WAUKEE CITY COUNCIL MINUTES
February 25,2008 ]
(A)Call to Order -The regular meeting of the Waukee City Council was called to order by Mayor
Peard at 7 :04 p.m.in the Council Chambers at City Hall.
(B)Pledge of Allegiance
(C)Roll Call-The following members were present:Mayor William F.Peard;Council Members
Don L.Bailey,Jr.;Casey L.Harvey;Darlene Stanton.Absent:Council Members C.Isaiah
McGee;Mike Watts.Council Member McGee arrived at 9:10 p.m.
Also present:City Administrator/Clerk Jeff Kooistra,Director of Community Development Jody
T.Gunderson,Director of Finance Linda Burkhart,Director of Public Works John Gibson,
Director of Planning Brad Deets,City Planner Ben Landhauser,Public Works Administrative
Coordinator Beth Richardson,City Engineer Mikelis Briedis,City Attorney Steve Brick.

(E)Agenda Approval-Council Member Stanton moved to approve the agenda,removing item
#Jl G from the Consent Agenda for separate consideration and removing item #Jl2;seconded by
Council Member Harvey.Roll call:Ayes:Stanton,Harvey,Bailey.Nays:None.Absent:
McGee,Watts.Motion carried 3 -0 -2.
(F)Mayor's Report -On Feb,13,Mayor Peard attended a ribbon cutting at Waukee Wellness,as
well as the first organizational meeting of the Waukee Economic Development Corporation.On
Feb.18,he shot a congratulatory video for Council Member McGee's inclusion in the Des
Moines Business Record's 2008 "Forty Under 40."On Feb.19,he attended the Library's "Big
Read"kick-off festivities,along with CouncillVIembers Stanton and Harvey.Mayor Peard
attended an Iowa League of Cities workshop along with City Administrator/Clerk Kooistra,and
the Waukee Area Chamber of Commerce monthly board meeting on Feb.20.On Feb.21,he
welcomed Sen.Charles Grassley at Waukee High School and presented the senator with a letter
requesting continued assistance with federal funding for the Alice's Road Corridor project.
(G)Presentations:
1)Annual report from Waukee Police Department -Report made by Police Sgt.Troy Mapes.
2)Design Alliance on the Waukee Public Works Facility Project-Jerry Purdy of Design
Alliance presented a recommended design for the Waukee Public Works Facility Project.
Also in attendance were Damir Zubovic of Design Alliance and Steve Bennett of CSI.
(II)Public Hearings:
1)On the City of Waukee Comprehensive Plan -Mayor Peard opened the public hearing and
asked if any written correspondence had been received.City Administrator/Clerk Kooistra
replied in the negative.Mayor Peard asked if anyone present wished to address the Council
on the issue.Director of Planning Deets explained that due to weather conditions,
representatives of Gould Evans were not in attendance to present the Comprehensive Plan to
the Council.Council Member Bailey asked iflack of presentation from Gould Evans would
result in any discounted fees from that finn;City staff will research the matter.After a brief
discussion and at the request of Council Member Bailey,Council Member Stanton moved to
continue the public hearing at the March 10,2008 regular meeting;seconded by Council
Member Harvey.Roll call:Ayes:Stanton,Harvey,Bailey.Nays:None.Absent:McGee,
Watts.Motion carried 3 -0 -2.I
2)On the authorization of a Loan Agreement and the issuance of not to exceed $300,000
General Obligation Capital Loan Notes,Taxable Series 2008A,of the City of Waukee,
Iowa -Mayor Peard opened the public hearing and asked if any written correspondence had
been received.City Administrator/Clerk Kooistra replied in the negative.Mayor Peard asked
if anyone present wished to address the Council on the issue.City Administrator/Clerk
Kooistra explained that the notes were to purchase the next option on property intended for
the Copeland Recreation and Sports Complex.Mayor Peard declared the public hearing
closed.
3)On the proposed issuance of not to exceed $2,600,000 General Obligation Bonds of the
City of Waukee,Iowa -Mayor Peard announced that this was now the time for meeting on
the matter of issuance of not to exceed $2,600,000 General Obligation Bonds of the City of
Waukee,Iowa,in order to provide funds to pay costs of aiding in the planning,undertaking
and carrying out of urban renewal proj ects under the authority of Iowa Code Chapter 403,
including construction and equipment of a public works building,and that notice had been
published as provided by Sections 403.12,384.25 and 384.26 of the Code ofIowa,of the
proposal to issue bonds and the right to petition for an election.Mayor Peard asked whether
any petition had been filed in the Clerk's office,as contemplated in Section 384.26 of the
City Code ofIowa;City Administrator/Clerk Kooistra reported that such a petition had been
filed requesting that the question of issuing the bonds be submitted to the qualified electors of
the City.Mayor Peard asked if the petition had been reviewed and qualified;Mr.Kooistra
replied that it had not yet.Council Member Stanton moved to examine the petition filed to
determine whether the same is legal and sufficient and also whether it bears the requisite
number of signatures pursuant to the provisions of Sections 384.26 and 362.4 of the City
Code of Iowa;seconded by Council Member Bailey.At the request of Council Member
Bailey,Jenny Blankenship ofPFM explained how the general obligation bonds would be
paid back with urban renewal revenues and revenues generated through the gas utility,and
not through taxes.She also stated that the proposed bonds would be tax-exempt at both the
federal and state level.Council Member Bailey suggested that City staff hold a public
information forum for citizens that had questions about the project.Council Member Stanton
expressed frustration that those circulating the petition and many who signed the petition had
not contacted the Councilor City staff beforehand with questions about the project;Council
Member Bailey agreed.Roll call:Ayes:Stanton,Bailey,Harvey.Nays:None.Absent:
McGee,Watts.Motion carried 3 -0 -2.Council Member Stanton moved to adjourn the
public hearing and defer action to a meeting to be held at 7:00 p.m.,on the lO'h day of March,
2008,at this place;seconded by Council Member Harvey.Roll call:Ayes:Stanton,Harvey,
Bailey.Nays:None.Absent:McGee,Watts.Motion carried 3 -0 -2.As a result ofthe
action of the Council,Mayor Peard announced that agenda items #14 and IS are removed
from the agenda.

Jenny Blankenship ofPFM reviewed the bid tabulation and recommended the proposal made

proposal to purchase $290,000 General Obligation Capital Loan Notes,Taxable Series
2008A -Council Member Bailey moved to approve the resolution,accepting the proposal to
purchase made by First American Bank of Clive,Iowa;seconded by Council Member
Harvey.Roll call:Ayes:Bailey,Harvey,Stanton.Nays:None.Absent:McGee,Watts.

Municipal Code,regarding speed limits on some streets within the city limits of the City of

Administrator/Clerk Kooistra reported that he'd received a telephone call from James Dewitt,
Jr.,who was unable to attend the meeting but would like the opportunity to address the Council

6th St.;Greg Breuer,610 6th St.;and Troy Mapes,235 Northview Dr.,spoke in opposition of
increasing the speed limit along 6th St.Council Member Stanton asked that Section 2 of the
proposed ordinance be restructured to a graduated speed zone along 6th St.Council Member
Bailey requested Greg Roth of Veenstra &Kimm contact Sgt.Mapes regarding the proposed
