HomeMy WebLinkAbout2007-11-26-Work Session MinutesWAUKEE CITY COUNCIL MINUTES WORK SESSION MEETING NOVEMBER 26,2007 IA)Call to Order -The work session meeting of the Waukee City Council was called to order by Mayor Pro Tem Darlene Stanton at 7:05 p.m.in the Council Chambers at City Hall. B)Roll Call-The following members were present:Council Members Donald L.Bailey,Jr.;C.Isaiah McGee;JeffV.Mertz;Darlene Stanton.Absent:Mayor William F.Peard;Council Member Mike Watts. Also present:City Administrator/Clerk Jeff Kooistra;Director of Public Works John Gibson;Director of Planning Brad Deets;Deputy City Clerk Rebecca D.Schuett;City Attorney Steve Brick. C)Agenda Approval-Council Member Mertz moved to approve the agenda;seconded by Council Member McGee.Roll call:Ayes:Mertz,McGee,Stanton,Bailey.Nays:None.Absent:Watts. Motion carried 4 -0 -1. D)Open Forum E)Work Session: 1.Sidewalk Program map -Director of Public Works Gibson compared maps of the 2005 program and the proposed revisions.Mr.Gibson stated that Council Member Watts had contacted him about changing a certain portion from the 2009 program to 2008.Council Member Bailey asked that the proposed program focus on areas where public safety was of special concern,such as along school routes.He then proposed that a certain portion from the 2010 program be added to the 2008 program because of the proximity to schools.Mr.Gibson reminded the Council that the program would not require sidewalk installation along streets without curbing and gutter.Council Member Mertz asked if the 2009 and 2010 program portions to the north could be combined;Mr.Gibson explained that the proposed program would rotate around the city on a continuous 6-year cycle,so that it was preferable to keep separate the two portions to which Council Member Mertz referred.The Council concurred that the 2009 and 2010 portions to which Council Members Watts and Bailey had referred should be included in the 2008 program. 2.Sidewalk Program reimbursement -City Attomey Brick reviewed his opinion on the matter, referencing the Iowa Constitution and Iowa Supreme Court precedent which require a specific public purpose for this type of expenditure,and stating that he found no such public purpose. Council Member Stanton asked if any precedent had been set in other states on this matter;Mr. Brick responded that he could research the matter,but that ultimately the Iowa Constitution would supercede any other state's constitution or Supreme Court opinions.Mary White,670 Boone Dr.,asked the Council if any consideration would be given to snow removal for elderly or disabled citizens,refering to a City of Ankeny ordinance on the matter.City staff will research the Ankeny ordinance. 3.Development and building fees -Director of Planning Deets gave a PowerPoint presentation on development and building fees in Waukee and throughout the Des Moines metropolitan area.Also in attendance was Creighton Cox of the Homebuilders Association of Greater Des Moines,who answered questions of the Council.Mr.Deets reviewed some possible fee structure changes which would not effect net costs. 4.Lighting Ordinance,commercial zoning -Director of Planning Deets gave a PowerPoint presentation,stating that Shottenkirk Chevrolet had requested the City review the lighting ordinance as it applies to auto dealerships.Mr.Deets reviewed the current ordinance standards and lighting levels at various other auto dealerships in the area.He then suggested some possible ordinance changes,such as separate lighting requirements for display areas,an I increase in overall average foot candles,or curfew restrictions,The Council discussed the various possible ordinance changes,as well as lighting ordinances for other communities,The Council concurred that City staff should consult an illumination engineer for recommended lighting levels and that the current lighting ordinance for auto dealerships should be revised. 5.Smoking restrictions in public parks -Council Member McGee stated that any proposed ordinance would first be presented to the Parks Board before consideration by the CounciL There was a brief discussion on enforcement issues and whether the Sugar Creek Municipal Golf Course should be excluded from such an ordinance. F)Comments Adjournment.Council Member Mertz moved to adjoum;seconded by Council Member McGee.Ayes: All.Nays:None.Motion carried 4 -O.
