(A)Call to Order -The regular meeting of the Waukee City Council was called to order by Mayor
Peard at 7:03 p.m.in the Council Chambers at City Hall.
(B)Pledge of Allegiance
(C)Roll Call-The following members were present:Mayor William F.Peard;Council Members
Casey L.Harvey,C.Isaiah McGee,Mike Watts,Darlene Stanton.Absent:Council Member
Donald L.Bailey,JI.
Also present:City Administrator/Clerk Jeff Kooistra,Director of Finance Linda Burkhart,
Director of Public Works John Gibson,Director of Planning Brad Deets,City Planner Ben
Landhauser,Deputy City Clerk Rebecca D.Schuett,City Engineer Mikelis Briedis,City
Attorney Steve Brick.

(E)Agenda Approval-Council Member McGee moved to approve the agenda;seconded by
Council Member Harvey.Roll call:Ayes:McGee,Harvey,Stanton,Watts.Nays:None.
Absent:Bailey.Motion carried 4 -0 -1.
(F)Mayor's Report -On OSI1S,Mayor Peard attended the MPO Policy Committee meeting.He
has been asked to deliver a speech during the Memorial Day observances at the cemetery.On
OSI22,Waukee will host the Metro Mayor's meeting at Mickey'S Irish Pub,and on OS/08,Mayor
Peard attended the Waukee Area Leadership Institute graduation.
(G)Presentations:
1)Proclamation:Recognizing June 7,2008 as National Community Appreciation Day-
Mayor Peard read the proclamation aloud and presented it to Brad Jensen of New York Life,
sponsor of the event.MI.Jensen briefly reviewed the activities scheduled during the event.
2)Proclamation:Recognizing the contributions made to the City of Waukee by Jody T.
Gunderson as Director of Community Development -Mayor Peard read the proclamation
aloud and presented it and the Key to the City to MI.Gunderson.MI.Gunderson thanked the
mayor,council and City staff for their support during his employment with the City.
(II)Public Hearings:
1)On a proposed budget amendment for the City of Waukee for Fiscal Year 2008 -Mayor
Peard opened the public hearing and asked if any written correspondence had been received;
City Administrator/Clerk Kooistra replied in the negative.Mayor Peard asked if anyone
present wished to address the Council on the issue.Council Member McGee requested
clarification regarding additional grant revennes expected by the Library that are not included
in the amendment;Director of Finance Burkhart explained that an average grant amount,
which would include the Big Read grant,had already been budgeted.Mayor Peard declared
the public hearing closed.
2)On an ordinance to amend Chapter 300,Zoning Ordinance,City of Waukee,Iowa,by
amending Section 301.8 to add provisions regulating temporary uses and seasonal sales
events -Mayor Peard opened the public hearing and asked if any written correspondence had
been received;City Administrator/Clerk Kooistra replied in the negative.Mayor Peard asked
if anyone present wished to address the Council on the issue;no one in attendance addressed
the Council.Mayor Peard declared the public hearing closed.I
3)On the issuance of not to exceed $3,100,000 General Obligation Bonds of Waukee,Iowa-
Mayor Peard announced that this was now the time for meeting on the matter of issuance of
not to exceed $3,100,000 General Obligation Bonds of the City of Waukee,Iowa,in order to
provide funds to pay costs of aiding in the planning,undertaking and carrying out of urban
renewal projects under the authority ofIowa Code Chapter 403,including construction and
equipment of a public works building,and that notice had been published as provided by
Sections 403.12,384.25 and 384.26 of the Code ofIowa,of the proposal to issue bonds and
the right to petition for an election.Mayor Peard asked whether any petition had been filed in
the Clerk's office,as contemplated in Section 384.26 of the City Code ofIowa;City
Administrator/Clerk Kooistra replied that a petition was filed with the City on Friday,May
16,2008,requesting that the question of issuing the Bonds be submitted to the qualified
electors of the City.City staff is in the process of confirming the validity of the petition,and
will report back to the Council at the next Council meeting on June 2,2008.Council
Member Stanton moved to acknowledge receipt of the petition for election on the not to
exceed $3,100,000 General Obligation Bonds,and deferral of action to June 2,2008;
seconded by Council Member McGee.Roll call:Ayes:Stanton,McGee,Watts,Harvey.
Nays:None.Absent:Bailey.Motion carried 4 -0 -1.
4)On an ordinance to amend Chapter 300,Zoning Ordinance,City of Waukee,Iowa,by
rezoning and changing certain property therein from A-I [Agricultural District]to M-l
[Light Industrial District];and amend the Official Zoning Map to show rezoning (a parcel
to be known as City of Waukee Public Works Facility)-Mayor Peard opened the public
hearing and asked if any written correspondence had been received;City Administrator/Clerk
Kooistra replied in the negative.Mayor Peard asked if anyone present wished to address the
Council on the issue;no one in attendance addressed the Council.Mayor Peard declared the
public hearing closed.
(I)Public Heariug Action Items:
1)Resolution:Consideration of approval ofa budget amendment for the City of Waukee for
Fiscal Year 2008 -Council Member Stanton moved to approve the resolution;seconded by
Council Member Harvey.Director of Finance Burkhart gave a brief overview of the
proposed amendment.Roll call:Ayes:Stanton,Harvey,Watts,McGee.Nays:None.
Absent:Bailey.Motion carried 4 -0 -1.(Resolntion #08-103)
2)Ordinauce:Consideration of approval of an ordinance to amend Chapter 300,Zoning
Ordinance,City of Waukee,Iowa,by amending Section 301.8 to add provisions regulating
temporary uses and seasonal sales events [introduction,first reading]-Council Member
McGee introduced the ordinance.Council Member Harvey moved to approve the first
reading of the ordinance in title only;seconded by Council Member Stanton.Director of
Planning Deets gave a brief overview of the proposed ordinance.Council Member McGee
asked if business owners had been made aware of the proposed ordinance;Mr.Deets replied
in the negative,adding that City staff wished to have input from the Council on the ordinance
prior to contacting business owners.Council Member Harvey questioned if the proposed
ordinance would apply to Farmers Market vendors;Mr.Deets replied in the negative,as the
Farmers Market was a city-sanctioned event and not subject to the provisions of the proposed
ordinance.Waye Terry,215 Linden Dr.,addressed the Council and asked ifthose who
violated the ordinance would receive a warning prior to being ticketed;Mr.Deets replied that
City staff would need to work with such persons in a judicious manner.Council Member
Stanton wondered iflanguage defining non-profit organizations required clarification;City
Attorney Brick replied that such clarification was unnecessary.Roll call:Ayes:Harvey,

