(A)Call to Order -The regular meeting of the Waukee City Council was called to order by Mayor
Pro Tem McGee at 7:02 p.m.in the Council Chambers at City Hall.
(B)Pledge of Allegiance
(C)Roll Call-The following members were present:Council Members Donald L.Bailey,JI.;Casey
L.Harvey;C.Isaiah McGee;Darlene Stanton;Mike Watts.Absent:Mayor William F.Peard.
Also present:City Administrator/Clerk Jeff Kooistra,Director of Community Development Jody
T.Gunderson,Director of Finance Linda Burkhart,Director of Public Works John Gibson,
Assistant Director of Public Works Tim Royer,Director of Planning Brad Deets,City Planner
Ben Landhauser,Deputy City Clerk Rebecca D.Schuett,City Engineer Mikelis Briedis,City

(D)Open Forum -Tom Barrett,27960 S Ave.,Dallas Center,thanked the Council for their support
of his opposition to the Site G location proposed for the West Metro Regional Airport and
suggested the Cities ofWaulcee and Dallas Center approve a joint resolution pledging no funding
toward the Airport,
(E)Agenda Approval-Council Member Bailey moved to approve the agenda,removing
consideration of agenda item #J7;seconded by Council Member Stanton.Roll call:Ayes:

Council Member Watts moved to approve the Consent Agenda;seconded by Council Member
Stanton.Roll call:Ayes:Watts,Stanton,McGee,Bailey,Harvey.Nays:None.Motion
carried 5 -O.
2)Ordinance:Consideration of approval of an ordinance to amend Chapter 2I3A,Waukee
Municipal Code,by amending Section 213A.12 concerning charges for the collection,processing
and marketing of solid waste and recyclable materials [introduction,first reading]-Council
Member Watts moved to approve the ordinance;seconded by Council Member Harvey.
Director of Public Works Gibson gave a PowerPoint presentation on the history of the City's
solid waste and recyclable rates,and on the rate increase proposed in the ordinance.Council
Member Stanton questioned if a portion of the rate increase was to help pay for landfill
upgrades;Mr.Gibson answered in the affirmative,clarifying that the increase would allow the
landfill to conform with DNR standards.Council Member Watts amended the motion,
introducing the ordinance and moving to approve the first reading of the ordinance in title only;
Council Member Harvey amended the second.Roll call:Ayes:Watts,Harvey,McGee,Bailey,
Stanton.Nays:None.Motion carried 5 -O.When voicing his vote,Council Member Bailey
stated that he would approve the first reading of the ordinance with the understanding that the
proposed rate increase would be explained to him more thoroughly prior to approval of the
third and final reading.Deputy City Clerk Schuett read the ordinance in title only.
3)Ordinance:Consideration of approval of an ordinance to amend Chapter 300,Zoning
Ordinance,City of Waukee,IOlVa,by rezoning and changing certain property therein from
A-I [Agricultural District]to C-I [Community and Highway Service Commercial District];
and amend the Official Zoning Map to show rezoning (a parcel to be known as Broderick
Property,Phase 1)[second reading]-Council Member Stanton moved to approve the second
reading ofthe ordinance in title only;seconded by Council Member Harvey.Council Member
Watts asked if the third reading should be waived at tbis time;Director of Planning Deets stated
that City staff preferred approval oftbe second reading only at this time,as a signed
development agreement for the parcel had not yet been received.Roll call:Ayes:Stanton,
Harvey,Watts,Bailey,McGee.Nays:None.Motion carried 5 -O.Deputy City Clerk Schuett
read the ordinance in title only.
4)Ordinance:Consideration of approval of an ordinance to amend Chapter 300,Zoning
Ordinance,City of Waukee,IOlVa,by rezoning and changing certain property therein from
A-I [Agricultural District]to C-IB [Large Scale Commercial District];and then by rezoning
and changing certain property therein from C-IB [Large Scale Commercial District]to PD-I
[Planned Development Overlay District];and amend the Official Zoning Map to show
rezoning (YMCA Project)[second reading]-Council Member Stanton moved to approve the
second reading oftbe ordinance in title only;seconded by Council Member Watts.Director of
Planning Deets explained that the proposed ordinance had been updated with a revised legal
description,as the applicant wished to modify the rezoning for a smaller area.The City
Attorney advised that the revised ordinance could move forward without a rescheduled public
hearing.Roll call:Ayes:Stanton,Watts,McGee,Bailey,Harvey.Nays:None.Motion carried
5 -O.Deputy City Clerk Schuett read the ordinance in title only.
5)Ordinance:Consideration of approval of an ordinance to amend Chapter 301,Zoning
Ordinance,City of Waukee,IOlVa,by amending Chapter 301.4,Establishment of Districts:
Provisions for Official Zoning Map,by repealing said section and enacting in lieu thereof I
the re-adoption of the Official Zoning Map [second,third (final)reading]-Council Member
Harvey moved to approve the second reading of the ordinance in title only,waive the third
reading and place the ordinance on final passage;seconded by Council Member Watts.Roll

