WAUKEE CITY COUNCIL MINUTES
May 7,2007
(A)Call to Order -The regular meeting ofthe Waukee City Council was called to order by
Mayor Peard at 7:02 p.m.in the Council Chambers at City Hall.
(B)Pledge of Allegiance
(C)Roll Call-The following members were present:Mayor William F.Peard;Council
Members Don L.Bailey,Jr.;C.Isaiah McGee;JeffV.Mertz;Darlene Stanton;Mike
Watts.Absent:None.
(D)Open Forum
(E)Agenda Approval-Motion by Council Member Mertz,seconded by Council Member
McGee,to approve the agenda.Roll call:Ayes:Mertz,McGee,Stanton,Watts,Bailey.
Nays:None.Motion carried 5 -O.
(F)Mayor's Report -Mayor Peard announced that the recipient of the 2006 Citizen of the
Year award is Ron Olson.He congratulated Mr.Olson on the award and thanked the
selection committee of Council Member Bailey,Tom Tovrea,and Fran Jolliffe.A
reception honoring Mr.Olson will be held at City Hall on May 31.Mayor Peard reported
that he had addressed a group of Waukee Elementary second grade students on May I and,
along with Director of Community Development Gunderson,addressed the Kiwanis Club
on May 2.Mayor Peard attended a Comprehensive Plan advisory committee meeting on
May 3,and will attend a City Council goal setting session on May 8 and a MIALG meeting
on May 9.On May 15,he will attend the Waukee Leadership Institute graduation
ceremony,during which Gov.Culver will speak.Mayor Peard encouraged the members of
the City Council to attend the event.He will also attend the first Economic Development
Task Force meeting on May 16.
(G)Presentations:
1)Proclamation:Recognizing the month of May as National Bike Month and declaring
May 12-18,2007 as Bike to Work Week-Mayor Peard read the proclamation aloud
and presented a copy to Angie Dalton,one of the organizers of the Bike to Work Week
event in the Des Moines metro area.Ms.Dalton addressed the Council and presented
information about the program and biking in general.
2)Proclamation:Declaring May 13-19,2007 as Iowa School Board Recognition Week
-Mayor Peard read the proclamation aloud and presented a copy to Wayne Cooper and
Larry Lyon of the Waukee Community School District Board of Education.
3)City Attorney opinion on sales tax issue -City Attorney Brick presented a letter to the
Council regarding election advocacy and briefly discussed how the City could legally
proceed to inform the community about the ballot issue.
(H)Public Hearings:
1)On an ordinance to amend Chapter 300,Zoning Ordinance,City of Waukee,Iowa,
by amending Section 301.11,"R-1"Single Family Residential District,to include
provisions and requirements for the use of temporary buildings for residential lot and
subdivision sales -Mayor Peard opened the public hearing and asked if any written
correspondence had been received;City Administrator/Clerk Kooistra replied in the
negative.Mayor Peard asked if anyone present wished to address the Council on the
issue.Mark Trumbauer of Regency Land Development Services addressed the Council
to speak in favor of the proposed ordinance.There was some discussion as to whether
the proposed ordinance left open the possibility of such temporary structnres in a
cormnercially zoned portion of a planned development.Director of Planning Deets
explained that a PD was an overlay district and that temporary structures in a
commercially zoned portion of a PD would only be allowed if the Council approved a
planned development narrative allowing for such a contingency.The ordinance as
presented would only allow such temporary structnres in residentially zoned districts.
Council Member Stanton requested that verbiage be added to specifically disallow such
temporary structures in commercial zoning within a planned development,then
suggested that any site plan for such temporary structures be approved for one year
only with the possibility of a one-year renewal after Council review.Council Member
Watts expressed concern over the necessity of the proposed ordinance when only one
developer had requested it.Council Member Mertz stated that he did not favor the
proposed ordinance,but asked that changes be considered if it were approved,such as
verbiage to address skirting,elevations,overhead lines and landscaping.Council
Members Bailey and McGee spoke in favor of the proposed ordinance.Mr.Deets
explained that while the proposed ordinance change added verbiage to the R-l district
regulations,the change would affect all residentially zoned districts due to the structure
of the zoning ordinance.He also stated that two years was the maximum length
proposed for a permitted temporary structnre,and that nothing in the proposed
ordinance would disallow such structnres to be moved to different residential lots
within the same subdivision once a site plan expired.Mr.Trumbauer again addressed
the Council to speak in favor of the proposed ordinance.Creighton Cox of the Home
Builders Association of Greater Des Moines then addressed the Council,stating that
while Regency was spearheading the request for the ordinance,several other developers
supported it and hoped that other metro area communities would enact similar
ordinances.Mayor Peard declared the public hearing closed.

by amending Section 301.03,Definitions,to include the definition of a temporary

issue;no one present addressed the Council.Mayor Peard declared the public hearing
closed.

rezoning and changing certain property therein from R-3A [Owner-Occupied Multi-
Family Residential District]to PD-l [Planned Development Overlay District],and
amend the Official Zoning Map to show rezoning (a parcel known as Fox Cove)-
Mayor Peard opened the public hearing and asked if any written correspondence had
been received;City Administrator/Clerk Kooistra replied in the negative.Mayor Peard
asked if anyone present wished to address the Council on the issue.Mark Lee of Lee
Engineers,representing Fox Creek Estates,addressed the Council and explained the
rezoning application and how it would create a lower density residential area.Council
Member Stanton spoke briefly about rain gardens and asked if they could be
implemented in this plat;Mr.Lee replied that the developer had applied for funding to
include rain gardens in the plat.Council Member Stanton asked if the covenants for the

plat would address certain aesthetic concerns;Mr.Lee answered that the covenants
were still being drafted.Mayor Peard declared the public hearing closed.
