(A)Call to Order -The regular meeting of the Waukee City Council was called to order by
Mayor Pro Tern Stanton at 7:02 p.m.in the Council Chambers at City Hall.
(B)Roll Call-The following members were present:Council Members Don L.Bailey,Jr.;
Darlene Stanton;Mike Watts.Absent:Mayor William F.Peard;Council Members C.
Isaiah McGee;JeffV.Mertz.
(C)CLOSED SESSION -Pursuant to Iowa Code §21.5(I)(c)to discuss strategy with
Counsel in matters where litigation is eminent where its disclosure would be likely to
prejudice or disadvantage the position of the governmental body ill that litigation -
Motion by Council Member Bailey,seconded by Council Member Watts,to close the
regular session and enter closed session.Roll call:Ayes:Bailey,Watts,Stanton.Nays:
None.Absent:McGee,Mertz.Motion carried 3 -0 -2.Council entered closed session
at 7:04p.m.
CLOSED SESSION
Motion by Council Member Bailey,seconded by Council Member Watts,to end the closed
session and enter regular session.Roll call:Ayes:Bailey,Watts,Stanton.Nays:None.

(E)Agenda Approval-Motion by Council Member Bailey,seconded by Council Member
Watts,to approve the agenda,removing consideration of agenda item #Kl J from the
Consent Agenda for separate consideration.Roll call:Ayes:Bailey,Watts,Stanton.Nays:
None.Absent:McGee,Mertz.Motion carried 3 -0 -2.
(F)Mayor's Report -None given.
(G)Presentations:
1)DART transit presentation -Brad Miller,General Manager of Des Moines Area
Regional Transit,gave a brief presentation on the City of Waukee's possible
membership in DART.Council Member Stanton asked for a more in-depth
presentation from Mr.Miller during a future City Council work session.
(H)Action Items:
1)Resolution:Consideration of approval of adoption of the Resolution of Necessity
proposed for the Waukee,Iowa,Southfork and Walnut Ridge Sanitary Sewer System
Project -Motion by Council Member Bailey,seconded by Council Member Watts,to
defer consideration of the proposed Resolution of Necessity for later consideration to a
Council meeting to be held on Monday,September 10 at 7:00 p.m.at this meeting
place,with jurisdiction retained for further consideration and action at the adjourned
meeting.Council Member Bailey stated that the matter was being deferred as there
were not enough council members in attendance for a proper vote,and so that City staff
could research possible alternatives.Roll call:Ayes:Bailey,Watts,Stanton.Nays:
None.Absent:McGee,Mertz.Motion carried 3 ~0 ~2.
(I)Public Hearings:
1)On the proposition of the issuance of not to exceed $7,000,000 General Obligation
Bonds,Series 2007 A (Urban Renewal),of Waukee,Iowa -Mayor Pro Tern Stanton
opened the public hearing and asked if any written correspondence had been received.
City Administrator/Clerk Kooistra replied in the negative.Mayor Pro Tern Stanton
asked if anyone present wished to address the Council on the issue;no one present
addressed the Council.Mayor Pro Tern Stanton declared the public hearing closed.
2)On the proposition of the issuance of not to exceed $2,700,000 General Obligation
Bonds,Series 2007B (for an Essential Corporate Purpose),of Waukee,Iowa ~Mayor
Pro Tern Stanton opened the public hearing and asked if any written correspondence
had been received.City Administrator/Clerk Kooistra replied in the negative.Mayor
Pro Tern Stanton asked if anyone present wished to address the Council on the issue.J.
Eric Boehlert of Ahlers &Cooney,City Bonding Counsel,explained that approval of
the Council to take action for the issuance of the bond would in no way obligate the
City to issue the debt.Mayor Pro Tern Stanton declared the public hearing closed.

6)Ordinance:Consideration of approval of an ordinance to amend Chapter 300,Zoning
Ordinance,City of Waukee,Iowa,by rezoning and changing certain property therein
from M-1A [Limited Industrial District]to C-1 [Community and Highway Service
Commercial District]and amend the Official Zoning Map to show rezoning (a parcel
known as The Tenth Mile/Shotienkirk Chevrolet)[second,third (final)reading]-
Motion by Council Member Watts,seconded by Council Member Bailey,to approve the
second reading of the ordinance in title only.Council Member Watts expressed his

frustration that a proposed development agreement had not been provided to City staff
earlier.He stated that such a late submittal date did not allow time for proper review,and
that he would not support many of the items in the proposed agreement.City
Administrator/Clerk Kooistra said that City staff had reviewed the proposed agreement,
and sent an e-mail and letter to the attorney representing Shottenkirk Chevrolet
suggesting clarification on certain items within the agreement.Council Member Bailey
requested a copy of the letter and stated that he would not support the development
agreement as proposed.Jim Van Werden,attorney representing Shottenkirk Chevrolet,
addressed the Council to clarify that the proposed development agreement requested
reimbursement for acquiring and improving blighted property,Council Member Bailey
replied that the agreement appeared to ask for reimbursement for 100%of all costs
associated with development of the property.Roll call:Ayes:Stanton.Nays:Watts,
Bailey.Absent:McGee,Mertz.Motion failed 1 -2 -3.
7)Discussion:Fencing requirements/or swimming pools -Council Member Watts stated
that he'd been approached by residents with concerns regarding the City's fencing
requirements around swimming pools;specifically,pools of a smaller,more temporary
nature.He requested that City staff review the current ordinance and suggest alternatives
related to smaller pools.Council Member Bailey requested a report comparing Waukee's
ordinance to those of surrounding communities.Director of Plarming Deets agreed to
provide the report,explained the fencing requirements within the 2003 International
Residential Code adopted by the City as well as Waukee Municipal Code,and stated that
the City's ordinance appeared to be consistent with those of other surrounding
communities.City Administrator/Clerk Kooistra added that requiring an annual building
permit for temporary swimming pools created additional work for City staff and was
difficult to monitor.Council Member Stanton asked that the ordinance be clarified for
ease in understanding and expressed concern over possible safety issues if the fencing
requirements are amended.Council Member Watts questioned why lakes and detention
ponds within the City were not required to be surrounded by fencing.