Deputy City Clerk Schuett read the ordinance in title only.(Ordinance #2627)
6)Discussion:West Metro Airport Site Selection -Council Member Stanton stated that,while
she still had no interest in the City joining the West Metro Regional Airport Authority,two of
her major concerns regarding the airport had been satisfied,namely:1)that the airport not
locate on the Barrett Century Farm,and 2)that the project be funded privately.City
Administrator/Clerk Kooistra reviewed maps showing the airport location and runway
alignment approved by the Authority,as well as its location within Waukee's proposed
annexation area and its proximity to the Copeland Recreation and Sports Complex.Mr.
Kooistra stated his understanding that the project was to be funded through private sources,
then added that an environmental impact study had yet to be conducted for the site.Council
Member McGee questioned if the City couldjoin the Authority without committing to any
funding for the project.City Attomey Brick explained Iowa law regarding airport authorities,
stating that any financial obligations incurred by such authorities must be satisfied by the
membership of that authority.Mr.Brick also discussed an airport authority's power to levy
taxes.Council Member McGee expressed his cone em that the City would have difficulty
influencing the Authority if not a member;Council Member Stanton disagreed.Council
Member Bailey asked ifthe City could agree to continue its opposition to the airport location
on behalf of the affected property owners as all incentive toward voluntary annexation into
Waukee by those property owners,then questioned if the Authority could condemn land within
Waukee city limits.Mr.Brick answered that he would research the matter,adding that any
rezoning,plat or site plan within Waukee city limits would need to be considered by the
Council and conform to the City's zoning ordinance and comprehensive plan.Council Member
Watts stated that the City need only annex to within close proximity of the proposed airport,as
any development within two miles of city limits must be approved by the Council.Mr.Brick
clarified that the City had the authority to review such development,but that restrictions on that
authority were not defined by the State Legislature.Mr.Kooistra mentioned that on 03/18,the
Dallas County Planning and Zoning Commission had approved the rezoning of the airport site
to allow for such a use.Tom Barrett,27960 S Ave.,Dallas Center,added that the Dallas
County Board of Supervisors had met on 04/07 and approved the first reading of the ordinance.
Council Member Stanton asked if County or City zoning would take precedence for the site if it
were annexed by Waukee;Mr.Brick replied that property newly annexed by the City was
brought in with agricultural zoning and that the City zoning ordinance and comprehensive plan
currently had no zoning classification for aviation purposes,which could require the property
owner to begin the rezoning process anew with the City if the property were annexed.Council
Member Stanton asked Mr.Barrett ifhe would consider voluntary aunexation into Waukee;
Mr.Barrett answered that he would need to consider the matter,then clarified that the Dallas
County Planning &Zoning Commission and Board of Supervisors had not approved the
rezoning of the property,but an amendment to the County zoning ordinance to include an
airport as an allowable use.In response to an earlier question from Council Member Bailey
regarding land condemnation and after researching the matter,Mr.Brick read from the Code of
Iowa that eminent domain cannot be used with city limits unless the Board of Supervisors
authorizes its use after a public hearing on the matter.Council Member Stanton asked Mr.
Kooistra to contact the individual members of the Board of Supervisors to gauge their opinion
