(A)Call to Order -The regular meeting of the Waukee City Council was called to order by
Mayor Peard at 7:05 p.m.in the Council Chambers at City Hall.

(C)Roll Call-The following members were present:Mayor William F.Peard;Council
Members JeffV.Mertz;Darlene Stanton;Mike Watts.Absent:Don L.Bailey,Jr.;C.
Isaiah McGee.

(F)Mayor's Report -Mayor Peard reported that he'd attended an MFO meeting on October
19,the Citizen ofthe Year reception on October 23,and the City Council workshop
meeting on October 25.He then reminded everyone that November 7 was Election Day and
encouraged all to vote.

2)Public Hearing:011 the annexation of both consenting and non-consenting properties
by the City of Waukee,Iowa -Mayor Peard opened the public hearing and asked if any
written correspondence regarding the ordinance had been received;City
Administrator/Clerk Kooistra replied in the negative.Mayor Peard asked if anyone
present wished to address the Council on the issue;no one present addressed the Council.
Mayor Peard declared the public hearing closed.
3)Resolution:Consideration of approval of the annexation of both consenting and non-
consenting properties by the City of Waukee,Iowa -Motion by Council Member
Stanton,seconded by Council Member Watts,to approve the resolution.Director of
Community Development Gunderson reviewed the annexation process to date.Council
Member Watts asked how the city might obtain voluntary annexation petitions from the
three remaining non-consenting property owners;Mr.Gunderson replied that City staff
would work toward that goal prior to the November 20,2006 regular City Council
meeting.Rita Garland,3221 Ute Ave.,addressed the Council with questions regarding
the requested sewer easement on her property and whether any of the other properties in
the annexation area along Ute Ave.were required to have such easements.City Engineer
Briedis and Director of Public Works Gibson explained that the trunk sewer meant to
service the area had been designed,but not the lateral lines.In order to run sewer lines for
the Sunset Ridge subdivision,a tentative agreement had been reached with the Taggart
property owners regarding the location of an easement across that property,which would
then allow sewer accessibility for the Garland property.Roll call:Ayes:Stanton,Watts,

4)Mayor's Appointment:Of a Council Member as council representative to the Board
of Appeals -Mayor Peard appointed Council Member Stanton as council representative

6)Resolution:Consideration of approval of the site plan for Waukee Schools Baseball
and Softball Complex -Motion by Council Member Watts,seconded by Council
Member Stanton,to approve the resolution.Director of Planning Deets gave some
history on the purple color of the roofing material on the existing batting
facility/concession stand and explained that the developer wished to use that smne purple
on the proposed complex.Council Member Watts felt that the purple roofing material
was acceptable on the school district's sports buildings,but that it would not be
appropriate on academic and administrative buildings.Jim Duey,activities director for
the Waukee Community School District,addressed the council regarding the shade of the
roofing material.Council Member Stanton expressed concern over the location of the
proposed 6-foot fence and requested that it be relocated out of the city right-of-way;Mr.
Deets explained that the fence location was acceptable to City staff at this time,but that it
would need to be relocated when Warrior Lane is widened.Roll call:Ayes:Watts,

approve the resolution.Director of Planning Deets explained that the report concluded
the first phase of the key intersections project and that the next step would be approval of
engineering contracts in order to implement the designs.Council Member Watts stated
his concern with the crosswalks planned across multiple lanes of traffic.Council
Member Mertz suggested that landscape maintenance be addressed in the City ordinance

certain language so that the City may extend the deadline for completing corrective
action at the City's sole discretion [introduction and first reading]-Council Member
Watts introduced the ordinance;motion by Council Member Stanton,seconded by
Council Member Mertz,to approve the first reading of the ordinanceintitleonly,
Council Member Stanton questioned how the ordinance would be enfcroed-consistently.
After some discussion,Council Member Stanton amended the motion to approve the first
reading of the ordinance in title only,waive the second and third readings through the
suspension ofIowa Code §380.3,and place the ordinance on final passage;Council

SectioIl207A11,Golf Course Prices,by adding as subsection H'provisions for

regulations governing and rates to be charged for the rental of the golf course
clubhouse [second reading]-Motion by Council Member Watts,seconded by Council
Member Stanton,to approve the second reading of the ordinance in title only.Council
Member Watts expressed concern regarding who would serve beverages and how that
person would be paid for their time,requesting that the issues be addressed in the
ordinance.Council Member Mertz replied that the issues could be addressed in the rental
agreement.Council Member Stanton requested that language be included in the
ordinance that would limit rental of the clubhouse to dates and times during the off-
season.Director of Public Works Gibson stated that the availability of the clubhouse for
rental would be at the sole discretion of the Park and Recreation Department and that fees
would be proposed in the rental agreement unless the City Attorney felt they would be
better addressed in the ordinance.City staff will review the ordinance and rental
