WAUKEE CITY COUNCIL MINUTES
July 24,2006
(A)Call to Order -The regular meeting ofthe Waukee City Council was called to order by
Mayor Peard at 7:02 p.m.in the Council Chambers at City Hall.
(B)Pledge of Allegiance
(C)Roll Call-The following members were present:Mayor William F.Peard;Council
Members Don L.Bailey,Jr.;C.Isaiah McGee;JeffV.Mertz;Darlene Stanton;Mike
Watts.Absent:None.
(D)Open Forum
(E)Agenda Approval-Motion by Council Member Stanton,seconded by Council Member
Mertz,to approve the agenda,moving item JIE to 12A.Roll call:Ayes:Stanton,Mertz,
Bailey,Watts,McGee.Nays:None.Motion carried 5 -O.
(F)Mayor's Report -Mayor Peard reviewed the RAGBRAI route and schedule and
encouraged Waukee's citizens to make the RAGBRAI participants feel welcome.He then
read aloud a letter of welcome to the participants of the event,and also thanked the
RAGBRAI committee and volunteers for their hard work.

(H)Public Hearings:
1)On amending Chapter 301,Zoning Ordinance,City of Waukee,Iowa,by rezoning
and changing certain property therein from C-l [Community and Highway Service
Commercial District}to C-IB [Large Scale Commercial District},C-4 [Office Park
Commercial District}and R-4 [Row Dwelling and Townhome Dwelling District];and
amend the Official Zoning Map to show rezoning [a parcel to be known as The
Crossing at Alice's Road}-Mayor Peard opened the public hearing and asked if any
written correspondence regarding the ordinance had been received;John Gibson replied
in the affirmative.Motion by Stanton,seconded by Mertz,to receive and file the July
11,2006,letter from Angie Jensen,650 Redbud Ct.,in opposition of the rezoning
application.Mayor Peard asked if anyone present wished to address the Council on the
issue;no one present addressed the Council.Mayor Peard declared the public hearing
closed.
2)On amending Chapter 301,Zoning Ordinance,City of Waukee,Iowa,by rezoning
and changing certain property therein from A-I [Agricultural District}to R-2 [One
and Two Family Residential District},R-3 [Rental Multi-Family Residential District},
R-4 [Row Dwelling and Townhome Dwelling District},and C-4 [Office Park
Commercial District]Row Dwelling and Townhome Dwelling District};and amend
the Official Zoning Map to show rezoning [a parcel owned by Silver Oak Enterprises
LLC}-Mayor Peard opened the public hearing and asked if any written
correspondence regarding the ordinance had been received;John Gibson replied in the
negative.Mayor Peard asked if anyone present wished to address the Council on the
issue;Tom Wittman of Civil Engineering Consultants (CEC)addressed the Council to
answer any questions.Mayor Peard declared the public hearing closed.I

Stanton,Mertz,McGee,Watts,Bailey.Nays:None.Motion carried 5 -O.Becky
Schuett read the ordinance in title only.

3)Resolution:Consideration of approval of a Surface Water Flowage Easementts)
conveyed from Warren and Jodi Page to the City of Waukee,Iowa -Motion by Council
Member Watts,seconded by Council Member McGee,to approve the resolution.John
Gibson explained that the existing 30-foot easement would remain,with the addition of a
IS-foot easement on the Page property.City Engineer Mik Briedis addressed the Council
to explain the surface water flowage in the area,stating that the IS-foot easement would
allow for the City to install a future drainage culvert if needed.He also sstated that the
Council could consider eliminating all of the flowage easements in this particular area,as
the drainage did not follow the easements as approved with the final plat.Mr.Dunn's
proposed in-ground swimming pool would not impact the drainage in the area.Council
Member Stanton requested a formal study by the City Engineer regarding the flowage
prior to approval,and asked if a drainage swale should be installed in the area.Mr.
Briedis replied that the City would need a compelling argument in order to install a
swale,and that there had been no known complaints regarding drainage from the affected I

Ave.There was some discussion as to the temporary road;Brad Deets explained that the
road was temporary in anticipation ofthe future realignment of Ute Ave.lR-22.Mr.
Gibson stated that the City was negotiating with the developer regarding the paving of
