(A)Call to Order -The regular meeting of the Waukee City Council was called to order by
Mayor Peard at 7:04 p.m.in the Council Chambers at City Hall.
(B)Pledge of Allegiance
(C)Roll Call-The following members were present:Mayor William F.Peard;Council
Members Don L.Bailey,Jr.;C.Isaiah McGee;JeffV.Mertz;Darlene Stanton;Mike
Watts.Absent:None.Also present:City Administrator/Clerk Jeff Kooistra;Director of
Community Development Jody T.Gunderson;Director of Public Works John Gibson;
Assistant Director of Public Works Tim Royer;Director of Planning Brad Deets;Fire Chief
Clint Robinson;Deputy City Clerk Rebecca D.Schuett;City Engineers Mikelis Briedis,
Forrest Aldrich;City Attomey Steve Brick.

(E)Agenda Approval-Council Member Stanton moved to approve the agenda,removing
consideration of item J2;seconded by Council Member McGee.Roll call:Ayes:Stanton,
McGee,Mertz,Watts,Bailey.Nays:None.Motion carried 5 -O.
(F)Mayor's Report -Mayor Peard had recently attended the St.Boniface Fall Dinner,VFW
Women's Auxiliary Spaghetti Feed,Waukee United Methodist Church Chicken Noodle
Dinner and Immanuel Lutheran Church dinner.Last week,he attended the MFO monthly
meeting.Mayor Peard wished his son,Tanner,a happy 13th birthday.He then reminded
everyone that Tuesday,Nov.6,was Election Day and that polls wonld be open from 7:00
a.m.to 8:00 p.m.

1)Quarterly Report from Waukee Police Department -Report made by Police Sgt.
Mapes.
(H)Public Hearings:
1)On the adoption of plans,specifications.form of contract and estimate of cost for the
construction of the Southfork and Walnut Ridge Sanitary Sewer System Project-
Mayor Peard opened the public hearing and asked if ally written correspondence had
been received.City Administrator/Clerk Kooistra replied in the negative.Mayor Peard
asked if anyone present wished to address the Council on the issue;no one present
addressed the Council.Mayor Peard declared the public hearing closed.
2)On the adoption of plans,specifications.form of contract and estimate of cost for the
construction of site excavation work at the Waukee Public Works Facility -Mayor
Peard opened the public hearing and asked if ally written correspondence had been
received.City Administrator/Clerk Kooistra replied in the negative.Mayor Peard
asked if anyone present wished to address the Council on the issue.Council Member
Mertz stated that,while he supported the project,he was concemed that the plans for
the Public Works Facility had not first been approved by the Utilities Board and
Planning and Zoning Commission.Council Member Bailey replied that the project
should move forward so that the site excavation could be completed before winter.
Mayor Peard asked if a special meeting of the Utilities Board could be scheduled to
consider the project;Director of Public Works Gibson explained that the Utilities Board
could have a special meeting,but that the Planning and Zoning Commission could not
meet prior to their next regularly scheduled meeting.He then stated that there was no
building design or site plan for either board to approve at present.Council Member
Watts stated that site excavation could be approved prior to an approved site plan and
that developers have been allowed to do so before.City Attorney Brick confirmed
Council Member Watts'statement,adding that the City did not require grading permits
at this time.Mayor Peard declared the public hearing closed.
3)On an ordinance to amend Chapter 300,Zoning Ordinance,City of Waukee,Iowa,
by rezoning and changing certain property therein from R-4 [Row Dwelling and
Townhome Dwelling District}to R-3 [Rental Multi-Family Residential District};and
then by rezoning and changing certain property therein from R -3 [Rental Multi-
Family Residential District}to PD-l [Planned Development Overlay District};and
amend the Official Zoning Map to show rezoning (parcel known as Lot 1of Williams
Pointe Plat 12)-Mayor Peard opened the public hearing and asked if any written
correspondence had been received.City Administrator/Clerk Kooistra replied in the
negative.Mayor Peard asked if anyone present wished to address the Council on the
issue.Council Member Bailey asked if the zoning was conditional based upon an
approved site plan;Director of Planning Deets replied in the affirmative,adding that
the planned development document for the parcel would include exhibits of the concept
plan,which the developer would be required to follow.Council Member Watts asked
how the project would effect the City's taxable valuation;City staff will research the
matter and provide a report.Council Member Watts then stated that the expected
population increase resulting from the proposed proj ect would translate into an
increased need for public safety personnel and equipment.Council Member Mertz
expressed concern about the proposed detached garage units,asking that the developer
add more character to the structures.Mr.Deets replied that City staff would work with
the developer during the site plan process to address such concerns.Mark Trumbauer,
Regency Land Development Services,and Todd Wiskus,Simonson &Associates,
addressed the Council to speak to Council Member Mertz's concerns.Mayor Peard
declared the public hearing closed.

and asked if any written correspondence had been received.City Administrator/Clerk
Kooistra replied in the negative.Mayor Peard asked if anyone present wished to
address the Council on the issue;no one present addressed the Council.Mayor Peard
declared the public hearing closed.