City Clerk Schuett read the ordinance in title only.

services -Council Member Harvey moved to approve the resolution;seconded by Council
Member McGee.Director of Planning Deets gave a brief overview of the proposal.Council
Member Harvey and Mayor Peard suggested the 12-inch average maximum grass height
requirement for properties in violation of the ordinance be reviewed.Council Member Watts
stated that the 12-inch requirement was reasonable for large,vacant commercial lots.City J
Attorney Brick clarified that 12 inches was the maximum height allowable by the Code of
Iowa.Roll call:Ayes:Harvey,McGee,Stanton,Watts.Nays:None.Absent:Bailey.

4)Ordinance:Consideration of approval of an ordinance to amend Chapter 501,Waukee
Municipal Code,regarding speed limits on some streets within the city limits of the City of
Waukee,Iowa [introduction,first reading]-Council Member McGee introduced the
ordinance and moved to approve the first reading of the ordinance in title only;seconded by
Council Member Watts.Director of Public Worlcs Gibson gave a brief overview of the
proposed ordinance.Council Member Stanton expressed reluctance to increase speed limits
above 25 mph in the residential areas along Waco PI.and Legacy Pointe Blvd.,adding that
the speed limit for both streets should be the same in similarly developed areas in order to
maintain consistency.Council Member Watts voiced his support for the speed limits
proposed in the ordinance,stating that Briclc Dr.,Waco PI.and Legacy Pointe Blvd.were
minor collector streets designed to move traffic more quiclcly.Council Member Stanton )
reiterated her desire to Iceep speed limits in residential areas at 25 mph,adding that future
street design throughout the City should be improved.Council Member McGee voiced his
support for the speed limits proposed in the ordinance due,in part,to the laclc of private

driveway access points along those streets noted in the ordinance.City Engineer Briedis
briefly spoke on street design as it related to development and how City traffic engineers
arrived at their recommendations for speed limits.Mayor Peard called for the question.Roll
call:Ayes:McGee,Watts,Harvey.Nays:Stanton.Absent:Bailey.Motion carried 3 -1-1.
