(A)Call to Order -The regular meeting of the Waukee City Council was called to order by
Mayor Peard at 7:01 p.m.in the Council Chambers at City Hall.
(B)Pledge of Allegiance
(C)Roll Call -The following members were present:Mayor William F.Peard;Council
Members Don L.Bailey,JI.;C.Isaiah McGee;JeffV.Mertz;Darlene Stanton.Absent:
Mike Watts.

(E)Agenda Approval-Motion by Council Member McGee,seconded by Council Member
Bailey,to approve the agenda with the removal of item #J2.Roll call:Ayes:McGee,
Bailey,Mertz,Stanton.Nays:None.Absent:Watts.Motion carried 4 -0 -I.
(F)Mayor's Report -Mayor Peard expressed the City's sorrow upon the passing of Mike
Myers,chairman of Regency Homes.He then stated his pleasure regarding the Waukee
Visitors Guide published by the Des Moines Business Record,calling it an important
economic development tool.On November 29,Mayor Peard attended a public input
meeting regarding the MPO's proposed regional corridors plan,where he read a statement
into the record of the meeting that the City of Waukee did not support the recommended
proposal,as it ignored the transportation needs of the western suburbs.Mayor Peard will
attend a meeting on December 5 in Ade1 regarding the western bypass;the meeting was
called for by the City of Waukee and will be facilitated by the Dallas County Development
Alliance.Lastly,Mayor Peard praised the people and groups responsible for a successful
Winterfest.

Motion by Council Member Stanton,seconded by Council Member Mertz,to approve
the consent agenda.Roll call:Ayes:Stanton,Mertz,Bailey,McGee.Nays:None.

3)Resolutlon:Consideration of approval of the preliminary plat for Waukee Vista
Commercial Park -Motion by Council Member Stanton,seconded by Council Member
McGee,to approve the resolution.Director ofPlauning Deets gave a brief overview of
the plat.Council Member Stanton complimented the developer on the amount of green
space for the Sherwin Williams site plan.Council Member Mertz stated his desire to see
sidewalks installed along Laurel Street and expressed his disappointment that a
development agreement was not being considered for the plat.Roll call:Ayes:Stanton,
McGee,Bailey,Mertz.Nays:None.Absent:Watts.Motion carried 4 -0 -1.
(Resolution #06-239)
4)Resolution:Consideration of approval of the final plat for Waukee Vista Commercial
Park -Motion by Council Member Stanton,seconded by Council Member Bailey,to
approve the resolution.Director of Planning Deets gave a brief overview ofthe plat and
stated that the developer had posted bonds with the City of outstanding improvements.
Council Member Stanton asked if any city ordinances addressed sidewalk installation for
commercial properties;Mr.Deets explained that the ordinances only applied to
residential sidewalks.Council Member Mertz suggested that commercial sidewalks be
addressed in the site plan ordinance.Council Member Bailey asked if there were any
development plans for the remaining four lots of the plat;Alan Rivers of Vista Real
Estate and a managing partner of Waukee Partners Partnership addressed the Council,
stating that there had been some interest in the remaining lots.Mr.Rivers then said that
the installation of sidewalks would not pose a problem if it were done once all lots were
developed.Director of Public Works Gibson explained the City policy that commercial
sidewalks are installed when the abutting properties install sidewalks,or at the City's
request.Motion by Council Member Bailey,seconded by Council Member Stanton,to
amend the motion to approve the resolution so that sidewalks shall be constructed along

Laurel Street across all lots of the plat when the lots abutting either end of the plat have
constructed sidewalks,or at the request of the City.Mr.Rivers stated that such a
requirement was possibly detrimental to the development.There was some discussion
regarding sidewalk requirements for other existing commercial developments within the
community.Mr.Rivers then asked the Council to address the outstanding issues
regarding the frontage road along Hickman Rd.;Council Member Bailey requested a
report from City staff on the matter.Roll call on the amendment to the motion:Ayes:
Bailey,Stanton,McGee,Mertz.Nays:None.Absent:Watts.Motion carried 4 -0 -1.

5)Resolution:Consideration of approval of the site plan for Sherwin Williams -Motion
by Council Member Stanton,seconded by Council Member McGee,to approve the
resolution.Director of Planning Deets gave a brief overview of the proj ect.Chuck
Bishop of Bishop Engineering addressed the Council,presenting color samples of the
exterior elevations.Council Member Mertz requested a corrected footprint of the
building to reflect changes in the location of the canopy along the eastern elevation.
Council Member Stanton asked if all lots within Waukee Vista Commercial Park would
share a detention pond;Mr.Bishop replied that it would not be known until the other lots
developed.Roll call:Ayes:Stanton,McGee,Bailey,Meltz.Nays:None.Absent:
Watts.Motion carried 4 -0 -1.(Resolution #06-241)
6)Resolution:Consideration of approval of a request for a one-year extension of the City
of Waukee,Iowa,REAP Grant #05-R4-NF in the amount of $1 00,000 -Motion by
Council Member Stanton,seconded by Council Member McGee,to approve the
resolution.Director of Public Works Gibson briefly explained the request.Roll call:
Ayes:Stanton,McGee,Bailey,Mertz.Nays:None.Absent:Watts.Motion carried 4 -0

7)Ordinance:Consideration of approval of an ordinance to amend Chapter 301,Zoning
Ordinance,City of Waukee,Iowa,by amending Section 301.27,Parking Regulations,
by repealing said section and enacting in lieu thereof parking regulations and
requirements for specific uses [second reading]-Motion by Council Member Bailey,
seconded by Council Member Stanton,to approve the second reading in title only.Roll
call:Ayes:Bailey,Stanton,McGee,Meltz.Nays:None.Absent:Watts.Motion carried
4 -0 -1.Deputy City Clerk Schuett read the ordinance in title only.
8)Resolution:Consideration of approval of the Telecommunications Space Lease
between the City of Waukee,Iowa,and the Waukee Community School District-
Motion by Council Member Stanton,seconded by Council Member McGee,to approve
the resolution.Director of Public Works Gibson gave a brief overview of the agreement.
Roll call:Ayes:Stanton,McGee,Bailey,Meltz.Nays:None.Absent:Watts.Motion
carried 4 -0 -1.(Resolution #06-242)