1)Resolution:Consideration of approval of a resolution adopting plans,specifications,
form of contract and estimate of cost for the construction of the Southfork and

approve the resolution;seconded by Council Member Mertz.Roll call:Ayes:Walts,I

5)Ordinance:Consideration of approval of an ordinance to amend Chapter 300,
Zoning Ordinance,City of Waukee,Iowa,by rezoning and changing certain property

save as many existing trees as possible and that the PD-I zoning included restrictions
on certain uses typically allowed in C-4 zoning.Bill Murphy of Strategic Design
addressed the Council.Also in attendance was Greg Judas ofKC Holdings.Mr.
Murphy reviewed the proposed layout of buildings on the site and reiterated the
developer's intent to save trees.Mr.Judas also spoke about an agreement with the
previous property owner to save trees.Roll call:Ayes:Watts,Bailey,McGee,Mertz,
Stanton.Nays:None.Motion carried 5 -O.Deputy City Clerk read the ordinance in
title only.

date of public hearing on an ordinance to amend Chapter 300,Zoning Ordinance,City of
Waukee,Iowa,by rezoning and changing celtain property therein from M -IA [Limited
Industrial District]to C-l [Community and Highway Service Commercial District]and
amend the official zoning map to show rezoning (a parcel known as Shottenkirk
Chevrolet;seconded by Council Member Stanton.City Attorney Brick explained that a
public hearing is required before action can be taken on the rezoning request;in order for
the request to be reconsidered,a motion do to so must be brought forward at the

6)Resolution:Consideration of approval of a resolution fixing date for a meeting on the
proposal to enter into a Redevelopment Agreement with Shottenkirk Waukee

Following the roll call vote,Jim Van Werden,attorney representing Shottenkirk
Chevrolet,asked if the motion had been made correctly;City Attorney Brick applied in
the affirmative,Council Member Bailey asked Mr.Van Werden if the signed agreement
would be provided to the City by the end of the week;Mr.Van Werden replied that he
hoped as such.
7)Resolution:Consideration of approval of a Memorandum of Understanding between
the Iowa Department of Administrative Services,State Accounting Enterprise,ami the
City of Waukee,Iowa,for participation in the Income Offset Program -Council
Member Stanton moved to approve the resolution;seconded by Council Member Bailey.
Council Member Watts expressed concern about the high number of unpaid ambulance
service fees and suggested that City stafflook into hiring a part-time individual to handle
ambulance billing.City Administrator/Kooistra explained that he and Director of
Finance Burkhart had already begun researching improved methods for ambulance
billing.Council Member Meltz asked if there was a billing appeals process in place for
low income persons;Mr.Kooistra explained certain such procedures.Roll call:Ayes:

8)Resolution:Consideration of approval of an amended and restated agreement for the
Des Moines Regional Transit Authority (DART)-Council Member McGee moved to
approve the resolution;seconded by Council Member Bailey.Brad Miller,General
Manager of Des Moines Area Regional Transit (DART),addressed the Council and
stated that the DART commission had approve Waukee's inclusion in DART if the City
saw fit to join.City Administrator/Clerk Kooistra stated that Waukee was the first entity
proposing to join DART since the initial 28M agreement was approved,and that City

legal counsel found no major legal issues with the amended agreement.At the request of
Council Member Bailey,Mr.Miller explained that bus service would not be provided in
the first year of the agreement,but the City would make payments to DART.A study
would be conducted to ascertain how best to provide services,and the City Council
would then need to approve any service to begin in any year.Council Member Mertz
asked if it would be possible for the City to opt out of the agreement at a later date if it
saw fit;Mr.Miller replied in the affirmative,Council Member Stanton expressed
concem that it would not be easy to opt out ofthe agreement,and that not enough
detailed information had been provided to approve the resolution at this time.Council
Member Watts stated that the City would have financial obligations if opting out,
including obligations related to bus purchases.Mr.Miller explained that any buses
purchased by DART became part of the general fleet,and that there would be no
obligation to pay for buses as they are not purchased on credit.Council Member Mertz
asked for a timeline on the proposed study if the City were to join DART;Mr.Miller
stated that the City would dictate how quickly a study could be completed and when bus

9)Resolution:Consideration of approval of Addendum No.1 to the Standard
Specifications for Public Improvements in the City of Waukee,Iowa -Council Member
Stanton moved to approve the resolution;seconded by Council Member Mertz.Director
of Public Works Gibson explained that the proposed addendum would increase testing
standards for certain public improvements.Council Member Mertz asked if the proposed
addendum included language dictating the costs for such additional testing be paid by the
developer;M:r.Gibson replied that such language was included elsewhere in the Standard

13)Resolution:Consideration of approval of the sidewalk installation,repair and
maintenance program -Council Member Watts moved to approve the resolution;
seconded by Council Member Bailey.Council Member McGee expressed his support for
the resolution,but wanted to pursue the concept of reimbursement for those property
owners who'd been assessed at 100%since the ordinance was previously amended,Jim
Phillips,240 Bel Aire Dr.,also expressed concern about reimbursement.Council
Member Bailey suggested both reimbursement and the program timeline map be
discussed in a work session meeting.Council Member Stanton replied that such concerns
should've been addressed in a work session prior to consideration of the resolution.
There was some discussion as to assessment for corner lots;Director of Public Works
Gibson explained the intent of the policy.After some additional discussion,Council
Member Watts called for the question.Roll call:Ayes:Watts,Bailey.Nays:Mertz,
Stanton,McGee.Motion failed 2 -3.City staff agreed to include discussion of the
policy on a future work session agenda.
Council Member McGee requested that Reports be made prior to the closed session;the

Copeland family respects recreational activities on the property more so than they have
on the bike trail easements on their current property,and that he would not support the
