(A)Call to Order -The regular meeting of the Waukee City Council was called to order by
Mayor Peard at 7:00 p.m.in the Council Chambers at City Hall.
(B)Pledge of Allegiance
(C)Roll Call-The following members were present:Mayor William F.Peard;Council
Members Don L.Bailey,Jr.;C.Isaiah McGee;JeffV.Mertz;Darlene Stanton;Mike
Watts.Absent:None.
(D)Open Forum -Chris Brandt,130 NE Sunrise Dr.,introduced himself as a candidate for
City Council,
(E)Agenda Approval-Motion by Council Member Mertz,seconded by Council Member
Stanton,to approve the agenda,removing consideration of item J6.Roll call:Ayes:Mertz,
Stanton,Watts,Bailey,McGee.Nays:None.Motion carried 5 -O.
(F)Mayor's Report -Mayor Peard attended the October I City Council meeting,the October
3 meeting of the Economic Development Task Force,and the October 12 annual meeting
of the Waukee Foundation.

D.Consideration of approval of setting November 5,2007 as the date of public hearing
on an ordinance to amend Chapter 300,Zoning Ordinance,City of Waukee,Iowa,by
rezoning and changing cenain property therein from A-1 [Agricultural District]to C-
4 [Office Park Commercial District];and then by rezoning and changing certain
property therein from C-4 [Office Park Commercial District]to PD-I [Planned
Development Overlay District];and amend the Official Zoning Map to show
rezoning (a parcel known as the Schwartz property)

5)Resolution:Consideration of approval of the final plat for Westgate Business Park
Plat 3 -Motion by Council Member Stanton,seconded by Council Member Mertz,to
approve the resolution.Director of'PIanning Deets gave a brief overview of the project
and requested the Council approve the resolution subject to final review and approval of
the legal documents by the City Attorney.Roll call:Ayes:Stanton,Mertz,McGee,

7)Resolution:Consideration of approval of a policy related to permitting and fencing of
private residential swimming pools -Motion by Council Member Watts,seconded by
Council Member Bailey,to approve the resolution.Council Members McGee,Watts and
Stanton thanked City staff for their work on the resolution.Council Member Watts asked
for clarification on the $20 permit fee and when it would be required;Director of
Planning Deets explained the policy.Council Member McGee requested City staff
publicize the policy.Roll call:Ayes:Watts,Bailey,Stanton,Mertz,McGee.Nays:

8)Resolution:Consideration of approval of funding for the City of Waukee employee
holiday party in an amount not to exceed $1,500.00 -Motion by Council Member
Stanton,seconded by Council Member Watts,to approve the resolution.Director of
Public Works Gibson explained that the funds would be used to pay for entertainment for
the holiday party.Council Member Bailey asked the City Attorney to review the
resolution to be certain it properly defined the public purpose for the funding;City
Attorney Brick responded that the resolution was based on that which had been reviewed
and approved the previous year.Roll call:Ayes:Stanton,Watts,McGee,Bailey,Mertz,

9)Ordinance:Consideration of approval of an ordinance to amend Chapter 300,Zoning
Ordinance,City of Waukee,Iowa,by modifying applicable zoning districts for certain
property therein,zoned as R-2 [One and Two Family Residential District],R-4 [Row
Dwelling and Townhome District}and C-IA [Neighborhood Commercial District]in
order to coordinate with adjacent street centerlines,and amend the Official Zoning
Map to show rezoning (a parcel known as Stone Prairie)[second reading]-Motion by
Council Member Stanton,seconded by Council Member Mertz,to approve the second
reading of the ordinance in title only.Roll call:Ayes:Stanton,Mertz,Bailey,McGee.I

15)Ordinance:Consideration of approval of an ordinance repealing existing Chapter 218
of the Waukee Municipal Code and enacting in lieu thereof Chapter 218 pertaining to
the installation,repair and maintenance of sidewalks within the city limits of the City
of Waukee,and providing penalties for violations [introduction,first reading]-
Council Member Bailey introduced the ordinance and motioned to approve the first
reading of the ordinance in title only;seconded by Council Member Watts.City
Attomey Brick stated that the ordinance moved the assessment language and program
timeline from the ordinance to a resolution;the proposed ordinance now addressed basic
maintenance issues.Council Member Bailey asked if the ordinance must be adopted
prior to approval of the resolution;Mr.Brick replied in the affirmative.Council Member
Stanton expressed concern that certain areas of Waukee had agreements with the City
outlining different time lines for sidewalk installation,and that those areas should be
noted in the ordinance;Council Member Bailey agreed.Mr.Brick suggested language
additions that would clarify the matter.Council Member Bailey asked if the City
recorded planned development agreements;City staff will research the matter.Roll call:

16)Resolution:Consideration of approval of the sidewalk installation,repair and
maintenance program -Motion by Council Member Watts,seconded by Council
Member Bailey,to table consideration of the resolution but to discuss the matter.Nick
Gruber,80 Ashland Ct.,addressed the Council to state that property owners who had
been assessed during the 2004 and 2005 program were not happy with the proposed
policy changes.He then expressed the opinion that homeowners are responsible for
maintaining the sidewalks that abnt their property and that he did not think the City
should snbsidize such maintenance.Council Member Bailey thanked Mr.Gruber for his
comments and replied that the proposed policy changes would reduce,not eliminate,the
cost to property owners for repair and replacement.Mr.Gruber then stated that property
owners in the 2004 and 2005 program areas might ask for refunds.Council Member
Stanton asked City staff to research the possibility of refund to those property owners in
the 2004 and 2005 program areas;Council Member McGee concurred,Jim Phillips,240
Bel Aire Dr.,addressed the Council to ask how the proposed policy changes would affect
those property owners in the 2004 and 2005 program areas that had yet to complete their
sidewalks.Director of Public Works Gibson replied that all properties within those areas
had completed the program.Council Member Bailey asked the City Attorney to research
the possibility of refunds.Council Member Stanton asked for a report on the possible
cost to the City to implement refunds.Council Member Mertz stated that he did not
support the idea of refunds as it set a bad precedent.Mayor Peard explained that the
previous policy had been approved by the Council a public safety matter and that it was
the best policy at the time.Roll call:Ayes:Watts,Bailey,Mertz,McGee,Stanton.Nays:
