WAUKEE CITY COUNCIL MINUTES
April 2,2007
(A)Call to Order -The regular meeting of the Waukee City Council was called to order by
Mayor Peard at 7:02 p.m.in the Council Chambers at City Hall.
(B)Pledge of Allegiance
(C)Roll Call-The following members were present:Mayor William F.Peard;Council
Members C.Isaiah McGee;JeffV.Meltz;Darlene Stanton;Mike Watts.Absent:Don L.
Bailey,Jr.
(D)Open Forum
(E)Agenda Approval-Motion by Council Member Stanton,seconded by Council Member
Mertz,to approve the agenda.Roll call:Ayes:Stanton,Mertz,McGee,Watts.Nays:
None.Absent:Bailey.Motion carried 4 -0 -I.
(F)Mayor's Report -Mayor Peard attended the Community Development Committee regular
meeting on March 21,the Comprehensive Plan open house on March 28 and the ribbon
cutting ceremony for Kerkhoff Chiropractic on March 29.On March 30,Mayor Peard
hosted a visit with Congressman Tom Latham at City Hall,where the Mayor updated
Congressman Latham on development activities and infrastructural needs within Waukee.
On April 3,Mayor Peard will participate as a panelist at the Des Moines Business Record's
Commercial Real Estate F arum;as well as attend a discussion with a representative of the
West Metro Regional Airport Authority,along with Council Member Stanton and City
Administrator/Clerk Kooistra.Mayor Peard will attend the Iowa Prayer Breakfast on April
5.
(G)Presentations:
1)Proclamation:Recognizing the achievement and service of Alec Sundermann in
earning the rank of Eagle Scout,the highest rank and honor in Scouting -Mayor
Peard read the proclamation aloud and presented it to Eagle Scout Alec Sundermann.
(H)Public Hearings:
1)To consider a Loan Agreement in the principal amount of $8,456.80 for acquiring
equipment for the municipal golf course -Mayor Peard opened the public hearing and
asked if any written correspondence had been received;City Administrator/Clerk
Kooistra replied in the negative.Mayor Peard asked if anyone present wished to
address the Council on the issue;no one present addressed the Council.Mayor Peard
declared the public hearing closed.
(I)Public Hearing Action Items:
1)Resolution:Consideration of authorizing and approving a Loan Agreement and
providing for the issuance of a $8,456.80 General Fund Municipal Golf Course
Equipment Note -Motion by Council Member Watts,seconded by Council Member
Stanton,to approve the resolution.Roll call:Ayes:Watts,Stanton,Mertz,McGee.
Nays:None.Absent:Bailey.Motion carried 4 -0 -I.(Resolution #07-65)

3)Resolution:Consideration of approval of the job description for the position of City
Planner and directing City staff to begin the process of filling said position-Motion
by Council Member McGee,seconded by Council Member Stanton,to approve the
resolution.Roll call:Ayes:McGee,Stanton,Watts,Meltz.Nays:None.Absent:
Bailey.Motion carried 4 -0 -1.(Resolution #07 -69)
4)Ordinance:Consideration of approval of an ordinance to amend Chapter 600,
Waukee Municipal Code,by adding and enacting thereto Chapter 622,adding
provisions prohibiting certain fireworks activity within the city limits of the City of
Waukee [second reading]-Motion by Council Member McGee,seconded by Council
Member Stanton,to approve the second reading of the ordinance in title only.City
Attorney Brick stated that modifications requested by the Council had been made and
that he had since been requested to add language clarifying that the insurance
requirements are to cover losses arising from permitted fireworks activities.Council
Member Mertz requested language requiring applicants to state the type of fireworks
they intend to discharge.Council Member McGee asked that surrounding property
owners be notified of a fireworks permit application;City Administrator/Clerk Kooistra
mentioned some practical considerations in doing so.Mr.Brick stated that the

application process for the type and amount of insurance required by the ordinance was
quite arduous.Nick Gruber,80 Ashland Ct.,addressed the Council,saying that his
research regarding the insurance application process supported Mr.Brick's statement
and that the insurance amounts required by the proposed ordinance was very restrictive
and likely to discourage individual homeowners from applying for a fireworks permit.
Council Member McGee called for the question.Roll call:Ayes:McGee,Stanton,
Mertz,Watts.Nays:None.Absent:Bailey.Motion carried 4 -0 -1.Deputy City
Clerk Schuett read the ordinance in title only.
