(B)Pledge of Allegiance (C)Roll Call-The following members were present:Mayor William F.Peard;Council Members Don L.Bailey,Jr.;Casey L.Harvey;C.Isaiah McGee;Darlene Stanton.Absent:Council Member Mike Watts. Also present:City Administrator/Clerk Jeff Kooistra,Director of Community Development Jody T.Gunderson,Director of Finance Linda Burkhart,Director of Public Works Jolm Gibson, Assistant Director of Public Works Tim Royer,Director of Planning Brad Deets,Deputy City Clerk Rebecca D.Schuett,City Engineer Forrest Aldrich,City Attorney Steve Brick. (D)Open Forum (E)Agenda Approval -Council Member Bailey moved to approve the agenda,moving consideration of agenda item H3 prior to items HI and H2,and removing agenda item J5; seconded by Council Member Stanton.Roll call:Ayes:Bailey,Stanton,McGee,Harvey.Nays: None.Absent:Watts.Motion carried 4 -0 -1. (F)Mayor's Report -On Jan.10,Mayor Peard attended the Greater Des Moines Partnership Annual Ditmer,along with Council Members Bailey,Stanton,McGee and Watts and City Administrator/Clerk Kooistra.On Jan.14,he and Council Member McGee attended the Greater Des Moines Partnership Annual Legislative Reception.Mayor Peard and Council Member McGee also attended the Iowa Association of Business and Industry Legislative Reception on Jan.16.Mayor Peard will attend the Waukee Area Chamber of Commerce Annual Dinner on Jan.27,and has been asked to attend dinner and give a presentation at the Chinese New Year celebration being held at Waukee High School on Feb.2. (G)Presentations: 1)Quarterly Reports from Waukee Public Library,Waukee Fire Department,Waukee Area Chamber of Commerce -Reports made by Fire Chief Robinson,Library Director Mack,and Chamber President Colter. (H)Public Hearings: 3)On a Redevelopment Agreement between the City of Waukee and Shottenkirk Partnership, LP -Mayor Peard opened the public hearing and asked if any written correspondence had been received.City Administrator/Clerk Kooistra replied in the negative.Mayor Peard asked if anyone present wished to address the Council on the issue.Adam Doll,representing Shottenkirk Partnership,stated that the deadlines for submittal of the site plan and beginning of construction may need to be amended due to both the delayed approval of the Agreement and the deadlines imposed in the third amendment to the development agreement.Mr.Doll then asked if the deadline for completion of all improvements could also be changed in the third amendment,if necessary,Director of Planning Deets replied that such a change would require a fourth amendment.Council Member Bailey asked how long it would take to pay off the TIF if the Agreement were approved;Director of Community Development Gunderson replied that it would take approximately 5-6 years.Council Member Bailey questioned the outcome of the Agreement if the business were to close;M:r.Gunderson ] I answered that the Agreement allowed for it to be assigned or transferred.Mayor Peard declared the public hearing closed. 1)Resolution:Consideration of approval of a request by representatives of Shottenkirk Chevrolet for reconsideration of an ordinance to amend Chapter 300,Zoning Ordinance, City of Waukee,Iowa,by rezoning and changing certain property therein from M-IA [Limited Industrial District]to C-l [Community and Highway Service Commercial District];and amend the Official Zoning Map to show rezoning -Council Member Bailey moved to approve the resolution;seconded by Council Member McGee.Roll call:Ayes: Bailey,McGee,Harvey,Stanton.Nays:None.Absent:Watts.Motion carried 4 -0 -I. (Resolution #08-12) 2)On an ordinance to amend Chapter 300,Zoning Ordinance,City of Waukee,Iowa,by rezoning and changing certain property therein from M-IA [Limited Industrial District]to C-l [Community and Highway Service Commercial District];and amend the Official Zoning Map to show rezoning (a parcel known as Shottenkirk Chevrolet)-Mayor Peard opened the public hearing and asked if any written correspondence had been received.City Administrator/Clerk Kooistra replied in the negative.Mayor Peard asked if anyone present wished to address the Council on the issue;no one present addressed the Council.Mayor Peard declared the public heating closed. 3)MOVED FOR CONSIDERATION PRIOR TO AGENDA ITEM #HI (I)Public Hearing Action Items: 1)Ordinance:Consideration of approval of an ordinance to amend Chapter 300,Zoning Ordinance,City of Waukee,Iowa,by rezoning and changing certain property therein from M-IA [Limited Industrial District]to C-l [Community and Highway Service Commercial District];and amend the Official Zoning Map to show rezoning (a parcel known as Shottenkirk Chevrolet)[introduction,first reading]-Council Member Stanton introduced the ordinance and moved approval of the first reading of the ordinance in title only;seconded by Council Member Harvey.Director of Planning Deets gave a brief overview of tile rezoning request.Roll call:Ayes:Stanton,Harvey,McGee,Bailey.Nays:None.Absent: Watts.Motion carried 4 -0 -I.Deputy City Clerk Schuett read the ordinance in title only.
