land use plan,with higher density housing to the south and lower density to the north.
In response to the filed protests of neighboring property owners,Mr.Lee explained that
due to the topography of the mea,only the roofs of the single-story townhome units
along the southern border would be visible from Gracewood.Mr.Lee then discussed
sanitary sewer for the parcel and a possible lift station to move the flow to the existing
lift station at Hickman Rd.and 4th St.Council Member Bailey mentioned several
issues he had with the rezoning applications,such as higher density housing in the
southern portion of the parcel,the proposed Douglas Pkwy.aligrnnent not agreeing
with the Major Streets Plan,and the unresolved sanitary sewer issue.He asked the
Council to carefully review the application.Brad Deets spoke to Council Member
Bailey's concerns,explaining that the Douglas Pkwy.alignment is consistent with the
Major Streets Plan in regard to the topography of the area;he also stated that shifting
Douglas Pkwy.to the north would place it on the Waukee/Clive border and may cause
issues.He then stated that the sanitary sewer issue could not effectively be resolved
until the rezoning was approved,as much of the planning would depend on housing
density in the area.Mr.Deets also stated that there was limited access to the parcel
from Gracewood,which could make it difficult to continue single family housing along
the southern border of the parcel.The developer has also agreed to additional buffering
beyond that dictated by City ordinance.Council Member Mertz reminded the Council
that when the Gracewood plat was approved,it was agreed to limit access from
Gracewood as that developer anticipated multi-family uses to be constructed to the
north.Council Member Mertz then asked if neighboring property owners were aware
of the proposed alignment of Douglas Pkwy.;Mr.Deets replied that City staff had been
meeting with all affected property owners regarding the aligrnnent.He stated that the
City of Clive had also been made aware of the proposed alignment.Council Member
Stanton asked if a gravity sewer would better serve Fox Creek Estates;John Gibson
replied that due to the anticipated use a gravity sewer would be more cost effective than
a lift station.He then explained that the City of Clive agreed to possibly allow a
connection to their city's sanitary sewer,and that more information regarding costs and
engineering was anticipated.Council Member Bailey asked iflower density in Fox
Creek Estates would equate to higher sanitary sewer capacity;Mr.Gibson replied in the
affirmative,but stated that a lift station would still need to be constructed.In response
to a question regarding the timeline for development,Mr.Lee stated that the developer
hoped to break ground this season,with the underground work completed this year.
The first phase of development would include NE Whitetail Ln.to north of Douglas
Pkwy.and the property to the west of that line.Mr.Deets stated that the narrative for
the proposed PD-I parcel included the basic requirements,and that the specifics would
be resolved prior to the third reading of the rezoning application.Council Member
Bailey requested a map showing how the parcel aligned with surrounding property,
written confirmation that Silver Oaks Enterprises agreed with the alignment of Douglas

Pkwy.,and information regarding possible drainage issues along the proposed Douglas I
Pkwy.corridor.At this point,architect Russ Vel'Ploeg addressed the Council and gave
a general overview of the proposed PD-I zoning request,including parking,green
space,outside storage and architectural issues.Council Members Mertz and McGee
both stated their willingness to be flexible regarding hard surface requirments,but that
they would first need to see what was being proposed.Council Member Bailey stated
that the proposed green space did not seem adequate;Mr.Deets answered that the
amonnt of green space proposed exceeded the minimum requirements,and that a large
park was proposed in the southeast comer of the plat.Council Member Mertz asked for
clarification on the locations of bike trails;Mr.Lee reviewed the bike trail locations.
Council Member Stanton requested more trees in the parking area of the mixed use
portion,Council Member Mertz expressed concern regarding the driveway connections
with NE Whitetail Ln.Mayor Pro Tem Stanton declared the public hearing closed.
2)On an ordinance to amend Chapter 301,Zoning Ordinance,City of Waukee,Iowa,
by amending Section 301.32,Amendments,by repealing said section and enacting in
lieu thereof provisions for rezoning procedures and requirements for property -
Mayor Pro Tern Stanton opened the public hearing and asked if any written
correspondence regarding the ordinance had been received;John Gibson replied in the
negative.Mayor Pro Tem Stanton asked if anyone present wished to address the
Council on the issue;no one present addressed the Council.Mayor Pro Tem Stanton
declared the public hearing closed.

the resolution.Council Member Bailey expressed his disappointment in recent Stivers
Ford advertising regarding the location of the dealership.Brad Deets gave a brief
overview ofthe site plan,stating that the temporary facility would be removed prior to
the issuance of a complete certificate of occupancy for the permanent used car facility.
Council Member McGee stated that he was also offended by the recent Stivers Ford
advertising.Council Member Watts stated that used car sales had always been done from
the main dealership building,and he did not see the need for the temporary facility;

Council Member Mertz agreed.Doug Grassman of Stivers Ford addressed the Council,
