(A)Call to Order -The regular meeting of the Waukee City Council was called to order by
MayOTPeard at 7:03 p.m.in the Council Chambers at City Hall.
(B)Pledge of Allegiance
(C)Roll Call-The following members were present:Mayor William F.Peard;Council
Members Don L.Bailey,Jr.;Jeff V,Mertz;Darlene Stanton;Mike Watts.Absent:C.
Isaiah McGee.(Council Member McGee participated by telephone from 7:22 p.m.to 7:25
p.m.,then again from 7:45 p.m.to 7:51 p.m.)
Also present:City Administrator/Clerk Jeff Kooistra;Director of Community Development
Jody T.Gunderson;Director of Public Works John Gibson;Assistant Director of Public
W orks Tim Royer;Director of Planning Brad Deets;Deputy City Clerk Rebecca D.
Schuett;City Engineer Mikelis Briedis;City Attorney Steve Brick.

(E)Agenda Approval-Council Member Mertz moved to approve the agenda;seconded by
Council Member Stanton,Roll call:Ayes:Mertz,Stanton,Watts,Bailey.Nays:None.
Absent:McGee.Motion carried 4 -0 -1.
(F)Mayor's Report -Mayor Peard reported that he'd attended both the MPO meeting and
Waukee Area Chamber of Commerce luncheon on Nov.15.He reminded all that the City
was still taking applications from citizens interested in serving on city boards,committees
and commissions.MayOT Peard then thanked those who worked on his re-election
campaign and those that voted for him,and extended his congratulations to Council
Member Stanton and Council Member Elect Casey L.Harvey on their respective wins.He
wished all best wishes and safe travel for the Thanksgiving holiday.

1)Library Board of Trustees update on "The Big Read"program -Report made by
Rebecca Johnson,Library Board of Trustees;Devon Murphy-Petersen,Assistant
Library Director;Jane Olson,Waukee Area Arts Council;and Ann Hanigan,Waukee
High School English Department,
(H)Public Hearings:
1)On a Redevelopment Agreement between the City of Waukee and Shottenkirk
Partnership,LP -Motion to Reschedule Hearing -Mayor Peard contacted Council
Member McGee by telephone at 7:22 p.m.in order to participate in the discussion and
vote.
Council Member Stanton moved to reschedule the public hearing for J anuary 21,2008;
seconded by Council Member Mertz.Roll call:Ayes:Stanton,Mertz,Bailey,Watts,
McGee.Nays:None.Motion carried 5 -O.
2)On an ordinance to amend Chapter 300,Zoning Ordinance,City of Waukee,Iowa,
by rezoning and changing certain property therein from M-IA [Limited Industrial
District]to C-l [Community and Highway Service Commercial District]and amend
the official zoning map to show rezoning (a parcel known as Shottenkirk Chevrolet)
-Motion to Reschedule Hearing -Council Member Mertz moved to reschedule the
public hearing for January 21,2008;seconded by Council Member Stanton.Roll call:
Ayes:Mertz,Stanton,McGee,Watts,Bailey.Nays:None.Motion carried 5 -O.]
(I)Public Hearing Action Items:
1)Resolution:Consideration of approval of a resolution to approve an extension of the
time period for completion of conditions under the Development Agreement,dated
September 20,2005,and the First Amendment thereto,dated June 18,2007,and the
Second Amendment dated September 10,2007,between City of Waukee and The
Tenth Mile,L.L.c.-Council Member Watts moved to approve the resolution;
seconded by Council Member Stanton.Roll call:Ayes:Watts,Stanton,Bailey,
McGee,Mertz,Nays:None.Motion carried 5 -O.(Resolution #07-244)
Following the roll call vote,Council Member Mertz expressed his disappointment that
the matter was taking so long to resolve and his hope that the applicant would work
with City staff to resolve all outstanding issues prior to the expiration of the extension.
Council Member Stanton expressed her concern that vehicles at the Shottenkirk
dealership continued to be illegally parked,even after repeated notices.
Council Member McGee ended the telephone call at 7:25 p.m.

Council Member Bailey moved to approve the consent agenda;seconded by Council
Member Mertz,After a brief discussion,Council Member Bailey withdrew the motion;
Council Member Mertz withdrew the second.Council Member Bailey then moved to
approve the consent agenda,removing item JlD for a separate vote;seconded by Council

Council Member Bailey moved to approve consent agenda item JlD;seconded by
Council Member Mertz.Council Member Stanton proposed changing language in the
resolution from "5%of gross pro shop revenues"to "5%of the gross margin pro shop
revenues."There was a brief discussion on the definitions of "gross margin revenue"and
"net revenue."Council Member Mertz asked if the proposed incentives were typical for
this type of position;Director of Public Works Gibson replied in the affirmative.Council
Member Stanton questioned why the position was as an employee of the City and not as
an independent contractor;Mr.Gibson explained that the position could not be as an
independent contractor because the golf course had been purchased by the City with tax-

exempt bonds.Mr.Gibson also clarified that the pay and incentives for the position

Pkwy.,the developer had bonded with the City for the construction of improvements to

Council Member Stanton.Council Member Bailey stated that he thought the
Brick/Regency development agreement had been paid in full by the City.Director of
Community Development Gunderson answered that there was a certain dollar amount to
rebate,but that no request had been made by the property owner Ior payment.He also
stated that the City had approved an assignment of interest from the previous owner to
the current owner.Council Member Bailey requested documentation of the approved

amount remaining on the obligations and asked what was planned for excess revenues.
Director of Community Development Gunderson replied that no excess revenues were
anticipated.Council Member Bailey asked how the obligations would be affected ifthe
revenues were not as expected;Mr.Gunderson answered that City staff had projected

Family Residential District];and then by rezoning and changing certain property
therein from R-3 [Rental Multi-Family Residential District]to PD-l [Planned
Development Overlay District];and amend the Official Zoning Map to show rezoning
(parcel known as Lot 1 of Williams Pointe Plat 12)[second,third (final)reading]-

Mayor Peard contacted Council Member McGee by telephone at 7:45 p.m.in order to
participate in the discussion and vote.
Council Member Stanton moved to approve the second reading of the ordinance in title
only,waive the third reading,and place the ordinance on final passage;seconded by
Council Member Watts.Director of Planning Deets reviewed the potential valuation for
the project and stated that the applicant had requested the third reading of the ordinance
be waived.Council Member Watts asked about potential valuation if the project were
included in a TIF district,then asked for a projected completion date for the project.
Mark Trumbauer,Regency Land Development Services,answered that the project would
begin this fall and be constructed in two phases,with the entire project expected to be
