(A)Call to Order -The regular meeting of the Waukee City Council was called to order by Mayor
Peard at 7 :02 p.m.in the Council Chambers at City Hall.
(B)Pledge of Allegiance
(C)Roll Call-The following members were present:Mayor William F.Peard;Council Members
Donald L.Bailey,Jr.;Casey L.Harvey;C.Isaiah McGee;Mike Watts.Absent:Council Member
Darlene Stanton.
Also present:City Administrator/Clerk Jeff Kooistra,Director of Community Development Jody
T.Gunderson,Director of Finance Linda Burkhart,Director of Public Works John Gibson,
Assistant Director of Public Works Tim Royer,Director of Planning Brad Deets,Fire Chief Clint
Robinson,Deputy City Clerk Rebecca D.Schuett,City Engineer Mikelis Briedis,City Attomey
Jim Brick.
(D)Open Forum -Rebecca Johnson of the Waukee Public Library Board of Trustees gave an
update on culminating events for The Big Read program.
(E)Agenda Approval-Council Member Watts moved to approve the agenda;seconded by Council
Member McGee.Roll call:Ayes:Watts,McGee,Harvey,Bailey.Nays:None.Absent:Stanton.
Motion carried 4 -°-I.
(F)Mayor's Report -On March 20,Mayor Peard attended the metro mayor's hmcheon.Mayor
Peard then presented a certificate of appreciation to video camera operator Kevin Delawyer,who
is leaving his position with the City.
(G)Presentations:
1)Recognition of outgoing Planning &Zoning Commissioner Chris Wilson -Mayor Peard
recognized Chris Wilson's service on the Planning &Zoning Commission.
(H)Public Hearings:
1)On an ordinance to amend Chapter 300,Zoning Ordinance,City of Waukee,Iowa,by
rezoning and changing certain property therein from A-I [Agricultural District]to C-I
[Community and Highway Service Commercial District];and amend the Official Zoning
Map to show rezoning (a parcel to be known as Broderick Property,Phase I)-Mayor
Pcard opened the public hearing and asked if any written correspondence had been received;
City Administrator/Clerk Kooistra replied in the negative.Mayor Peard asked if anyone
present wished to address the Council on the issue.Bill Ludwig of William Ludwig and
Associates gave a brief overview of the rezoning request.Council Member Harvey asked if
any businesses were planned to locate on the site at this time;Director of PI arming Deets
replied that the rezoning application was necessary in order for the YMCA Project rezoning
to move forward,specifically related to ingress/egress.City staff recommend a zoning
change agreement fOTthe property,which would limit specific allowable uses until the larger
Broderick parcel is rezoned as a Planned Development Overlay District.Mayor Peard
declared the public hearing closed.
2)On an ordinance to amend Chapter 300,Zoning Ordinance,City of Waukee,Iowa,by
rezoning and changing certain property therein from A-I [Agricultural District]to C-IB
[Large Scale Commercial District];and then by rezoning and changing certain property
therein from C-IB [Large Scale Commercial District]to PD-I [Planned Development
Overlay District];and amend the Official Zoning Map to show rezoning (YMCA Project)-
Mayor Peard opened the public hearing and asked if any written correspondence had been
received;City Administrator/Clerk Kooistra replied in the negative.Mayor Peard asked if
anyone present wished to address the Council on the issue.Council Member Bailey
expressed concern that the engineer for the proj ect had stated that there was no legal
requirement for the YMCA to share in the cost of the construction of Sunrise Dr.,as it was
not needed for that project.Vitus Bering of SVP A Architects and Bill Ludwig of William
Ludwig and Associates stated that Ladco Development agreed to bear the full costs
associated with the construction of Sunrise Dr.as part of the overall development.Director
of PI arming Deets clarified that a development agreement was being drafted by the City
Attomey to address certain issues in the development,including roadway construction
responsibilities;the agreement will be presented to the Council prior to the third reading of
the ordinance,Mayor Peard declared the public hearing closed.
3)On an ordinance to amend Chapter 301,Zoning Ordinance,City of Waukee,Iowa,by
amending Chapter 301.4,Establishment of Districts:Provisions for Official Zoning Map,
by repealing said section and enacting in lieu thereof the re-adoption of the Official
Zoning Map -Mayor Peard opened the public hearing and asked if any written
correspondence had been received;City Administrator/Clerk Kooistra replied in the negative.
Mayor Peard asked if anyone present wished to address the Council on the issue.Director of
Planning Deets gave a brief overview of the Official Zoning Map revisions.Mayor Peard
declared the public hearing closed.

Deets explained that the district was a precursor to the current PD-I Planned Development

Overlay District and that the R-5 district may possibly be eliminated in the future.Roll call:

3)Resolution:Consideration of approval of the final plat for Glynn Village Plat 5 -Council
Member Watts moved to approve the resolution;seconded by Council Member Watts.Council
Member Harvey asked if the City would require documentation that the outlots would be
deeded over to the abutting property owners;Director of Planning Deets replied that such
documentation was not required by the City.Council Member Watts questioned why fencing
was allowed in rear yards in Glynn Village when such fencing violated the covenants for the
subdivision;Mr.Deets explained that the covenants included specific fencing requirements but
did not prohibit fencing in rear yards.Council Member Watts then asked if the City was
concerned with drainage issues in rear yards that had been fenced;Mr.Deets answered that the
City has the authority to deny fencing building permit applications if there are drainage
concerns.Roll call:Ayes:Watts,Harvey,McGee,Bailey.Nays:None.Absent:Stanton.

4)Resolution:Consideration of approval of a resolution regarding terminating participation in
the Des Moines Regional Transit Authority -Council Member Watts moved to approve the
resolution;seconded by Council Member Harvey.City Administrator/Clerk Kooistra gave a
brief overview of the process to follow if the Council were to approve the resolution.Council
Member McGee asked if any additional correspondence had been received from DART on the
matter,other than the letter dated 03/18/08;Mr.Kooistra replied in the negative.Council
Member Harvey asked if the proposed resolution attempted to terminate participation as though
the City had never joined DART;Mr.Kooistra replied in the affirmative.Roll call:Ayes:
