WAUKEE CITY COUNCIL MINUTES
June 15, 2020
*Due to public health concerns and guidance, in accordance with Iowa Code Sections
21.4(1)(b) and 21.8, this meeting of the Waukee City Council was conducted electronically as
holding the meeting in person was impossible or impractical.
(A) Call to Order — The regular meeting of the Waukee City Council was called to order by Mayor
Clarke at 5:30 p.m. at Waukee City Hall, 230 W. Hickman Rd. and electronically via Zoom
pursuant to the electronic meeting provisions of Iowa Code Sections 21.4(1)(b) and 21.8.
(B) Pledge of Allegiance (temporarily suspended)
(C) Roll Call — The following members were present: Mayor Courtney Clarke; Council Members
Anna Bergman (electronically), R. Charles Bottenberg (electronically), Chris Crone, Larry R.
Lyon (electronically), Ben Sinclair. Absent: None.
Also in attendance: City Administrator Tim Moerman, Finance Director Linda Burkhart,
Development Services Director Brad Deets, Parks & Recreation Director Matt Jermier,
Marketing & Communications Director Summer Evans, Human Resource Director Michelle
Lindsay, IT Director Son Le (electronically), Police Lt. Scott Cunningham, City Clerk Rebecca D.
Schuett, City Attorney Steve Brick (electronically).

(E) Agenda Approval — Council Member Lyon moved to approve the agenda; seconded by Council
Member Crone. Results of vote: Ayes: Bergman, Bottenberg, Crone, Lyon, Sinclair. Nays:
None. Motion carried 5 — 0.

(G) Public Hearings:
1) On an ordinance to amend Chapter 169, Zoning Ordinance, City of Waukee, by
rezoning and changing certain property therein to modify PDA, a property known as
Painted Woods South — Mayor Clarke opened the public hearing and asked if any written
correspondence had been received; City Clerk Schuett replied in the negative. Development
Services Director Deets briefly reviewed the zoning application, noting that when the parcel
was first zoned in 2018, the PDA provisions allowed for numerous R-2 lots along 1-80 with
smaller lot sizes. In exchange for the smaller lots, certain enhanced architectural elements
were required, including a prohibition on vinyl siding. The proposed modification to the PDA
zoning would allow the use of vinyl siding. Mr. Deets reviewed proposed exterior elevations
showing thicker trim and other City staff recommendations to improve visual interest for the
structures. The Planning & Zoning Commission recommended approval; however, City staff
recommend the council deny the request for inconsistencies with the adjoining Painted
Woods South development and because of the concession in 2018 to allow smaller lots.
Council Member Lyon asked if the City staff position on the matter was communicated to the
Planning & Zoning Commission; Mr. Deets replied in the affirmative. Council Member Lyon
then wondered about the possible cost savings to the developer if they used vinyl instead of
hardboard siding; Mr. Deets speculated that there would be a $9,000-10,000 upcharge per
home for hardboard siding. Council Member Bottenberg asked how frequently the City
agrees to modify development standards and then have a developer request additional
modifications; Mr. Deets replied that it was not common but noted that there are a few other
PD overlays in the community where additional architectural elements have been required in
exchange for smaller lot sizes. Council Member Bergman stated that she would abstain
from voting on the matter due to a professional conflict of interest. No comments were made
by the public in attendance.
2) On the vacation of a portion of a Storm Sewer Easement and a Public Utility Easement
[Indi Run Plat 3] — Mayor Clarke opened the public hearing and asked if any written

correspondence had been received; City Clerk Schuett replied in the negative. Development
Services Director Deets briefly reviewed the vacation proposal, which is necessary due to a
modification of lots from single family to duplex units. No comments were made by the
public in attendance.
Public Hearing Action Items:
1) Ordinance: Consideration of approval of an ordinance to amend Chapter 169, Zoning
Ordinance, City of Waukee, by rezoning and changing certain property therein to
modify PD-1, a property known as Painted Woods South [introduction; first reading] —
Council Member Lyon introduced the ordinance and moved to approve the first reading in
title only; seconded by Council Member Sinclair. Development Services Director Deets
reiterated City staff's recommendation that the application be denied. Results of vote: Ayes:
None. Nays: Bottenberg, Crone, Lyon, Sinclair. Abstentions: Bergman (due to a
professional conflict of interest). Motion defeated 0 — 4 — 1. *
2) Resolution: Consideration of approval of a resolution approving the vacation of a
portion of a Storm Sewer Easement and a Public Utility Easement [Indi Run Plat 3] —
Council Member Crone moved to approve the resolution; seconded by Council Member
Lyon. Results of vote: Ayes: Bergman, Bottenberg, Crone, Lyon, Sinclair. Nays: None.
Motion carried 5 — 0. (Resolution #2020-213)

3) Resolution: Consideration of approval of a resolution approving site plan for Waukee
Islamic Center[35 Laurel Street] — Council Member Sinclair moved to approve the
resolution; seconded by Council Member Lyon. Development Services Director Deets briefly
reviewed the site plan, including site ingress/egress, parking, stormwater detention, and
building exterior elevations.
*Seth Moulton, representing D.R. Horton, addressed the council and asked for
reconsideration of the vote on the Painted Woods South rezoning application (Agenda Item
#H1), as he was unable to participate in the public hearing due to technical issues. City
Attorney Brick noted that a member on the prevailing side of the vote would need to make a
motion to reintroduce the matter, adding that if reconsideration was approved the application
itself could not be reconsidered until the next council meeting. Mayor Clarke stated that the
council would discuss Mr. Moulton's request at the end of the meeting. **
Mayor Clarke asked for continued discussion on the matter currently under consideration
(Agenda Item #13). Council Member Sinclair asked if the parking was adequate; Mr. Deets
replied in the affirmative. Council Member Bottenberg noted that the applicant currently
operates in the same building in which his professional office is located, observing that their

Development Services Drirector Deets reviewed the amended agreement, which eliminates
one lot from the agreement, as well as altering language related to the planned events
space. The proposed changes are consistent with the City's economic development policy.
Council Member Bottenberg requested confirmation that the amendment would not alter any
required improvements; Mr. Deets replied in the affirmative. Results of vote: Ayes:

**Mayor Clarke invited Mr. Moulton to make any comments related to his request for
reconsideration of the vote on Agenda Item #H1 (Painted Woods South rezoning). Mr.
Moulton reviewed the developer's request to be allowed to use vinyl instead of hardboard
siding for the subject lots, citing affordability issues for the finished homes. He stated that
lots that abut the existing Painted Woods South development are not proposed for use of
vinyl siding and that only the front elevations of the houses on the lots under consideration
for rezoning would be seen from the main road. He added that the developer lives in a
nearby subdivision and noted that the Planning & Zoning Commission unanimously
recommended approval of the application. Council Member Crone moved to reconsider the
matter at the next council meeting; seconded by Council Member Sinclair. Results of vote:
Ayes: Crone, Sinclair. Nays: Bottenberg, Lyon. Abstentions: Bergman (due to a
professional conflict of interest). Motion to reconsider defeated 2 — 2 — 1.
