WAUKEE CITY COUNCIL MINUTES
November 20,2006
(A)Call to Order -The regular meeting of the Waukee City Council was called to order by
Mayor Peard at 7:03 p.m.in the Council Chambers at City Hall.
(B)Pledge of Allegiance
(C)Roll Call-The following members were present:Mayor William F.Peard;Council
Members Don L.Bailey,Jr.;C.Isaiah McGee;Mike Watts.Absent:JeffV.Mertz;
Darlene Stanton.
(D)Open Forum.
(E)Agenda Approval-Motion by Council Member McGee,seconded by Council Member
Watts,to approve the agenda with the removal of item #J1N.Roll call:Ayes:McGee,
Watts,Bailey.Nays:None.Absent:Mertz,Stanton.Motion carried 3 -0 -2.
(F)Mayor's Report -Mayor Peard reported his attendance at a MIALG meeting on
November 13 with City Administrator/Clerk Kooistra,and an MPO meeting on November
16 where the western bypass was discussed.He then encouraged people to attend one of
several public input meetings to be held by the MPO regarding proposed corridors to meet
future transportation needs.The Mayor next passed along the thanks of Robyn Stottlemyer
to the fire and police departments for their quick response to an early morning fire at her
place of business.Finally,Mayor Peard wished all a happy Thanksgiving.

(H)Public Hearings:
1)On an ordinance to amend Chapter 301,Zoning Ordinance,City of Waukee,Iowa,
by amending Section 301.27,Parking Regulations,by repealing said section and
enacting in lieu thereof parking regulations and requirements for specific uses -
Mayor Peard opened the public hearing and asked if any written correspondence had
been received;City Administrator Kooistra replied in the negative.Mayor Peard asked
if anyone present wished to address the Council on the issue;no one present addressed
the Council.Council Member Bailey spoke briefly on the proposed parking regulations
for flex space construction.Mayor Peard declared the public hearing closed.

title only.Director of Planning Deets reviewed the ordinance,specifically the proposed
parking regulations for flex space construction.Roll call:Ayes:Bailey,McGee,Watts.
Nays:None.Absent:Mertz,Stanton.Motion carried 3 -0 -2.Deputy City Clerk

Motion by Council Member Watts,seconded by Council Member McGee,to approve
the consent agenda.Roll call:Ayes:Watts,McGee,Bailey.Nays:None.Absent:
Mertz,Stanton.Motion carried 3 -0 -2.
2)Resolution:Consideration of approval of the preliminary plat for Walnut Cove-
Motion by Council Member Watts,seconded by Council Member Bailey,to approve the
resolution.Director of Planning Deets gave an overview of the project,including the
recommendation that a City staff member be present when grading begins in order to
supervise the removal of mature trees.Sue Seidenfeld,840 Locust St.,addressed the
Council with concerns regarding the proposed plat,specifically related to increased
traffic and noise,the location of her driveway in relation to the proposed cul-de-sac,
drainage issues,snow removal and the removal of mature trees.Joe Copeland,owner of
the property abutting the proposed plat to the west,addressed the Council with concerns
regarding the possible disturbance of the existing fencing between the two properties.
Council Member Bailey stated that he would not support the resolution due to high
density and an odd configuration of lots.Council Member McGee expressed his concern
with the high density and possible loss of mature trees,and stated that the proposed plat
did not seem to fit in with the character of the rest of the neighborhood.Council Member I

Watts agreed with Council Member McGee.Jesse Duff of Cooper Crawford and
Associates and Paul Kester of Kozy Development addressed the Council,giving the
history of the development of the proposed plat.Mr.Kester stated that the development
would be handicapped-accessible,senior living homes which would generate less traffic.

4)Resolution:Consideration of approval of obligating funds from the Urban Renewal
Tax Revenue Fund for appropriation to the payment of annual appropriation tax
increment financed obligations which shall come due in the next succeeding fiscal year
[Waukee EBPJ -Motion by Council Member Watts,seconded by Council Member
McGee,to approve the resolution.Director of Finance Burkhart stated that new
certification forms were required by the state.Council Member Bailey asked for what
purpose ally additional funds would be earmarked;Ms.Burkhart replied that such monies
would remain in the reserve fund.Council Member Bailey expressed concern that the
proposed resolution was vague.Roll call:Ayes:Watts,McGee,Bailey.Nays:None.

6)Resolution:Consideration of approval of obligating funds from the Urban Renewal
Tax Revenue Fund for appropriation to the payment of annual appropriation tax
increment financed obligations which shall come due in the next succeeding fiscal year
[Waukee 2000J -Motion by Council Member Watts,seconded by Council Member
McGee,to approve the resolution including a provision for the release of 0%of the
