AN ORDINANCE TO AMEND CHAPTER 169, ZONING ORDINANCE, CITY OF WAUKEE,
IOWA BY AMENDING THE ZONING FROM A -I (AGRICULTURAL DISTRICT) TO R-2
(ONE AND TWO FAMILY RESIDENTIAL DISTRICT) FOR CERTAIN PROPERTY
[ASHLEY ACRES]
BE IT ORDAINED by the Council of the City of Waukee:
Section 1. Section 169.02 of Chapter 169, Waukee Municipal Code, Zoning Ordinance of
the City, adopting the Official Zoning Map, is hereby amended by amending the Zoning from A-1
(Agricultural District) to R-2 (One and Two Family Residential District) for property legally described
as follows:
PART OF THE SOUTHEAST QUARTER OF SECTION 21, TOWNSHIP 79 NORTH, RANGE 26
WEST OF THE 5 "' P.M., DALLAS COUNTY, IOWA AND MORE PARTICULARLY DESCRIBED
AS FOLLOWS:
BEGINNING AT THE EAST QUARTER CORNER OF SAID SOUTHEAST QUARTER; THENCE
SOUTH 00008'30" WEST ALONG THE EAST LINE OF SAID SOUTHEAST QUARTER, 1,581.58
FEET; THENCE NORTH 89021'30" WEST, 33.00 FEET TO THE NORTHEAST CORNER OF
BORMANN SUBDIVISION, AN OFFICIAL PLAT; THENCE CONTINUING NORTH 89021'30''
WEST ALONG THE NORTH LINE OF SAID BORMANN SUBDIVISION, 867.50 FEET TO THE
NORTHERLY LINE OF SAHU ACRES, AN OFFICIAL PLAT; THENCE NORTH 18008'30" WEST
ALONG SAID NORTHERLY LINE, 35.80 FEET, THENCE NORTH 70043'30" WEST
CONTINUING ALONG SAID NORTHERLY LINE, 625.00 FEET; THENCE NORTH 011138'00

THE PROPERTY IS SUBJECT TO ANY AND ALL EASEMENTS OF RECORD.
Section 2. Repealer. All ordinances or parts of ordinances in conflict with the provisions of
this ordinance are hereby repealed.
Section 3. Severability Clause. If any section, provision or part of this ordinance shall be
adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a
whole or any section, provision, or part thereof not adjudged invalid or unconstitutional.
Section 4. Effective Date. This ordinance shall be in effect upon its final passage, approval
and publication as provided by law.
