(B)Pledge of Allegiance (C)Roll Call -The following members were present:Mayor William F.Peard;Council Members Don L.Bailey,Jr.;C.Isaiah McGee;JeffV.Mertz;Darlene Stanton.Absent: Mike Watts. (D)Open Forum (E)Agenda Approval-Motion by Council Member Stanton,seconded by Council Member McGee,to approve the agenda.Roll call:Ayes:Stanton,McGee,Bailey,Mertz.Nays: None.Absent:Watts.Motion carried 4 -0 -1. (F)Mayor's Report -No report given. (G)Presentations: 1)Waukee Area Chamber of Commerce -Chris Colter,president of the Waukee Area Chamber of Commerce,addressed the Council to ask for continued financial support for the Chamber. 2)O&S Holdings,LLC -Chris Shane addressed the Council on behalf of O&S Holdings, LLC,Santa Monica,CA.Also in attendance were Tom Wong and Sandy Sanchez of O&S Holdings,LLC.Mr.Shane gave a brief history of the company and reviewed concept drawings for development of a portion of the property currently known as Olive Glen. (R)Public Hearings: 1)To consider an ordinance to amend Chapter 200,Waukee Muncipal Code,by adding and enacting thereto Chapter 224Y to provide for the establishment of the Sugar Creek Pump Station Connection Fee District pursuant to Section 384.38 of the Code of Iowa -Mayor Peard opened the public hearing and asked if any written correspondence had been received;City Administrator Kooistra replied in the negative. Mayor Peard asked if anyone present wished to address the Council on the issue. Creighton Cox,Director of Govemmental Affairs for the Home Builders Association of Greater Des Moines,addressed the Council to state that his organization would like the opportunity to discuss the ordinance and the breakdown of fee structures with City staff prior to final passage.Council Member Bailey asked if the Association had any objection to paying the fees in the district;Mr.Cox restated that his organization wished to review the ordinance and discuss it with City staff.Council Member Stanton stated that fee structures can vary greatly between communities.Mayor Peard declared the public hearing closed. Council Minutes of 02/12/07 Regular Meeting C.Consideration of approval of and authorizing staff to send requests for proposals for FY07,FY08,FY09 Audits (Resolution #07-43) D.Consideration of approval of the release of retainage to Municipal Pipe Tool Co.for the 2006 Joint Sanitary Sewer Lining Project in the amount of $2,752.35 Motion by Council Member Stanton,seconded by Council Member Absent:Watts.Motion carried 4 -0 -1. 2)Resolution:Consideration of a resolution fixing a date for hearing pursuant to Iowa Code Section 384.102 related to the City of Waukee Natural Gas Utility Expansion- Motion by Council Member Mertz,seconded by Council Member Stanton,to approve the resolution.Director of Public Works Gibson explained that bid proposals for the project had been received and opened,and that City staff requested that the date of public hearing be extended in order to allow time for staff review of the bid proposals. Roll call:Ayes:Mertz,Stanton,McGee,Bailey.Nays:None.Absent:Watts.Motion carried 4 -0 -1.(Resolution #07-44) 3)Resolution:Consideration of approval of a three-year extension to a Contract for Curbside Residential Waste and Recyclable Materials between the City of Waukee and Waste Management,Inc.-Motion by Council Member Stanton,seconded by Council Member Bailey,to approve the resolution.Director of Public Works Gibson requested the Council approve the resolution contingent upon an addendum regarding yard waste to be drafted by the city attorney and included with the contract extension. 6 Council Member Stanton amended the motion to approve the resolution,with the addition of a contract addendum to be drafted by the City Attorney regarding yard waste pick-up;Council Member Bailey amended the second.Roll call:Ayes:Stanton, Bailey,Mertz,McGee.Nays:None.Absent:Watts.Motion carried 4 -0 -1. (Resolution #07-45) 4)Resolution:Consideration of approval of a development agreement for Painted Woods Plats 2 and 3 -Motion by Council Member Stanton,seconded by Council Member Mertz,to approve the resolution.Director of Planning Deets reviewed some details within the agreement and requested the Council approve the resolution subject to obtaining signatures from authorized representatives of the development company. Absent:Watts.Motion carried 4 -0 -1.Deputy City Clerk Schuett read the ordinance in title only;Mayor Peard declared the ordinance duly adopted.(Ordinance #2596) 7)Ordinance:Consideration of approval of an ordinance to amend Chapter 502, Parking Regulations,City of Waukee,Iowa,Section 502.17,Prohibited Parking During Snow Emergency,by correcting certain language in the second paragraph to designate the chief of police or his designee to proclaim a snow emergency [introduction and first,second and third readings]-Motion by Council Member Bailey,seconded by Council Member Stanton,to approve the first reading of the ordinance in title only,waive the second and third readings,and place the ordinance on final passage.Roll call:Ayes:Bailey,Stanton,Mertz,McGee.Nays:None.Absent: Watts.Motion carried 4 -0 -1.(Ordinance #2597) 8)Discussion:Regarding Waukee Municipal Code §210,Regulating and Licensing of Peddlers,Solicitors and Transient Merchants and to Provide Penalties for Violations -City Administrator/Clerk Kooistra and City Attorney Brick reviewed proposed changes to the ordinance in order to address perceived safety concerns regarding sales on the public right-of-way.Council Members McGee,Bailey and Mertz concurred that they did not see the need for such changes in the ordinance.Council Member Stanton suggested similar ordinances in other metro area communities be researched;Council ) Member McGee requested statistics behind such limits in other communities. 7 9)Discussion:West Metro Regional Airport -Council Member Bailey stated that a potential Site G for the airport appeared to be within Waukee's future growth area;City Administrator/Clerk Kooistra confirmed as such.Council Member McGee expressed concern with the potential location.Council Member Stanton asked how the Council could recommend another potential site to the airport authority;City staff will research the matter.Council Member Bailey asked if the authority had considered any sites nearer Interstate 80.Larry Lyon,member of the West Metro Regional Airport Authority,answered that the topography nearer the interstate was not amendable to an airport location.Mr.Lyon also stated that Site G had not officially been selected yet as the location for the airport,Council Member Stanton expressed concern over potential flight paths over Waukee.Council Member McGee stated that he did not support the airport,but suggested that the City join the authority if the project were to move forward and Site G were ultimately selected.Mayor Peard replied that the property in question had yet to be annexed by the City.Council Member Mertz suggested the City review annexation priorities as this and other projects evolved.Mr.Lyon informed the Council of a public information meeting scheduled for March 6 at the Adel Public Library,and stated that all information regarding the airport was available on the City of Adel website.Butch Ostrander,City of De Soto council member,addressed the Council to speak in favor of an established location for the western bypass prior to any action related to the proposed airport.Mr.Kooistra stated that the Dallas County Planning &Zoning Commission would include the western bypass location in their comprehensive plan.
